TERMS AND CONDITIONS
By entering ‘Herald Sun Formula 1® Rolex Grand Prix Promotion’, you are agreeing to the following
terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry. Entry into the promotion is
deemed acceptance of these terms and conditions.
2. WHO CAN ENTER
2.1 Subject to clauses 2.2 and 2.3 entry is open to residents of VIC only.
2.2 Directors, management, employees and their immediate families of The Herald and Weekly
Times Pty Ltd, and their associated agencies and companies are not eligible to enter.
Immediate family means any of the following: spouse, ex-spouse, child or step-child
(whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent,
uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
2.3 Entrants must be aged over 18 years.
3. HOW TO ENTER
3.1 The competition commences on Friday March 1, 2013 at 00:01 (AEST) and concludes on
Thursday March 7, 2013 at 23:59 (AEDT) (‘the Competition Period’).
3.2 To enter the competition, readers need to find the competition page on
heraldsun.com.au/competitions and answer the question “What is your favourite part of the
Grand Prix?” in 25 words or less, supply their full name, address, state, email address and
daytime telephone number.
3.3 Entrants (including the winners) may only enter the competition once per person.
3.4 The time of entry will, in each case, be the time that the entry is received by The Herald and
Weekly Times.
3.5 The Promoter, their agents, affiliates or representatives will not be liable for any late, lost or
misdirected entries.
4. HOW TO WIN
4.1 Each entrant who has entered the competition over the Competition Period and registered
all details in accordance with clauses 2 and 3 will be entered into the prize draw. The draw
will take place at The Herald & Weekly Times, 40 City Road, Southbank VIC 3006 on
Wednesday March 9, 2013 at 10.00am (AEDT).
4.2 The major prize winner and minor prize winners will be notified by phone call within 2 days
of the draw.
4.3 The Promoters decision in relation to any aspects of the competition is final and the
Promoters will not enter into any correspondence regarding the result.
4.4 It is a condition of accepting the major prize that the winner and their companion will be
required to sign a legal release in a form determined by the Promoter and Australian Grand
Prix Corporation (APGC) in their absolute discretion.
4.5 Entries not completed in accordance with these terms and conditions will not be considered
valid and will not be included in the draw. Indecipherable or incomplete entries will be
deemed invalid.
4.6 The Promoter reserves the right to request the winner to provide proof of identity, proof of
residency at the nominated prize delivery address and/or proof of entry validity in order to
claim the prize. Proof of identification, residency and entry considered suitable for
verification is at the discretion of the Promoters. In the event that a winner cannot provide
suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
4.7 The Promoter reserves the right to verify the validity of entries and to disqualify any entry
which, in the opinion of the Promoter, includes objectionable content, profanity, potentially
insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with
the entry process, who submits an entry that is not in accordance with these terms and
conditions of entry, or who has, in the opinion of the Promoter, engaged in conduct in
entering the promotion which is fraudulent, misleading, deceptive or generally damaging to
the goodwill or reputation of the promotion and/or Promoters. The Promoters reserve the
right to disqualify a winner if the Promoters become aware that the winner and/or the
winner’s entry is of a type described in this clause.
5. PRIZES
5.1 One (1) major prize winner will receive:
· Winner and friend meet Mark Webber at the 2013 Formula 1® Rolex Australian Grand Prix –
valued at money can’t buy
· 4 day – World Championship Grandstand tickets – valued up to $1,100
· Four nights’ accommodation at Oaks on Market in Melbourne - valued up to $1,000
· Formula 1® Paddock Tour – valued up to $500
· VIP Tickets to watch the Nitro Circus Live closing act from the VIP platform – Valued up to
$500
Forty (40) minor prize winners will receive:
· One (1) Double Sunday General Admission ticket – valued up to $7,920
TOTAL PRIZE VALUE: $11,020
5.2 Prize values are based on the recommended retail prices at the time of printing and may vary
depending on the time of redemption. The Promoter accepts no responsibility for changes in
prize value between now and the ultimate prize redemption date.
5.3 The prize must be redeemed by the date specified by the promoter. Should the winner not
be able to accept the prize on this date, the prize is completely forfeited.
5.4 Prizes are not redeemable for cash or for any other products or services. The Prizes can only
be redeemed for travel products and services as described in term 5.1.
5.5 Additional spending money, meals, insurance, travel to and from event and all other ancillary
costs are the responsibility of the winners and their guest.
5.6 Prizes must be taken as offered and are not transferable, exchangeable or redeemable for
cash. Unless expressly stated in these Terms and Conditions, all other expenses become the
responsibility of the winner. A credit card imprint or cash deposit may be required from the
Winner at check-in to the accommodation, for all incidental charges.
5.7 All components of the major prizes must be taken together.
5.8 All additional costs incurred, whereby the major prize winner wishes to make variations to
the travel are the winner’s responsibility and cost and must be booked separately by the
winner. Travel variations include, but are not limited to, extension of travel duration,
travellers outside the age restrictions and additional travellers.
5.9 The major prize winner and their guest will be subject to, and must abide by the terms and
conditions the airline and hotel. Any breaches of such terms and conditions may affect the
ability to receive benefits of the prize. In that case, such benefits will be forfeited.
