By entering The News Limited 'Super Escapes' competition, you are agreeing to the following Terms and Conditions:
STANDARD TERMS
Information on how to enter forms part of the Terms and Conditions. Entry into the competition is deemed acceptance of these Terms and Conditions.
WHO CAN ENTER
Subject to clause 2.2, entry is only open to Australian residents.
Directors, management, employees and their immediate families of the Promoter and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this competition.
HOW TO ENTER
The competition will be conducted from 9am AEST to 7pm AEST each Sunday between 21 July 2013 and 11 August 2013, inclusive (“the Competition Period”).
To enter the competition, eligible entrants must during the Competition Period, purchase The Sunday Telegraph, Sunday Mail, The Sunday Times, Sunday Herald Sun or The Sunday Mail, find the code word weekly, and enter by either:
Online: heading to the website as directed, and enter all details requested within the competition page including the weekly code word and submit; OR
SMS: sending an SMS to 19700498 with the weekly code word, first name, last name and postcode, in that order with a space between each item (text message cost is 55c - maximum of 160 characters). Entrants must have premium service access. Entrants under 18 years old must obtain account holder’s consent. Salmat Interactive. SMS Helpdesk 1300 131 276. SMS winners will be contacted by SMS and/or phone and, if necessary, the Promoter will record their address details so that the prize may be awarded. SMS entries via the Internet are ineligible.
Limit one (1) entry permitted per person and mobile number for each Sunday across the Competition Period. Only one (1) prize permitted per person (excluding South Australian residents).
Entrants must retain proof of their original newspaper purchase showing the weekly code used to enter. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.
The time of entry will, in each case, be the time that the entry is received by the servers of the Promoter or its appointed agent or contractors for the receipt of entries and not the time of transmission by the entrant.
The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.
Incomprehensible, indecipherable or incomplete entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

The Promoter’s decision in relation to any aspects of the competition is final and the Promoter will not enter into any correspondence regarding the result.
It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
Entries not completed in accordance with these Terms and Conditions will not be considered valid.
The Promoter reserves the right to request that the winners provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bills) in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs, who submits an entry that is not in accordance with these Terms and Conditions, or who has, in the opinion of the Promoter, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
A draw for any unclaimed prizes may take place on 18 November 2013 at the same time and place as the original minor draws, subject to any directions from a regulatory authority. Spending money will be awarded in the form of a cheque made payable to the winner. Prizes are not exchangeable and cannot be taken as cash. Any additional charges such as spending money and travel are the responsibility of the winner. The Promoter accepts no responsibility for any variation in the prize value.
If a winner, for whatever reason, is unable to participate in a prize which is restricted to a specific date, or does not take an element of the prize within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof
If the prize or any part of the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transfers, transport to and from Australian departure point, items of a personal nature, in-room charges and all other ancillary costs are not included unless specified in the major prize details.
Prize awarded in Major Prize Draw 4 must be taken to coincide with the 2014 Super Bowl which is taking place on 2 February 2014 and is subject to booking and flight availability.
All other Major Prizes are subject to booking and flight availability and cannot be taken during Australian or New Zealand school holidays, public holidays or other peak periods. Holidays must be booked and taken prior to 30 June 2014.
During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.
Winners and their travel companion/s are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.
Winners and their travel companion/s must depart from and return to the same departure point and travel together.
Frequent flyer points will not form part of the prizes.
Itinerary and service providers (including airline and hotel) to be determined by the Promoter in its absolute discretion.
Prizes are subject to the standard terms and conditions of individual prize and service providers.
Winners may be required to present their credit card at time of accommodation check in.
Subject to the terms and conditions of the participating prize provider(s), if for any reason a Major Prize winner does not, once the prize has been booked, take a prize (or an element of a prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If a winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
Any ancillary costs associated with redeeming a voucher prize are not included. Any unused balance of a voucher prize will not be awarded as cash. Redemption of a voucher prize is subject to any terms and conditions of the issuer including those specified on the voucher.
NO LIABILITY
If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the competition or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize / participation in a prize.
Once prizes have left the Promoter’s possession or control, the Promoter and their associated agencies take no responsibility for prizes damaged, delayed or lost in transit.
The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition.
