Telfast Hanky Promotion Terms & Conditions
1.Information on how to enter and Prizes forms part of these conditions of entry. Submission of an entry is deemed acceptance of these conditions of entry.
2.Entry is only open to Australian residents aged 18 years or over (“Eligible Entrants”).
3.Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister orfirst cousin.
4.The promotion is in no way sponsored, endorsed or administered, or associated with Facebook.
5.The Eligible Entrant is providing information to the Promoter and not to Facebook.
6.Participating and entering in this promotion is considered a complete release of Facebook by each entrant or participant.
7.Telfast Hanky Giveaway commences at 9.00am AEST on 14/10/2013 and ends at 11.59pm AEST on 28/02/2014. The Take a Photo Game of Skill Promotion commences at 9.00am AEST on 21/10/2013 and ends at 11.59pm AEST on 24/01/2014 (“Promotional Period”). Specific Monthly draw information relating to the Take a Photo Game of Skill promotional period open and close dates and times are noted below.
8.Winners will be drawn at 87 Yarraman Place, Virginia, QLD 4011 in accordance with the following schedule:
9.This is a game of skill and winners will be judged on creative merit. To enter, Eligible Entrants must complete the following steps during the Promotional Period:
1.“Like” the Telfast Facebook page, and provide their name and address in order to receive one of the 4,000 Telfast Hankies, valued at $9.95 each.
2.Complete the entry form on the Telfast Facebook page and upload a photo of themselves with the hanky.
10.No cash alternative to the Prizes will be offered. Unless otherwise stipulated, Prizes are not transferable or exchangeable. The Promoter reserves the right to substitute any Prize with another of equivalent value without giving notice.
11.There is no entry fee and no purchase necessary to enter this Promotion. Any cost associated with entering the competition is the Eligible Entrant’s responsibility.
12.There is a limit of one (1) entry (“Eligible Entry”) per Eligible Entrant during the Promotional Period.
13.The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process (including but not limited to tampering by way of use of automatic entry software). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
14.Incomplete, indecipherable or illegible entries will be deemed invalid. Any incorrect details submitted may render the corresponding entry invalid.
15.An entry is deemed to be received at the time of its receipt by the Promoter and not at the time of transmission by the entrant.
16.The Promoter’s decision is final and no correspondence will be entered into.
17.If for any reason whatsoever, the Prize winner does not take their Prize or an element of their Prize by the time stipulated by the Promoter, then the Prize or that element of the Prize will be forfeited by the Prize winner and neither cash nor any other Prize will be awarded in lieu.
18.All Prizes will be posted to the winners. Winners will be notified and postal address must be provided.
19.If a Prize (or part of any Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with an alternative Prize to the equal value and/or specification, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.
20.If for any reason whatsoever beyond the reasonable control of the Promoter, the promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to cancel, suspend, modify, terminate or cancel the promotion.
21.Total Prize pool is valued at $41,300 and is correct at the time of print and comprised of the following Prizes (the “Prizes”):

22.The Promoter accepts no responsibility for any variation in the value of the Prizes (or any part of them).
23.If required, an unclaimed Prize selection may take place on 01/02/2014 at the same time and place as the original selection, subject to any directions from a regulatory authority.
24.Except for any implied condition or warranty the exclusion of which from these conditions of entry would contravene any statute or cause any part of these conditions of entry to be void (“Non Excludable Condition”), the Promoter excludes from these conditions of entry all conditions, warranties and terms, implied by statute, general law or custom. Except for any liability in relation to a Non Excludable Condition, the Promoter (including its officer, employees and agents) excludes all liability whether arising in tort (including, without limitation, negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss or profits) whether direct, indirect, special or consequential, arising in any way out of the promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control): (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that sated in these conditions of entry ; (e) any tax implications; (f) the cancellation or postponement of the Promotion; and/or (g) a Prize or use of a Prize.
25.Each entrant consents, if the entrant becomes a winner, to the Promoter using the entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in an media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome), the Promoter and or products/services supplied by the Promoter.
26.The Promoter collects personal information (“Personal Information”) in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Personal Information won’t be disclosed to any overseas recipients. Eligible Entry is conditional on providing this information. The Promoter may, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. Eligible Entrants should direct any request to opt out, request access, update or correct information of their Personal Information to the Promoter by writing to the Privacy Officer at
PrivacyOfficer.Australia@sanofi.com. All Eligible Entries become the property of the Promoter. Collected Personal Information will be dealt with in accordance with the principles set out in the Privacy Act 1988 (Cth). The Promoter’s privacy policy (available on
www.sanofi.com.au) provides details on how to complain about a privacy breach and how such a complaint will be dealt with.
27.The Promoter will retain all Eligible Entries and other records relating to this Promotion for the period required in accordance with the relevant state legislative requirements after the date on which the winners are drawn, after which all Eligible Entries will be destroyed if the Eligible Entrant has indicated on the Eligible Entry that he or she does not wish to receive any further information from the Promoter.
