Instructions on how to claim and the Rewards form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. Claims are only open to Australian residents. Claimants under 18 years old must have parental/guardian approval to claim and further, the parent/guardian of the claimant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor submitting a claim in this promotion.
3. Employees (and their immediate families) of the Promoter, participating Coles supermarkets and agencies associated with this promotion are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Promotion commences on 01/01/2014 and ends in each participating Coles supermarket at close of business on 31/01/2014, or when one hundred and seventy six(176) valid claims have been received in that supermarket, whichever is first to occur (“Promotional Period”). Participating Coles supermarkets will be any Coles supermarket in Australia that is displaying material advertising this promotion.
5. To be eligible to claim, individuals must purchase two (2) or more Birds Eye products in a single transaction from any participating Coles supermarket in Australia during the Promotional Period (“Qualifying Transaction”). Offer is strictly limited to the first (176) valid claims have been received in each participating Coles supermarket.
6. Incomplete claims will be deemed invalid.
7. Multiple claims permitted, subject to the following: (a) only one (1) claim permitted per Qualifying Transaction (regardless of the number of Birds Eye products purchased in excess of two (2) in that transaction); (b) each claim must be submitted separately and in accordance with claim requirements; and (c) a maximum of one (1) claim per person per day is permitted. Offer is strictly limited to the first one hundred and seventy six (176) valid claims received in each participating Coles supermarket during the Promotional Period.
8. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
10. The Promoter’s decision is final and no correspondence will be entered into.
11. The first one hundred and seventy six (176) valid claims received in each participating Coles supermarket will each be awarded a Disney ‘Frozen’ Stationery Kit, valued at $9.99. The Kit includes one (1) ‘Frozen’ notebook, one (1) ‘Frozen’ pen, one (1) ‘Frozen’ key ring and one (1) ‘Frozen’ note pad (“Reward”)
12. All Disney ‘Frozen’ Stationery Kits will be displayed next to the Birds Eye products in the frozen foods isle of participating Coles supermarkets. In order to claim, the Disney ‘Frozen’ Stationery Kit must be collected from the frozen foods isle of the participating Coles supermarket and provided to the cashier at the time of the Qualifying Transaction. If a claimant chooses not collect a Disney ‘Frozen’ Stationery Kit and provide this Disney ‘Frozen’ Stationery Kit at the cash register at the time of the Qualifying Transaction, he/she will forfeit their right to a Reward.
13. Total Reward pool value in each participating Coles supermarket is $1758.24.
14. The stated value of the Reward is the recommended retail value (including GST) in Australia as provided by the supplier and is correct at the time of printing.
15. If for any reason a claimant does not take a Reward at the time stipulated by the Promoter, then the Reward will be forfeited.
16. Rewards are not transferable or exchangeable and cannot be taken as cash.
17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
18. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) taking and/or use of a Reward.
