1                         Information regarding prizes and how to enter forms part of these conditions.  By entering, entrants accept these conditions.

2                         Entry is open only to Australian residents aged 18 or over except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies associated with this competition.

3                         The competition begins at 12pm (AEDT) on 25/03/2014 and closes at 12pm (AEDT) on 14/04/2014 (Competition Period).

4                         A competition question will be posted on the McCormick Foods Australia Facebook page https://www.facebook.com/McCormickAustraliaat 11.59AM AEDT on the specific days nominated in the summary table which is forms part of these terms and conditions.

5                         To enter via Facebook entrants must, during the Competition Period:

                                 i.            visit the McCormick Facebook page;

                                ii.            If they have not already done so, click the “like” button on the Facebook page; and

                              iii.            Provide an original, creative response to the competition question in the comments section of the wall post within 48 hours of the wall post being posted on the Facebook page.

 

6.                        On Facebook, only 1 entry per person per competition question will be accepted. Any subsequent entry after the first valid entry is received for a calendar day will be deemed invalid.

 

7.                        Facebook entries not submitted in the comments section will be deemed invalid.  This includes entries posted as separate wall post, separate wall comments, wall comments other that the weekly competition wall post or private messages.

8.                        All valid entries will be judged by a panel of appropriately qualified judges within 48 hours of the close of each draw, at Communicado Marketing Communications, Level 1, 544 High Street, Prahran VIC 3181.

 

9.                        Winners will be judged to be the best from all eligible entries received.

 

10.                    The entry deemed “best” from all valid entries received for each competition post will be awarded the prize for that particular posts (as outlined in the summary table).   The judges will continue to choose the entry deemed “best” from all valid entries received until all winners have been chosen.

 

11.                    If no entries, or a smaller number of entries than prizes available are received for any competition question the prize will be forfeited. 

 

12.                    All eligible entries will be judged on a basis of originality and creative merit of their answer to the competition question.

 

13.                    This is a game of skill and chance plays no part in determining the winner.

 

14.                    Winners will be notified in writing and will have their names published on https://www.facebook.com/McCormickAustraliawithin 48 hours of the judging.

 

15.                    Entries must be received by the Promoter via the relevant channel, during the timeframes and in the manner outlined in clause 5 and clause 7 of these terms and conditions.  Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant.

 

16.                    For the avoidance of doubt, entrants must remain a fan (“like” the page) of the McCormick Foods Australia Facebook competition for the entire Promotion Period and at the time of judging.  Entrants who “unlike” the Facebook Page at the time of determination of winners, will be deemed invalid.

 

17.                    The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, and communications failure or otherwise.  The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise.  The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.  Entrants who enter using multiple email addresses or aliases may be disqualified.  Computer generated entries will not be accepted.

18.                    The total prize pool is valued at up to $3,840 inc. GST.

 

19.                    The prize may not be transferred or substituted, except at the Promoter’s discretion. The Promoter reserves the right to substitute a prize of equal or greater value due to prize unavailability.

 

20.                    The promoter will attempt to contact each winner at least 3 times after the competition period closes yet, if a prize is not accepted or claimed within 14 days of the relevant competition question draw the entry will be deemed invalid and the prize will be forfeited.

 

21.                    Entrants can only enter in their own name. The Promoter may require entrants to provide proof of identity, proof of age, proof of residency and proof of email address.  Identification considered suitable for verification is at the Promoter’s discretion.

 

22.                    The winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name, image and likeness in promotional material.

 

23.                    If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of the prize will be determined by drawing a further valid entry in accordance with paragraph 6.

 

24.                    The Promoter’s decision is final and no correspondence will be entered into.

 

25.                    The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

 

26.                    Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.

 

27.                    This competition is in no way sponsored, endorsed, administered by or associated with Facebook or Instagram.  Entrants are providing their information to the Promoter and not to Facebook or Instagram.  Each entrant completely releases Facebook and Instagram from any and all liability.

 

28.                    The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

 

29.                    If for any reason any aspect of this competition is not capable of running as planned, including by reason of tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory if required.

 

30.                    The Promoter is not liable for any tax implications arising from prize winnings.  Independent financial advice should be sought.  Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

 

31.                    All entries will be the property of the Promoter.  The information entrants provide will be used by the Promoter for the purpose of conducting this competition.  The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.  Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
