1. Information on how to enter and prize details set out in all communications regarding the
Commonwealth Bank of Australia Commonwealth Bank “Bowl Us Over to Win” Promotion (the
“Promotion”) form part of these Conditions of Entry. Any entry not complying with these Conditions of
Entry is invalid. Entry into this Promotion and the acceptance or receipt of a prize by any person is
deemed as acceptance of these Conditions of Entry.
2. The Promoter is the Commonwealth Bank of Australia ABN 48 123 123 124 of Level 13, Darling Park
Tower 1, 201 Sussex Street Sydney NSW 2000. Telephone: 13 2221 (the “Promoter”).
3. The Promotion commences at 9:00am AEDST on 10/12/2012 and closes at 5:00pm AEDST on
19/12/2012 (the “Promotion Period”).
4. Entry into the Promotion is open to businesses operating in Australia that satisfy the following eligibility
requirements (“Eligibility Requirements”):
• businesses must employ less than 200 employees; and
• businesses must be a registered business; and
• the Prize Takers (defined in Clause 7) of each winning business must be able to take the prize
on the date specified in Clause 8 below.
5. To enter, an authorised representative on behalf of an eligible business that satisfies the Eligibility
Requirements, must, during the Promotion Period:
• locate the “Bowl Us Over to Win” application (“Application”) on the Facebook Platform and
connect to the Application. The Application is located on the “Summer of Can Cricket” tab on
the Commonwealth Bank Business page on Facebook
(www.facebook.com/CommonwealthBankBusiness) or via the direct link to the Application on
www.smallbusinesscricket.com.au.
• follow the prompts provided by the Application, input the requested details including their full
name, valid email address, contact telephone number, the name, State/Territory, postcode and
number of employees of the eligible business, answer five (5) multiple choice answers and
provide a twenty-five (25) word or less answer to the following question “What is your top tip for
maintaining a great work/life balance?” and submit the fully completed entry form.
6. Entries will be divided into the following State/Territory groups according to the postcode of the eligible
business provided in the Application: NSW, ACT, VIC, QLD, SA/NT, WA and TAS (“each a Group”).
There will be one (1) winning business selected in each Group for this Promotion. The judging will take
place at Darling Park, Tower 1, 201 Sussex Street Sydney NSW 2000 on 20/12/2012. This is a game of
skill and chance plays no part in determining the winners. Each entry will be individually judged based
on literary and creative merit of the twenty-five (25) word or less answer provided to the promotional
question. The judges may select additional reserve entries which they determine to be the next best,
and record them in order of merit, in case of an invalid entry or ineligible eligible business. The
authorised representative of the respective winning businesses will be notified by phone and email. The
Promoter’s decision is final and no correspondence will be entered into.
7. The best valid entry in each Group, as determined by the judges, will win a premium hospitality package
for up to eight (Cool people at a Commonwealth Bank Series cricket match, as outlined in Clause 8 below,
valued at up to $5,988 each. Prizes will be awarded to the owners of the winning eligible businesses,
who will be responsible for allocating all premium hospitality package tickets included in the prize at their
absolute discretion (“Prize Takers”). All Prize Takers must meet the event venue and ticket terms and
conditions, including any applicable age restriction. Each prize includes: a premium hospitality package
for up to eight (Cool Prize Takers for the specified Commonwealth Bank Series cricket match; the
opportunity for one (1) Prize Taker, as determined by the owner of the winning eligible business, to meet
the captains of each cricket team; one (1) Commonwealth Bank Series replica playing t-shirt
personalised with the name of the winning business on the back for one (1) Prize Taker, to be
determined by the owner of the winning eligible business; one (1) Commonwealth Bank/Cricket of
Australia branded cap for one (1) Prize Taker, to be determined by the owner of the winning eligible
business; and one (1) night twin-share accommodation (in four (4) separate rooms) in the same capital
city as the Commonwealth Bank Series cricket match for each Prize Taker (if required). Spending
money, meals, insurance, transport to and from departure point, transfers, items of a personal nature,
in-room charges and all other ancillary costs are not included. Prize must be taken to coincide with the
Commonwealth Bank Series cricket match, as outlined in Clause 8 below, and is subject to booking
availability.
8. The Commonwealth Bank Series cricket match to be attended by Prize Takers for each Group is as
follows:
• SA - Commonwealth Bank Series - Australia v Sri Lanka match on 13/01/2013 at Adelaide
Oval, War Memorial Drive, North Adelaide, SA 5006;
• QLD - Commonwealth Bank Series - Australia v Sri Lanka match on 18/01/2013 at The Gabba,
411 Vulture Street Woolloongabba QLD 4102 ;
• TAS - Commonwealth Bank Series - Australia v Sri Lanka match on 23/01/2013 at Bellerive
Oval, 15 Derwent Street, Bellerive, TAS 7018;
• WA - Commonwealth Bank Series - Australia v Sri Lanka match on 03/02/2013 at WACA
Ground, Nelson Crescent, East Perth WA 6892;
• ACT - Commonwealth Bank Series - Australia v Sri Lanka match on 06/02/2013 at Manuka
Oval, Manuka Circle, Griffith ACT 2603;
• NSW – Commonwealth Bank Series – Australia v West Indies match on 08/02/2013 at the
SCG, Driver Avenue, Moore Park, NSW 2021; and
• VIC - Commonwealth Bank Series - Australia v Sri Lanka match on 10/02/2013 at the MCG,
Brunton Avenue, East Melbourne ,VIC 3002.
