“APEROL – WIN A TRIP TO ITALY” PROMOTION

TERMS AND CONDITIONS


1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.


2. Entry is only open to New South Wales, Victorian, Queensland, South Australian and Western Australian residents aged 18 years or over.


3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.


4. Promotion commences at 9.00am AEDST on Sunday 10 November 2013 and ends at 11.59pm AEDST on Sunday 30 March 2014 (“Promotional Period”).


5. To enter, individuals must complete the following steps during the Promotional Period:


(a) Take an original photo of a sunset (the photo must not contain images of persons under the age of 25 years old);

(b) Go to the Aperol Facebook Page at www.facebook.com/AperitivoHourAustralia ;

(c) ‘like’ the Aperol Facebook Page (if not done so already);

(d) follow the prompts to the promotion application, input the requested details including their full name, date of birth and address;

(e) Upload the sunset photo taken in accordance with clause 5(a);

(f) Answer the question “Tell us about your perfect summer sunset?” in 25 words or less;

(g) Agree to the Terms and Conditions by selecting the relevant tick box; and

(h) Submit the fully completed entry form.


Uploaded photo files must be submitted in JPEG or PNG format and must not exceed 3MB file size. Images larger than 1000 pixels wide or tall will be resized to fit inside that box, while still keeping the original aspect ratio.



6. The Promoter, at its discretion, may upload one (1) or more of photo entries to the Aperol Facebook Page. All such entries will be vetted by the Promoter prior to upload.


7. A maximum of 3 entries permitted per person. Each entry must be substantially unique and each entry must be submitted separately and in accordance with the entry requirements.


8. Incomplete or indecipherable entries will be deemed invalid.


9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.


10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.


11. The judging will take place at Campari Australia Pty Ltd, Level 10, Tower B, 207 Pacific Highway, St Leonards NSW 2065 commencing Monday 1 April 2014 at 9.00am AEDST and concluding 5.00pm AEDST on Sunday 6 April 2013.


12. A winning entry will be selected for the Major Prize, along with 10 winners of the Minor Prizes. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.


13. The winners will be notified on Monday 7 April 2014 by email via their Facebook account and by telephone.


14. This is a game of skill and chance plays no part in determining the winners.  Each entry will be individually judged based on the originality and creative merit of the sunset photograph together with the originality, literary merit and creative merit of the answer provided to the promotional question.


15. The Promoter’s decision is final and no correspondence will be entered into.


16. Major Prize: The best valid entry, as determined by the judges, will win the Major Prize. The Major Prize is a trip for two (2) people to Italy and consists of the following:


* Return economy class airfares for two (2) people from the winner’s nearest capital city to Milan, Italy;

* Accommodation in a twin or double room (as determined by the Promoter) at four star hotels in Milan (2 nights) and Padua (3 nights) (exact accommodation venues determined by the Promoter in its absolute discretion);

* The following internal train and airport transfers within Italy for two (2) people:  Milan airport to Milan hotel; Milan hotel to train station in Milan; train station in Milan to Padua train station; transfer from Padua train station to Padua hotel; return train from Padua train station to Venice (for daytrip); train from Padua train station back to Milan train station; airport transfer from Milan train station to Milan International airport;

* Venice day trip for two (2) people from Padua.

* Travel insurance for two (2) people covering loss/damage to luggage, flight changes or cancellations to the value of AU$147;

* AU$2,000 spending money (awarded in the form of a cheque in the winner’s name);

* A guide to accompany the winner to Aperol bars in each city (2 hour guide per city), with a complementary Aperol Spritz and antipasti in the 3 bars; and

* Access to a 24 hour local helpline / guide for any advice.


The Major Prize is valued at up to AU$11,327.32, depending on date and point of departure.



17. Additional spending money, meals, taxes (excluding airline and airport taxes), additional insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken between 15 April 2014 and 15 April 2015 and is subject to booking and flight availability. Prize cannot be taken during the following blackout periods: 8 April 2014 – 24 April 2014 and 10 September 2014 – 25 September 2014. Prize may also not be taken during Australian school holidays, public holidays or other peak periods, unless otherwise permitted by the Promoter.


18. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The Major Prize winner and his/her companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The Major Prize winner (and his/her companion) must depart from and return to the same departure point and travel together (unless otherwise specified). Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The Major Prize winner may be required to present their credit card at time of accommodation check in.


19. The Major Prize winner and his/her travel companion will each be required to fully complete a travel insurance application form provided by the Promoter, and may also be required to undergo medical tests as required by the Promoter’s nominated travel insurer, in order to redeem the travel insurance element of the prize. Any person found guilty of insurance fraud or failure to honestly and accurately disclose all relevant insurance information at the time of applying for a travel insurance policy or when making a claim forfeits any rights or entitlements to the travel insurance element of the prize. Travel insurance will be provided by the Promoter’s nominated travel insurer, and subject to approval by the travel insurer. In the event that the Promoter’s nominated travel insurer refuses to issue insurance to the Major Prize winner and/or companion, the winner forfeits that travel insurance element of the prize. Travel insurance is subject to the terms and conditions issued by the Promoter’s nominated travel insurer, including but not limited to any limitations on the covered amount.


20. Minor Prizes: The next ten (10) best valid entries, as determined by the judges, will each win a Minor Prize. The Minor Prize is an Aperol Spritz pack, which consists of 1 x 700ml bottle of Aperol, 1 x 750ml bottle of Prosecco, 1 x Aperol sold syphon and 50 Aperol swizzle sticks. The Minor Prize is valued at AU$80.


21. In the event that a Minor Prize winner resides in a ‘dry’ area of Australia, where consumption and/or possession of liquor is not permitted, he/she will be awarded another prize of equal or greater value in lieu of the alcohol element of the Minor Prize.


22. If for any reason a winner does not take a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.


23. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.


24. Total prize pool value is up to AU$12,127.32. 


25. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.


26. When an entrant submits any materials via the promotion including answers to promotional question, photographs, comments, recordings and images (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.


Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.


Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.


27. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.


28. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.


29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.


30. Any cost associated with accessing the Aperol Facebook Page is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.


31. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.


32. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking and/or use of a prize.


33. As a condition of accepting a prize, each winner (and the Major Prize winner’s travel companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.  In the event that the Major Prize winner’s travel companion is under the age of 18, his/her parent or legal guardian must sign the legal documentation required under this clause on their behalf.


34. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, if selected by an entrant at the time of entry, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.


35. The Promoter encourages consumers to enjoy alcohol in moderation. Legal aged consumers are advised to consider the 'low risk drinking' guidelines recommended in the National Health & Medical Research Council Australian Alcohol Guidelines.  A full version of the guidelines is available at http://www.alcohol.gov.au/internet/alcohol/publishing.nsf/Content/guidelines. Participation in the promotion is subject to relevant liquor legislation in each applicable State or Territory, including responsible service of alcohol. Consumers are also encouraged to visit the Australian Government’s information site for alcohol at www.alcohol.gov.au.


36. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.


37. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained  by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
