OPTILIFE COMPETITION
TERMS AND CONDITIONS OF ENTRYInformation on how to enter and the prizes on offer form part of these terms and conditions. The submission of an entry in this competition is deemed acceptance of these terms and conditions.
Entry is only open to Australian residents aged 18 years or over only (Eligible Entrants).Entry to the competition is free.
Competition commences on [19th May 2014] at [10:00am], Sydney time
and closes on [30 June 2014] at [11:59pm], Sydney time (the Competition Period). Entries received outside the Competition Period are ineligible. An entry is deemed to be received at the time of its receipt by the Promoter and not at the time of transmission by the Eligible Entrant.
Winners will be notified by email or telephone at the Promoter’s discretion. The Promoter’s decision is final and no correspondence will be entered into.
Employees (and their immediate families) of the Promoter and agencies associated with this competition are ineligible to enter. Immediate family includes any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
To enter the competition, Eligible Entrants must, during the Competition Period:
(i) Access the competition entry form at [www.ktas.com.au/optilife];
(ii) In the space provided on the entry form, answer the question “Where would you go if you could drive 50,000km and why?” in 25 words or less;
(iii) Include their full name, the post code of their current address, a contact telephone number and a valid email address;
(iv) Provide details of the make, model of their vehicle;
(v) Click the check box on the entry form indicating acceptance of these terms and conditions; and
(vi) Click the button nominated on the entry form to submit or send their entry
Multiple entries are not permitted. Only the first entry from an Eligible Entrant will be considered for the purposes of this competition. Subsequent entries will be deemed invalid.This is a game of skill and chance plays no role in the determination of winners. Each week the winner will be determined by the most creative entry.
Every Monday during the Competition Period, one entry submitted in the week prior of the Competition Period will be adjudged (in the Promoter’s sole discretion) to be the most creative response to the question in clause 7(ii). Pursuant to this clause 9, six (6) winners (each, a Winner) will be selected. Winners will be selected on
26/5/14, 2/6/14, 9/6/14, 16/6/14, 23/6/14 and 30/6/14 at 12noon.
Each Winner will receive a set of 4 x Goodyear Optilife tyres (the Prize) to the value of $1000 AUD. The Prize includes fitting of the tyres to the Winner’s vehicle at any KTAS outlet in Australia, but does not include any further services or procedures such as wheel balancing or wheel alignment. Subject to this clause, the Prize is not transferable or exchangeable. If the Winner’s vehicle is one in which Goodyear Optilife tyres cannot be fitted, or where a set of 4 x Goodyear Optilife tyres exceeds $1000, the Winner may nominate another party (the Nominee) to receive the Prize. In that event, the Nominee will be bound by these terms and conditions on the same terms as a Winner. If no Nominee can be identified by the Winner by 14th July 2014, the Promoter reserves the right to re-allocate the Prize to another Eligible Entrant in its absolute discretion.
Winners will be notified by 7 July 2014 by either telephone or email. Winners must respond within 7 days of notification from the Promoter to confirm whether they will be claiming the Prize. Any Winners who fail to do so will be deemed to have forfeited their Prize.
Winners (or Nominees) must attend a Kmart Tyre & Auto Service outlet by 31st October 2014 to arrange the installation of the Prize to their vehicle. The Winner (or Nominee, as the case may be) is responsible for all costs involved in bringing their vehicle to and from Kmart Tyre & Auto Service.
The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence). Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
Total prize pool value is up to $6,000 AUD.
Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.
Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these terms and conditions; (e) any tax liability incurred by a Winner or Eligible Entrant; or (f) use/taking of the Prize.
As a condition of accepting the Prize, the Winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. Eligible Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
