Entrants understand and acknowledge that participating in the Miss Muddy event organized and conducted by Entertainus Pty Ltd is a dangerous activity and is in the nature of an “extreme sport”. As such it has inherent dangers and risks. The event may involve climbing over rocks, water activities, running, wading and crawling through jelly, mud and/or ice, running/walking on the beach, following directional signage, independent decision making and other unspecified surprise or mystery activities.

TERMS & CONDITIONS


WIN a chance to participate in the Miss Muddy obstacle course with the Woman’s Day team!

1.Instructions on 'how to enter' and prizes form part of conditions of entry. Participation in this promotion is deemed acceptance of these conditions of entry.

2.Entry is open to Female Australian residents aged 18 years and over and those who can attend the Miss Muddy Challenge on the dates stipulated in clause 15. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

3.Entrants certify that they are physically fit and have sufficiently trained for participation in the event - Miss Muddy. Entrants certify that they have not been advised by a qualified medical person that they should not participate in the event - Miss Muddy and that they have been given the opportunity by the organiser and Promoter to review the event as thoroughly as possible and ask questions regarding the event prior to their participation.

4.Entrants understand and acknowledge that participating in the Miss Muddy event organized and conducted by Entertainus Pty Ltd is a dangerous activity and is in the nature of an “extreme sport”. As such it has inherent dangers and risks. The event may involve climbing over rocks, water activities, running, wading and crawling through jelly, mud and/or ice, running/walking on the beach, following directional signage, independent decision making and other unspecified surprise or mystery activities. Entrants are aware of the hazards involved and acknowledge that there is always risk of injury (including permanent injury, mental injury, paralysis and death) and damage to their property and accordingly agree to participate at their own risk. Entrants agree to attend all briefings as required by the Promoter and event organisers in their absolute discretion.

5.Only one (1) entry per person permitted.

6.The promotion commences on February 18, 2014 and closes at 11:59pm (AEDST) on February 23, 2014. The judging will be done by a panel of judges appointed by the Promoter. The judging will take place at the Promoter’s premises, 54 Park Street, Sydney NSW 2000 and will begin on February 24, 2014. The prize winner will be notified in writing and by telephone within two (2) days after the competition judging date using contact details provided in their entry.

7.To be eligible to enter, entrants must during the promotional period, purchase issue 8 (cover date February 24, 2014) of Woman’s Day magazine and then the individual must log on to www.womansday.ninemsn.com.au/win/, follow the prompts on the promotion entry page and input the requested details including their full name, address, telephone number, current email address, age and answer to the competition question in 25 words or less “Why do you want to be part of the Woman’s Day Miss Muddy team?” and submit the entry as instructed.

8.Entrants must retain the original copy of all purchase receipts for all entries as proof of purchase. If a receipt is not available from the participating store where the participating title(s) were purchased, entrants must provide an original copy of the title magazine cover as proof of purchase.  Promoter reserves the right to request proof of purchase for each entry made to verify all entries before awarding the prize. Failure to produce the required valid purchase receipt or original copy of the title cover for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Each entry must relate to a separate qualifying purchase.

9.This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

10.The entrant warrants to the Promoter that the entry submitted is an original artistic work of the entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided by the entrant in relation to the entry was provided by a third party, the entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoter is entitled to amend, edit, select, add to or delete from any part of the submitted entry.

11.Entries must not be offensive, defamatory or racist.  Any entry which the judges deem inappropriate will be invalid.  The entrant agrees to indemnify the Promoter.

12.The Promoter reserves the right to verify the validity of entries and entrants (including but not limited to an entrants identity, age, place of residence and proof of purchase) and to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these conditions of entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 

13.The judges' decision in relation to any aspect of the competition is final and binding on every person who enters. By entering the promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit with their entry being entered into a database and the Promoter may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant. A request to access, update or correct any information should be directed to the Promoter.

14.The best two-hundred and fifty (250) entries, as determined by the judges, will be deemed the winner’s and will each win:

•One (1) x double-pass to the Miss Muddy event valued at AU$120.00.

Total prize pool is valued at up to AU$30,000.00 (including GST). Any ancillary costs associated with redeeming the prize are not included. All costs associated with redeeming and participating in the prize are the responsibility of the winner.

The events will take place at the following states and dates:

Canterbury, NSW - Sunday 2nd March 2014
Brisbane, QLD - Sunday 29th June 2014
Ballarat, VIC - Sunday 30th November 2014

The prizes will be awarded in the following:

NSW/ACT residents will be awarded the Canterbury NSW event tickets.
QLD/NT residents will be awarded the Brisbane QLD event tickets
VIC/SA/TAS/WA residents will be awarded Ballarat event tickets

PRIZE:


15.As a condition of accepting the prize, the winner (and his/her companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 

16.In the event that for any reason whatsoever the prize is not redeemed on the dates stipulated in clause 15, the prize will be forfeited by the winner and cash, nor any other prize will not be awarded in lieu of the prize being forfeited.

17.Prizes will be awarded to the winners in the form of an electronic ticket/voucher entitling the winner to two (2) entries specified as a ‘double-pass’. The electronic ticket will be delivered to winners via the email address provided on their entry form. Failure to provide an email address on the entry form will result in a void entry.

18.The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the Miss Muddy events are postponed, cancelled, rescheduled or relocated for any reason whatsoever.

19.The winner and their companions must be 18 years and over to redeem the prize.

20.The winner (and their companion) are responsible for all other expenses including but not limited to  travel to and from the event, additional domestic flights, accommodation, spending money, meals (unless specified), drinks, transfers (unless specified), activities (unless specified), incidentals, services charges, insurance and all other ancillary costs. 

21.Medical and Fitness restrictions apply.  Prize does not include personal injury insurance. Personal Injury insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

22.In the event the winner does not make use of their one or both tickets at the event at the point of redemption of the prize, the difference will be forfeited by the winner and cash, nor will any other prize be awarded in lieu of the prize difference being forfeited.

23.Prize is subject to the standard terms and conditions of individual prize and service providers.

24.The Miss Muddy tickets are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

25.The winner and their guest must not engage in any illegal or unsafe behaviour whilst participating in the prize. To the extent allowable by law, the Promoter and its partners exclude any legal liability or responsibility for legal or otherwise incidents or activities engaged in by the winner or their guest during participation in the prize.
GENERAL:

26.All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize is not valid in conjunction with any other offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.  In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ online, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ online. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.

27.Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

28.In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including  but not limited to natural disaster)the  Promoter reserves the right to subject to reference to all relevant  state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

29.If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.

30.If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.

31.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

32.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

33.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Privacy:
34.The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter. Entrants’ PI will not be disclosed to any entity outside of Australia.
