1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
3. Employees (and their immediate families) of the Promoter, participating Hoyts cinemas and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Promotion commences at 26/12/2012 and ends at 11:59pm AEDST on 20/01/2013 (“Promotional Period”).
5. Participation in the promotion is via either of the three (3) below options:
a) To be eligible to enter and receive a scratch card, individuals must purchase at least one (1) movie ticket from a participating Hoyts box office during the Promotional Period. Entrants must then scratch their scratch card to reveal whether or not they have won an instant prize. To claim a prize, entrants must follow the instructions provided in the table below. One (1) scratch card will be awarded to the entrant per movie ticket purchased in a single transaction at a participating Hoyts box office; OR
b) To be eligible to enter and receive the opportunity to scratch a virtual scratch card, individuals must visit the official Hoyts website
www.hoyts.com.au and purchase at least one (1) movie ticket during the Promotional Period. Upon completion of a successful transaction entrants will receive a booking confirmation email with a link to access the promotional website
www.hoyts.com.au/summer where the entrant will be presented with a virtual scratch card. Entrants must then scratch the virtual scratch card with their mouse cursor to reveal instantly online whether or not they have won an instant prize. To claim a prize, entrants must follow the instructions provided in the table below. One (1) virtual scratch card will be awarded to the entrant per movie ticket purchased in a single transaction online at the official Hoyts website; OR
c) To be eligible to enter and receive a scratch card, individuals must purchase at least one (1) Candy Bar item from a participating Hoyts box office during the Promotional Period. Entrants must then scratch their scratch card to reveal whether or not they have won an instant prize. To claim a prize, entrants must follow the instructions provided in the table below. One (1) scratch card will be awarded to the entrant per Candy Bar transaction at a participating Hoyts box office.
6. All valid entries received from winners and non-winners of an instant prize will have the opportunity to enter the unclaimed prize draw. Entrants must visit
www.hoyts.com.au/unclaimedsummer follow the prompts to the competition unclaimed prize draw entry page, become a Hoyts Insider or Hoyts Rewards member (if not either already), input the requested details and submit the fully completed online entry form during the Promotional Period.
7. Incomplete, indecipherable or illegible entries will be deemed invalid.
8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. Entrants must retain their original Hoyts purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify that the purchase was made during the Promotional Period but prior to entry.
10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
11. The Promoter’s decision is final and no correspondence will be entered into.

16. Redeeming an instant win prize online: Where applicable, entrants must visit the Hoyts website

17. Redeeming an instant win prize at a participating Hoyts box office: Entrants will be required to present and surrender their winning scratch card or a copy of their winner notification from their winning virtual scratch card to a member of staff at a participating Hoyts box office in order to receive their prize. Validly dates for instant prizes are detailed in the table above.
18. Any ancillary costs associated with redeeming a voucher/gift card/movie ticket are not included. Any unused balance of the voucher/gift card will not be awarded as cash. Redemption of the voucher/gift card/movie ticket is subject to any terms and conditions of the issuer including those specified on the voucher/gift card/movie ticket.
19. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
20. Total prize pool value is $4,182,229. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
21. A draw for any unclaimed Samsung Galaxy Note or PlayStation 3 Essentials Pack prizes may take place on 04/03/2013 at 12:00pm at Level 50, 680 George Street, Sydney NSW 2000 subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw. Their names will be published online at
www.hoyts.com.au/summerwinners on 06/03 /2013 for a period of 28 days.
22. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
24. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
25. Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. There will be a total of 2,700,300 scratch cards printed for this promotion. There will be a total of 540,600 winning instant win scratch cards and a total of 29,400 online instant win notifications for this promotion.
26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
28. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
