Terms and Conditions, Home Ice Cream, Golden Ticket Chocolate Box Instant Win Competition (the “Promotion”)
1. Information on how to enter and Prize details form part of these conditions. Entry into this Promotion is deemed acceptance of these terms and conditions of entry.
2. The “Promoters” Home Ice Cream Pty Ltd, 173-181 McDougall Street, Toowoomba Qld Australia 4350. ABN 83 009 843 690.
3. The Promotion will be open from midnight Australian Eastern Daylight Time ("AEDT") on 8 July 2013 and will continue until 11.59pm on 30 September 2013 ("Promotion Period").
4. The Instant Win Promotion is open to all Australian residents, other than management, employees or contractors of the Promoter and other agencies, firms or companies associated with the Promotion and their immediate families ("Eligible Entrants").
5. The Instant Win Promotion is only associated with the Home Ice Cream ‘Chocolate Box’ during the Promotional Period and no other Home Ice Cream products.
6. To enter and be eligible to instantly win, entrants must, during the Promotion Period, complete the steps listed below:
a Purchase a specially marked Home Ice Cream ‘Chocolate Box’.
b If the Home Ice Cream Chocolate box randomly contains one of the five official Golden Tickets, the entrant is an instant winner and is required to contact Home Ice Cream on 07 4699-9988 to claim their winning prize. Winner names will be published on the Home Ice Cream website on 1st November, 2013.
c Entrants who are not instant winners are eligible to enter the second chance draw via the Home Ice Cream Website, www.homeicecream.com. The second chance draw is open to all Australian residents other than management, employees or contractors of the Promoter and other agencies, firms or companies associated with the Promotion and their immediate families ("Eligible Entrants"). Entrants do not need to purchase a Home Ice Cream Chocolate Box to enter the second chance draw.
d If any of the five instant win prizes have not been claimed by 29th October 2013 (one month after the close of the competition), a random Second Chance Draw will take place at 12:00 pm on 30 October 2013 at 173-181 McDougall Street, Toowoomba Q 4350 Australia. In the event the five instant win prizes have been claimed, the 2nd chance draw will not proceed. The draw will be conducted by a representative of the Promoter. Second Chance Winners will by notified by phone by 5pm, 31 October 2013. 7. Standard browsing charges apply, where applicable, in accessing the internet to enter the second chance draw.
8. Prizes
9. The Eligible Entrant will instantly win a Golden Ticket, which needs to be claimed by contacting Home Ice Cream on 07 4699-9988. The major prize consists of:
a Samsung Galaxy Note 8" 16GB WiFi - White
10. The total value of the Major Prize is $468x 5 = $2,340.
11. General
12. Prizes are not exchangeable and are not redeemable for cash.
13. The Promoters excludes all warranties in relation to supply of the Prize, except those that cannot be excluded by law.
14. The Promoter shall not be liable for any Prize that may be lost, stolen, forged, damaged or tampered with in any way before it reaches the winner.
15. The Promoter accepts no responsibility for any variation in the value of a Prize.
16. If the Promoter is unable to provide a winner with the nominated Prize, the Promoter reserves the right to supply an alternative Prize of equal or greater monetary value to the nominated Prize.
17. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt by the Promoter. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
18. If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to State and Territory regulations.
19. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.
20. Incomplete, illegible or incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
21. The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
22. To the extent that these terms are unenforceable or do not comply with the law, that term is to be read down, or excluded to the extent required to comply with the law.
23. To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or indirect loss) or personal injury suffered or sustained in connection with this Promotion.
24. Unless entrant specifies to receive further communication for Home Ice Cream Pty Ltd – all entries will be destroyed and not used for any other purpose or passed onto any third party suppliers. Any personally identifiable information you provide in connection with the Promotion will be collected, stored and used in accordance with the Promoter’s Privacy Policy, located at
