BUDGET DIRECT HEALTH INSURANCE COMPETITION TERMS AND CONDITIONS
Information on how to enter, mechanics of entry and prizes form part of these Terms and Conditions. Entry into the promotion is deemed acceptance of these Terms and Conditions. Entry is via Internet only.
Entry is only open to residents of Australia aged 18 years and older (Entrants). The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion.
The promotion starts at 10:00am (AEST) on 10/06/2013 and ends at 129:00pm (AEST) on 30/06/2012 (Promotional Period), which will be will be divided into three (3) promotional weeks (each, a Promotional Week) and three (3) corresponding promotional draws (Draws) as set out below in Condition 4 for the purpose of determining winners and awarding prizes in this promotion. Winners will be notified by email and their entries, names and localities will be published on Facebook as the winning entries are announced. All reasonable steps to notify winners of the results of the Draws will be taken by the Promoter.

To enter the promotion, Entrants must, during a Promotional Week: a. visit the Budget Direct page on Facebook (
www.facebook.com/BudgetDirect) ( Budget Direct Page); b. ālikeā the Budget Direct Page. Entrants who have ālikedā the Budget Direct Page prior to the start of the Promotional Week will not be required to complete this step. For the avoidance of doubt, to ālikeā in this context means to click on the ālikeā icon on the Budget Direct Page; c. access the promotional application (Application) made available on the landing page of the Budget Direct Page; and d. follow the prompts of the Application in the manner required to submit the entry form, including providing the Entrantās full name, current and valid email address,Date of Birth and less than 25 word answer to the stated question (Question).
Entrants acknowledge that the Entrantās Facebook profile, wall and news feed may be updated, if the Application is shared or recommended by the Entrant. Facebook membership, the ālikingā of Facebook pages, Facebook pages, Facebook applications and use of Facebook generally are subject to the Facebook prevailing terms and conditions of use available at
www.facebook.com. The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other Internet users. To the extent permitted by law, each Entrant agrees to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Entrant in respect of the Entrantās participation in the promotion. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook.
Entrants may enter multiple times however there is a limit of one (1) on how many times an entrant can win. If an entrant has been selected as a winner by the Promoter, any subsequent entry after will be deemed invalid. Two (2) of the six (6) winners will be notified each week for three (3) weeks and any entries that have not been selected as a winner will roll over into the next round of the competition. The first two (2) prize winners will be selected by the Promoter on the 17/06/2013, the second two (2) prize winners will selected by the Promoter on the 24/06/2013 and the final (2) prize winners will be selected on the 01/07/2013.
In each promotional period, two (2) eligible entries will be chosen by the Promoter based on their answer to the Question. Each will win one (1) yearsā subscription to a magazine publication via iSubscribe valued at a maximum AUD$85.00. A total of two (2) prizes awarded for each Promotional Week and six (6) prizes awarded in this promotion. Total maximum prize pool value is $510.
Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. Contact details entered incorrectly via the Application by an Entrant will deem an entry invalid.
Costs associated with accessing the Budget Direct Page and/or Application remain an Entrantās responsibility and may vary depending on the Internet service provider used.
The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to verify the validity of entries and Entrants (including an Entrantās identity, age and email address) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to tampering by way of use of automatic entry software or submitting multiple entries by using different email addresses or alternate names). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Prizes are not transferable or exchangeable. A prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value.
The Promoter may select a runner up prize winner for all unclaimed prizes at the same time at 10;00 am on 15/07/2013 in order to distribute any prizes (if any) unclaimed by that date.
It is a condition of accepting a prize that the winner also agrees to iSubscribeās terms and conditions located on the landing page where all winners go to redeem their prize.
Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Budget Direct Page and/or Application or the information on the Budget Direct Page and/or Application, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
If a prize or element of a prize becomes unavailable, for any reason beyond the Promoterās reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to the Promoterās choice.
The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing the Application or any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; and/or (iv) acceptance and/or use of any prize.
If this promotion is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion.
An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information about an Entrant to include the Entrant in the promotion and, where appropriate, award prizes. If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible.
If an Entrant participates in the promotion and also chooses to āopt-inā via the Application, the Entrant acknowledges that a further primary purpose for collection of the Entrantās personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Entrant in the future with information on special offers or provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact the Entrant with special offers in this way. By entering the promotion and opting-in, an Entrant acknowledges and agrees that the Promoter may use the Entrantās personal information in the manner set out in this condition.
