*1. 1. Participation in the Promotion constitutes acceptance of these Terms. 2.2. The Promotion commences on Monday, 22nd July 2013 at 9am AEST and closes on Saturday, 31st August 2013 at 6pm AEST (“Promotional Period”). 3.3. This is a game of skill and chance plays no part in determining the winner. 4.4. No purchase is required to enter. One entry per person. 5.5. The Promotion is open to Australian Residents only 6.6. To enter the Promotion, entrants must submit their original recipe along with their full name, address and daytime telephone number to
jmcookingcompetition@joycemayne.com.au. 7.7. The winners will be determined by the Promoter’s judging panel at their sole discretion. 8.8. The Thirty (30) most original recipes judged to the judging panel will be published in a cook book for Joyce Mayne. 9.9. There is one (1) Major Prize. The Major Prize is the winner’s choice of Westinghouse cooking appliances from a Joyce Mayne Franchise valued at $2,500. (“the Major Prize”). 10.10. There are three (3) Minor Prizes. Each Minor Prize is One (1) Joyce Mayne Gift Card valued at $200. (“the Minor Prize”) 11.11. The total value of the Major and Minor Prizes is $3,100. 12.12. The Prize cannot be redeemed for cash. 13.13. If the Winner of the Prize is under the age of 18 years, a parent or guardian must accompany the Winner when the Prize is taken. 14. 14. Judging for the Prize will take place at B1 Richmond Road, Homebush West NSW 2140 on Friday, 6th September 2013 at midday. 15.15. The winners will be contacted by phone on Wednesday, 11th September 2013 and their details published in the Australian on Wednesday, 18th September 2013. (“Winner”). 16.16. Entries that are illegible, incomplete or do not comply with these Terms are invalid. The Promoter reserves the right, at any time, to verify the validity of entries and entrants as required (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. 17.17. An entrant must warrant that the recipe is not the copyright material of another person or source, or they otherwise have permission to submit the recipe (ie, the recipe may be a family members). 18.18. If the recipe is the copyright material of another person or source, the entrant should give full credit to the person or source. 19.19. If the recipe is adapted from a recipe of another person or source, words to the following effect should be included “inspired by a recipe of ...”. 20.20. An indemnity by the customer in favour of the relevant JM parties/franchisees/printers for breach by the customer of the relevant warranties. 21.21. The Promoter reserves the right to request the Winner provide suitable identification of proof of age and identity prior to awarding the Prize. 22.22. The Promoter reserves the right to announce and/or publish the Winners’ name and/or photograph for publicity purposes. 23.23. The Promoter may at its absolute discretion, suspend, cancel or recommence the Promotion if (a) for any reason the Promotion is not capable of proceeding as planned; (b) if the Promotion is corrupted or the administration, security, fairness, integrity or proper conduct of the Promotion is affected; or (c) if the determination of the winners or delivery of prizes is prevented or hindered by any event outside the Promoter’s control subject to approval by relevant state regulatory authorities. 24.24. Except for any liability not excluded by law, entrants release and indemnify the Promoter from and against all actions, claims and liabilities, that the entrant now has or in the future may have against the Promoter for any loss, damage or injury (including any special or consequential loss) suffered as a direct or indirect result of the Entrant’s participation in the Promotion. 25.25. The Promoter’s decision in relation to this Promotion is final and binding on entrants and the Promoter will not enter into any correspondence. 26.26. By entering the Promotion, entrants consent to their personal information being used by the Promoter, the Franchise and/or its related entities for the purpose of conducting this Promotion and notifying the Winners. All personal details of the entrant will be stored at the offices of the Promoter. A request to access, update or correct any information should be directed to that office. The Privacy Policy may be obtained at any Franchise. 27.27. The use of any automated entry software or any other mechanism or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition. 28.28.