9. Prizes do not include any travel to and from the event location and all costs associated with travel will be
the responsibility of the Prize Takers. Any Prize Takers who utilize the accommodation component of
the prize may be required to present their credit card at time of accommodation check in.
10. During the entire duration of a prize, a nominated parent/guardian must accompany any Prize Taker
under 18 years of age. At least one (1) representative employed by the Promoter will attend the
premium hospitality package component of the prize with the Prize Takers.
11. If for any reason a Prize Taker does not take a prize (or an element of a prize) at the time stipulated by
the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for
cash.
12. Prizes are subject to the standard terms and conditions of individual prize and service providers.
13. The Commonwealth Bank Series cricket match corporate box prizes are subject to the event venue and
ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers
hereby expressly reserve the right to eject any Prize Taker for any inappropriate behaviour, including
but not limited to intoxication, whilst participating in any element of the prize.
14. The opportunity for one (1) Prize Taker from each winning business (as determined by the owner in
his/her absolute discretion) to meet the captains of each Cricket team awarded as part of each prize
provides those Prize Takers with an opportunity to meet the captains of each Cricket team, and an
opportunity to have a photograph taken with the captains. These elements of the prize are not
guaranteed and are subject to the goodwill of the captains on the day. The Promoter accepts no
responsibility and will not offer any alternative in the event that these elements of the prize cannot be
offered for any reason.
15. If a prize (or an element of a prize) is unavailable, the Promoter, in its discretion, reserves the right to
substitute the prize (or that element of the prize) with a prize to the equal value and/or specification.
16. Total prize pool value is up to $40,301. Prizes are not transferable, exchangeable and cannot be taken
as cash, unless otherwise specified.
17. The Promoter reserves the right, at any time, to verify the validity of entries and eligible businesses and
to disqualify any eligible business in which an authorised representative of that eligible business submits
an entry that is not in accordance with these Conditions of Entry or if an authorised representative of an
eligible business tampers with the entry process. Errors and omissions may be accepted at the
Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not
constitute a waiver of those rights.
18. All entries submitted become the property of the Promoter. Entries will not be returned to any eligible
business. Each authorised representative, on behalf of an eligible business, warrants to the Promoter
that each entry submitted is an original literary work that does not infringe the rights of any third party.
Authorised representatives, on behalf on an eligible business, agree to indemnify the Promoter against
all costs and claims by third parties arising from a breach of this warranty. Authorised representatives
consent to any use of their entry which may otherwise infringe their moral rights pursuant to the
Copyright Act 1968 (Cth).
19. Prize Takers consent to the Promoter using their name, likeness, image and/or voice (including
photograph, film and/or recording of the same) in any media for an unlimited period without
remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any
products manufactured, distributed and/or supplied by the Promoter.
20. If for any reason this Promotion is not capable of running as planned (including, but not limited to)
infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other
causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness,
integrity or proper conduct of this Promotion, the Promoter may take any action that may be available
including cancelling, terminating, modifying or suspending the Promotion. The Promoter reserves the
right in its sole discretion to disqualify any eligible business in which an authorised representative
tampers with the entry process.
21. The Promoter is not responsible for any problems or technical malfunction of any telephone network or
lines, computer online systems, servers or providers, computer equipment, software, technical problems
or traffic congestion on the internet or any website, or any combination thereof (including, but not limited
to) any injury or damage to participants or any other person’s computer related to or related to or
resulting from participation in or downloading any materials in this Promotion.
22. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify
the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as
any other implied warranties under the ASIC Act or similar consumer protection laws in the State and
Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be
excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers,
employees and agents) excludes all liability (including negligence), for any personal injury; or any loss
or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in
any way out of the Promotion.
23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the
Promoter (including its respective officers, employees and agents) is not responsible for and excludes
all liability (including negligence), for any personal injury; or any loss or damage (including loss of
opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any
technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any
theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost,
altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason
beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these
Conditions of Entry; (e) if any Commonwealth Bank Series cricket match or meeting of the Cricket team
captains is cancelled or delayed for any reason beyond the reasonable control of the Promoter; (f) any
tax liability incurred by an eligible business; or (g) taking of a prize.
24. All entries become the sole property of the Promoter. The Promoter collects eligible businesses
information so that it may process your entry, administer this Promotion and contact the eligible
business regarding information on products or services that may be of benefit or interest to the eligible
business. The Promoter may communicate personal information to external providers and organisations
to which it may outsource certain functions. Authorised representatives on behalf of an eligible business
may access and correct information by contacting the Privacy Officer, Customer Relations,
Commonwealth Bank Group, Reply Paid 41, NSW 2001, by calling the Promoter on 13 2221 or by
visiting any branch of the Promoter. Please refer to the Privacy Policy available at
www.commbank.com.au or on request from any Commonwealth Bank branch.
25. These Conditions of Entry shall be governed by the laws of Australia and each entrant agrees to submit
to the non-exclusive jurisdiction of Australia.
