TERMS AND CONDITIONS: HOYTS CINEMA X-MEN: DAYS OF FUTURE PAST competition
Information on how to enter and prizes form part of these terms and conditions. Entry into the ‘Hoyts Cinema X-MEN: DAYS OF FUTURE PAST competition is deemed to be acceptance of these Conditions of Entry.
 
Entry is open to residents of Australia that are registered followers of HOYTS Australia on Facebook and must be at least 13 years old (“Eligible Entrant”). Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.
 
The competition commences on Saturday 17th May 2014 at 6.30pm, and closes 11:59pm AEST on Wednesday 28th May 2014 (“Promotional Period”).
 
There is ONE of TWO prizes to be won within the competition period. It will contain: 1x Limited edition (numbered) – Replica Magneto Helmet. Each item valued at RRP $750.
 
Prizes are not transferable or exchangeable. All references to times and dates are to times and sates in Sydney, NSW Australia.
 
To enter the competition, an eligible entrant must enter via the Facebook contact form with their answer, first name, last name and email address. Eligible entrants can enter multiple times throughout the entire competition period; however eligible entrants can only enter once per day during the competition period. All entrants are only eligible to win a maximum of one prize for the duration of the competition period. This is a game of skill, and chance plays no part in determining the prize winner. All valid entries received during the Competition Period will be judged by the Promoter based on their originality and creativity and whether the entry complies with these terms and conditions, including sections 14, 15, 16 and 17.  The entry judged to be the best (using the criteria referred to in this section) will win the prize.
 
Judging will be completed at the offices of the Promoter by close of business on Wednesday the 28th of May 2014. Winners will be notified on Thursday 29th of May 2014 in writing via email. The Promoter will notify the winner of the process of claiming the prize.
 
The Promoter reserves the right to request the winner (or entrant) to provide proof of identity and age, proof of residency and proof of entry validity in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
 
The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any entrant:
who tampers with the entry process;
who the Promoter has reason to believe has breached these terms and conditions;
who submits an entry that is not in accordance with these terms and conditions;
who has, in the opinion of the Promoter, engaged in any unlawful or other improper conduct which jeopardises, or may jeopardise, the fair and proper conduct of the competition; and/or
who has engaged in conduct in entering the competition which is unlawful, fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or the Promoter.
 
The Promoter reserves the right to disqualify an entrant or the winner if the Promoter becomes aware that the entrant or winner and/or the winner’s entry is of a type described in this section or is otherwise not in accordance with these terms and conditions.  The Promoter’s legal rights to recover damages or other compensation from such disqualified persons are reserved.
The Promoter may, in its sole discretion, determine whether an entry will be posted, or remain posted on the HOYTS Australia Facebook, Instagram, Twitter or Google Plus page in its absolute discretion, including if notified that the entry breaches any provision of these terms and conditions.
 
 
Entrants warrant and agree that their entry, including all content of the entry and their photograph (collectively referred to as the “Entry Content”), will at all times be:
the original independent creation of the entrant;
exclusively and solely owned by the entrant (including the copyright therein); and
free of any claims, including copyright or trademark claims by other parties.
Entrants warrant and agree that their Entry Content (in whole or in part) have not been published previously; do not and will not infringe any third party rights (including intellectual property rights or rights of privacy, publicity or confidentiality); are not unlawful, fraudulent, defamatory, obscene, profane, derogatory, pornographic, sexually inappropriate, politically incorrect, violent, abusive, insulting, scandalous, inflammatory, harassing, threatening, racist, ageist, sexist, objectionable with respect to religion, origin or gender, not suitable for children under 15, or otherwise unsuitable for publication or objectionable; will not contain viruses or cause injury or harm to any person or entity.
 
Entrants warrant and agree that they:
will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems;
have the full authority to grant to the Promoter the rights referred to in these terms and conditions; and
they are fully responsible for their Entry Content.
Entrants hereby grant the Promoter and the Promoter’s personnel, representatives, contractors, agents and related entities, a non-exclusive, perpetual, irrevocable, royalty-free, world-wide licence to use their Entry Content (and the intellectual property rights therein, including copyright) for the purpose of this competition and related marketing and publicity purposes. The owner of any copyright in the Entry Content consents to any use of the Entry Content which may otherwise infringe the owner’s moral rights, pursuant to the Copyright Act 1968 (Cth).
 
Consideration for the Promoter accepting the entrant’s entry, the entrant releases and forever discharges the Promoter from all claims that the entrant may have or may have had but for this release arising from or in connection with:
Any entrant’s participation in this competition (including the Entry Content itself);
 
The Promoter’s use or attempted use of the Entry Content; and the winner’s acceptance and/or use of the prize.
 
The entrant indemnifies and holds harmless the Promoter to the extent permitted by law in respect of any claim by any person (including but not limited to other entrants in this competition), arising as a result of or in connection with:
the entrant’s participation in this competition;
the entrant’s non-compliance with these terms and conditions (including a breach of any warranties contained in these terms and conditions); and/or the entrant’s acceptance or use of the prize.
In this section, “all claims” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising.
All entrants acknowledge that the Promoter can rely on these terms and conditions even if the Promoter only learns of a person’s ineligibility to enter after the Promoter has awarded a prize to the ineligible person.  Return of a prize or payment of its equivalent value to the Promoter can be required by the Promoter if this occurs.
Entrants agree that if a prize winner fails to comply with these terms and conditions, the Promoter may at its discretion award the prize to another entrant in accordance with these terms and conditions or may choose not to award such prize.
If for any reason this competition is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures, vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, adverse publicity, or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness, operation or integrity of this competition, the Promoter reserves the right in its sole discretion, to cancel, terminate, modify or suspend this competition.
Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to entrants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this competition.
Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes;
accepts no responsibility for late, lost or misdirected entries; and
will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss or damage or loss of opportunity) or for any personal injury suffered or sustained in connection with any aspect of this competition or the acceptance, collection and/or use of, or participation in, the prize, except for any liability which cannot be excluded by law.
This section 24 does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.
Promoter collects personal information from entrants to enable entrants to participate in this competition and the Promoter uses this personal information for the administration of this competition and prize fulfilment.  The Promoter may disclose an entrant’s personal information to the Promoter’s employees, contractors, agents, and affiliates for the purposes of administering this competition and for prize fulfilment, but no further use of this information will be made without prior consent.  All personal details will be held in accordance with the HOYTS Privacy Policy, which can be accessed by visitinghttp://www.hoyts.com.au/common/footer/privacy_policy.aspx.
 
By the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.  The Promoter’s decision in relation to any aspect of this competition is final and no correspondence will be entered into.
Entrants unconditionally and irrevocably release and discharge Instagram, Facebook, Twitter and Google Plus from any and all liability in relation to this competition. Entrants acknowledge that this competition is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook, Twitter and Google Plus. Entrants acknowledge that any information provided by entrants is provided to the Promoter and not to Instagram, Facebook, Twitter and Google Plus.
