Entry is only open to Australian residents aged 18 years and older.
Employees (and their immediate families) of the Promoter, participating pet retailers, vet practices, online retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. Promotion starts 31/8/12 and ends at 11.59pm AEST on 30/9/12. Multiple entries accepted. Each entry must be an original work and all all entrants agree that their entries do not contain any material that infringes the rights of anyone else. Images will be judged based on creativity. Prize pool: 10x Australian Mongrel books signed by David Darcy. Each winner will receive 1 book valued at $50.
Winners will be announced on friendsfurever.com.au. If any prize is unavailable, the Promoter, at its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

TERMS & CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years and older. Employees (and their immediate families) of the Promoter, Vet Shop Australia, vet practices and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. The Promoter will conduct the promotion in the period commencing at 12:01am AEST on 01/08/2012 and closing at 11:59pm AEST on 30/09/2012 for purchases made online and 5pm AEST on 30/09/2012 for purchases made via phone (“Promotional Period”). Local call costs apply. Phone service available from 9am AEST to 5pm AEST Monday to Friday.
4. To be eligible to participate in the promotion, individuals must purchase any 1 x 6-pack of Bayer Advantage®, Advantix® or Advocate® products from Vet Shop Australia either at
http://www.vetshopaustralia.com.au or through calling 1300 838 7467 and ordering from a sales representative during the Promotional Period.
5. All entries received during the Promotional Period will go into a draw to select the major prize winner.
6. Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement, as outlined in clause 4 above; and (b) each entry submitted by the same person must feature the same email address. For the sake of clarity, if 2 x 6-packs of Bayer Advantage®, Advantix® or Advocate® products are bought in one transaction from the Vet Shop Australia website during the Promotional Period, an entrant will receive two (2) entries into the draw.
7. Entrants must retain their original purchase receipt(s) and original product barcode(s) for all entries as proof of purchase and provide their proof of purchase to the Promoter when requested. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the online retailer of the purchase and that the purchase was made during the Promotional Period but prior to entry.
8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. Incomplete, inaudible or indecipherable entries will be deemed invalid.
10. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
11. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
13. The prize draw will take place at Anisimoff Legal, Level 5, 492 St Kilda Road, Victoria 3004 on 08/10/2012 at 1pm AEDST. Winners will be notified via telephone within two (2) business days of the draw and in writing. The winner of the Major Prize will have his/her name published in The Australian on 12/10/2012.
14. The first valid entry drawn will win the Major Prize. The Major Prize is an Apple Entertainment Pack valued at $8,506 including: 1 x Macbook Pro (MD104X/A, 2.6GZ, 750GB, 15”) valued at $2,499; 1 x white iPad 3rd generation including Wi-Fi (64GB) valued at $899; 1 x Apple TV valued at $109; 1 x Samsung LCD Television (UA55ES8000MXXY) valued at $3,999; and $1,000 worth of iTunes vouchers.
15. The next fifty (50) valid entries that are drawn will each win a Red Dog DVD valued at $39.95.
16. The Promoter’s decision is final in relation to all aspects of this promotion and no correspondence will be entered into.
17. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
18. If a prize is unavailable, the Promoter, at its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. Total national prize pool value is $10,503.50. Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
20. A draw for any unclaimed prizes may take place on 08/01/2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified via telephone within two (2) business days of the draw and in writing, and the name of the Major Prize winner (if awarded in the unclaimed prize draw) will be published in The Australian on 11/01/2013.
21. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
25. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
26. As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
