Entry to the promotion is free. Residents of Queensland, New South Wales, Victoria, South Australia, Western Australia aged 18 years or older are eligible to enter. A person may enter the promotion once only. Any entrant who enters more than once will have all entries apart from the original, deemed invalid.
Employees (and their immediate families) of the Promoter, Venga Pty. Ltd. trading as Chocolteria San Churro and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

The draw for the prize will be conducted at twelve (12) noon Queensland time, 5 June 2013 at Sports & Events Promotions Pty Ltd of 18/7 Boundary Street, Brisbane Qld 4000. The first valid entry drawn will win the prize.
The winning entrant will be advised in writing by mail or email and phone on the day of the draw.

A redraw for any unclaimed prize may take place on 9 September 2013 at the same time and place as the Prize draw, subject to any directions from a regulatory authority. Winner's name will be published in The Australian on 13 September 2013.
The prize must be taken between 1 September 2013 and 30 November 2013.
If for any reason a winner does not take the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
For the 'Win a trip for you and three amigos to Spain' prize, any additional costs associated, including but not limited to meals, taxes (except for airport and departure taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges, and spending money, are the responsibility of the winner and companions (as incurred). The winner and companions are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and documentation required for travel.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the Promoter's website is the entrant's responsibility and is dependent on the Internet service provider used.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Participating Suppliers (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Participating Suppliers (including their respective officers, employees and agents) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
Total prize pool value is up to $11,500 including GST.
Prize winners are advised that tax implications may arise from their prize winning and may wish to seek independent financial advice prior to the acceptance of the prize.
If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any directions from a regulatory authority.
Prizes are not redeemable for cash, credit or product and no exchanges are offered. The Promoter accepts no responsibility for any variation in the value of the Prize (or part thereof). Prizes, or any unused portion of a prize, are not transferable.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the prize except for any liability which cannot be excluded by law.
As a condition of accepting a Prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
All details of entrants become the property of the Promoter.
Each entrant's personal information ("PI") is collected to enable the Promoter to administer and promote Venga Pty. Ltd. trading as San Churro. The PI of winners may be provided to third parties who are assisting the Promoter, including prize suppliers and deliverers and, as required, to Australian regulatory authorities. Entrants who fail to provide all requested PI, may be determined by the Promoter, at its sole discretion to be ineligible to win a prize. Errors and omissions may be accepted at the Promoter's discretion.
All entrants and prize winners consent to the Promoter using the entrant's name, address suburb, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration or compensation for the purpose of promoting this competition (including any outcome), publicity and promoting any products manufactured, distributed and/or supplied by the Promoter.
The winner and the three chosen friends will actively participate in the promotion by emailing photographs taken while on the Trip to Spain with comments attached to describe their trip experience, to the designated San Churro contact. These photographs and comments, may at the absolute discretion of the Promoter, be posted on the San Churro Facebook page or be used in any other advertising material or medium.
Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the competition. The Promoters legal rights to recover damages or other compensation from such an offender are reserved.