5.10 As a condition of accepting the prize, the prize winner and their companions agree to be
bound by the 2013 Formula 1® Rolex Australian Grand Prix Conditions of Entry details of
which are available at entry to the event and www.australia-grandprix.com
5.11 In the event that the winner does not take the prize in the time stipulated, then the prize will
be forfeited by the winner and cash will not be awarded in lieu of the prize. Prizes must be
taken as offered and cannot be varied. Any unused portion of the prize is not-transferable,
non-refundable and non-redeemable for other goods or services and cannot be taken as
cash.
5.12 If for any reason a prize or part of a prize becomes unavailable the Promoter will endeavour
to provide a substitute prize of equal value. The replacement prize is at the discretion of the
promoter and negotiation will not be entered into.
5.13 In participating in the prizes, the winner agrees to participate and co-operate as required in
all editorial activities relating to the promotion, including but not limited to being
interviewed and photographed. The winner grants the Promoter a perpetual and nonexclusive
licence to use such footage and photographs in all media worldwide and the winner
(and their guest) will not be entitled to any fee for such use.
5.14 The winner agrees that they will not sell or otherwise provide their story and/or photographs
to any media or other organisation.
5.15 The winner must, on request by the Promoter, be able to provide evidence which, to the
reasonable satisfaction of the Promoters, demonstrates that the winner is an eligible entrant
(as per clauses 2.1, 2.2 and 2.3) and has complied with these terms and conditions.
6. NO LIABILITY
6.1 The Promoter and AGPC shall not be liable for any loss or damage whatsoever which is
suffered (including but not limited to indirect or consequential loss) or for any personal
injury suffered or sustained in connection with any prize/s except for any liability which
cannot be excluded by law. Neither are the Promoter or AGPC responsible for any incorrect
or inaccurate information, either caused by the entrant or any of the equipment or
programming associated with, or utilised in this competition, or for any technical error, or
combination thereof that may occur in the course of the administration of this competition,
including any omission, interruption, deletion, defect, delay in operation or transmission,
communications line or telephone, mobile or satellite failure, theft or destruction or
unauthorised access to, or alteration of, entries.
6.2 If for any reason, this competition is not capable of running as planned, including due to
infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical
failures or any other causes beyond the reasonable control of the Promoter which corrupt or
affect the administration, security, fairness, integrity or proper conduct of this promotion,
the Promoter reserves the right, in their sole discretion, to disqualify any individual who
tampers with the entry process, take any action that may be available and to cancel,
terminate, modify or suspend the competition subject to any written directions given under
State Legislation.
6.3 Except for any liability that cannot be excluded by law, the Promoter and AGPC (including
their officers, employees and agents) exclude all liability (including negligence) for any
personal injury, loss or damage (including loss or opportunity) whether direct, indirect,
special or consequential, arising in any way out of the promotion, including but not limited
to, where arising out of the following:
a) any technical difficulties or equipment malfunction (whether or not under the
Promoters control);
b) any theft, unauthorised access or third party interference;
c) any entry or prize claim that is late, lost, altered, damaged or misdirected
(whether or not after receipt by the Promoter) due to any reason beyond the
reasonable control of the Promoter;
d) any variation in prize value to that stated in these conditions of entry;
e) any tax liability incurred by a winner or entrant;
f) the broadcast of any program relating to the competition or the publication of any
material, including statements made by any compere, staff member, journalist,
other entrants or any other person; and/or
g) participation in the prize.
6.4 Once prizes have left the Promoter premises, the Promoter, their associated agencies and
AGPC take no responsibility for prizes damaged, delayed or lost in transit.
6.5 The Promoter reserves the right, in their sole discretion, to disqualify any individual who the
Promoter has reason to believe has breached any of these conditions, or engaged in any
unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct
of the promotion. The Promoters legal rights to recover damages or other compensation
from such an offender are reserved.
6.6 The prize winner and their companions acknowledge that he or she participates in the prize
at his or her own risk. If a winning entrant becomes aware of any medical condition or
impairment that will be detrimental to their health if they participate in the prize they must
withdraw from the prize. The Promoter reserves the right to deem that a winning entrant or
their companion is not sufficiently healthy or fit to participate in the prize.
7. PRIVACY CONSENT
7.1 Entry details remain the property of the Promoter, and their related entities and are
collecting the entrant's personal information for the purpose of conducting and promoting
this competition (including but not limited to determining and notifying winners). Entrants
may request access to his or her personal information by writing to The Herald and Weekly
Times Pty Ltd Privacy Officer by email at privacy@hwt.newsltd.com.au (VIC) or by mail: PO
Box 14999 Melbourne City MC 8001.
7.2 If an entrant marks the ‘opt-in’ boxes on the competition entry form, the entrant consents to
the storage of their personal information on the Promoters’ or a prize partner’s database
and (depending which ‘opt-in’ box(es) have been marked) the Promoters and/or the relevant
prize partners may (depending which ‘opt-in’ box(es) have been marked) use this
information at any time in the future for promotional and marketing purposes regarding
their respective products or services including contacting the entrant via electronic
messaging.
7.3 Entrants can seek access to personal information that AGPC hold about them by writing to
the Privacy Officer, Australian Grand Prix Corporation, PO Box 577, South Melbourne VIC
3004 , or by emailing at privacy@grandprix.com.au. AGPC full privacy policy is available at
www.motogp.com.au.
8. PROMOTER’S DETAILS
