Competition Terms and Conditions

PARTICIPATION
This competition ("Competition") is conducted by Australian Associated Motor Insurers Limited ABN 92 004 791 744 ("Promoter"), c/o Level 11, 447 Collins St, Melbourne Vic 3000.
Entry to the Competition constitutes acceptance of these terms and conditions. All entry instructions and prize information published by the Promoter forms part of these terms and conditions. Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
The Competition is only open to individuals who: (i) are residents of Australia aged 18 years or older as at time of entry; and (ii) are not employees of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) are not a spouse, de-facto partner, child or sibling (whether natural or by adoption) or parent of such an employee ("Eligible Entrant").
Competition entry commences at 09:00 (AEDT) on 04/02/2013 and closes at 17:00 (AEDT) on 17/03/2013  ("Entry Period").
Except as otherwise indicated, all amounts stated in these conditions are stated in Australian dollars.
ENTRY
This Competition is a game of skill. Chance plays no part in determining the winner. To enter the Competition, an Eligible Entrant must, during the Entry Period:
Use a compatible browser to visit http://competitions.aami.com.au/dingsofourlives/ (“Competition Website”), “like” the page, then enter their ‘unbelievable ding story’ limited to less than 140 characters and fill in their details on the entry form (including name, email address, mobile phone number and postcode); or
Use a compatible browser to Log onto their Twitter account, and “tweet” their ‘unbelievable ding story’ in less than 140 characters and assign the hashtag #dingsofourlives. Eligible Entrants will then receive a response from the Promoter and must follow the instructions to submit their details (including name, email address, mobile phone number and postcode) in order to complete the entry.
Entrants consent to the Promoter publishing their first name along with their entry on the Competition Website.
All Eligible Entrants must ensure that the Promoter receives their complete entry during the Entry Period.  Entries will be deemed accepted at the time that the Promoter is satisfied that the relevant requirements under Condition 6 have been met and not at the time of submission by the Eligible Entrant.  The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or delays or failures in any telecommunications service or equipment.
Multiple entries are permitted, but each entry must comply with these terms and conditions. Each entrant must create their own entry and only submit an entry in their own name. Entries that are found to have been derived from third party work will be considered invalid and, if awarded a prize, the prize must be returned to the Promoter.
Each entrant warrants and agrees that:
the entrant has created the entry themselves;
the entrant will not submit material in their entry that is copyrighted or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless the entrant is the owner of such rights;
the entry has not been previously published in any other medium or forum worldwide;
they will not submit material that is unlawful, obscene, defamatory, derogatory, abusive, harmful to any person or entity, or otherwise inappropriate or offensive; and
the entrant has not granted rights to their entry to any other person which is inconsistent with the rights granted to the Promoter under these conditions.
Each entrant acknowledges and agrees that the Promoter (and each of its assignees and licensees) has the right, in its absolute discretion, to edit, amend, copy, reproduce, use, publish, broadcast and communicate to the public, the entry in any media including television and the internet, without any further consultation, reference, payment or other compensation. Each entrant also agrees that they will not make any claim against the Promoter (or its assignees and licensees) arising form the exercise of these rights, including claims in relation to any moral rights that they may otherwise have.
The Promoter may, in its absolute discretion, declare any (or all) entries made by an Eligible Entrant invalid if the Eligible Entrant tampers with the entry process, benefits from such tampering or submits an entry that is illegible, incomplete or not in accordance with these conditions or otherwise calculated to jeopardise the fair and proper conduct of the Competition.
The Promoter reserves the right, at any time, to require an entrant to verify the validity of their entry (including providing proof of identity, eligibility and age) and to disqualify any entrant who has breached these terms and conditions. Proof considered suitable for verification is at the Promoter’s discretion.
INTERNET ENTRIES
Eligible Entrants must submit their internet entries manually. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.
Cost of entry via the internet is free, but internet connection and usage rates may apply and remain an entrant’s responsibility. Eligible Entrants should obtain details of such costs from their service providers.
JUDGING AND PRIZE
The competition judging for the prize will take place at 09:00 (AEDT) on 26/03/2013 at Level 11, 447 Collins St, Melbourne Vic 3000.
There is only one prize.  The Eligible Entrant judged to have the most funny, original and creative entry will be selected as the winner. The Prize is $10,000, issued as two $5,000 Visa debit cards. Visa’s relevant terms of use apply, including card expiry dates. The Promoter may (but is not obliged to) use the winning entry as the basis for an AAMI advertisement.
PROVISIONS APPLICABLE TO THE PRIZE GENERALLY
The prize is non-transferable, non-refundable, non-exchangeable, and non-replaceable.  Any tax on the prize is the responsibility of the winner.  Independent financial advice should be sought by any person participating in this Competition.
WINNER OF THE PRIZE
The winner will be notified by a phone call and a written message that will be sent by email to the email address provided by them in their entry within 2 days of the winner being selected.
The prize notification will state that the winner has won the prize and will include details as to how the prize will be provided.
The winner’s name will be published on the Competition Website within seven (7) days of the winner being selected.
If : (i) the prize is not claimed by the winner or the Promoter has been unable to successfully notify the winner following reasonable attempts; or (ii) the winner is determined by the Promoter to be ineligible in accordance with these conditions, the prize will be awarded to the entry judged to be the next most original and creative from the pool of entries originally eligible to win the prize. The resulting winner will be notified by a phone call and a written message that will be sent by e-mail to the e-mail address provided by them in their entry.
GENERAL
The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Eligible Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); (v) any delay in delivery, or failure of safe delivery of the Prize.
All of the Promoter's decisions in relation to all aspects of this Competition are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If for any reason any aspect of this Competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, fraud, technical failures or any other cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Competition, or invalidate any affected entries.
The Promoter and its associated agencies and companies (including their respective officers, employees and agents) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Competition or accepting or using the prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
The winner consents by entering the Competition to the Promoter using their name, likeness, image and/or voice (including a photograph, film and/or recording of them) in any media at any time or times without compensation, financial or otherwise, for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
PRIVACY AND MARKETING CONSENT AND DISCLOSURE
Privacy Statement. Entrants' personal information will be collected by or on behalf of the Promoter to enable the Promoter and its agencies to administer the Competition and may also be used by the Promoter, its agents, contractors and related companies, for the purposes of carrying out planning, product development and designing future promotional campaigns. The personal information of the winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers. Entrants’ first names may be published along with their entry on the Competition Website, and the winner’s name will also be published on the Competition Website (see Condition 21). By entering this Competition, each entrant consents to the use of their personal information as described. Persons may contact the Promoter by calling 13 22 44 or sending an email to social@aami.com.au to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize. The collection, use and disclosure of all personal information is handled in accordance with the Promoter’s Privacy Policy available online at http://www.aami.com.au/customer-service/termsof-use or by calling 13 22 44.
If an entrant has marked the “opt-in” box on their entry form, the entrant consents to the Promoter using their information to send future communications about AAMI news and promotions via email or SMS. Entrants may unsubscribe from the Promoter’s marketing program at any time using information contained on the electronic message or by making a request during a telephone call.
Each entrant completely releases Facebook from any and all liability in relation to this Competition, and acknowledges that this Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook.
