Use the Right Bin and Win Competition
Competition Updates

 

The 10 week competition commenced Monday 2 June 2014. Watch this space for regular updates on inspection outcomes.

Week 1: Bin inspections at the randomly selected properties in Kooringa Street and Solvay Road Taperoo did not identify food waste in the green organics bin. The prize pool will increase for the week 2 inspections to a total value of $200

Week 2: Bin inspections at the randomly selected property Chester Avenue Clearview found no food waste in the green organics bin. The prize pool will increase for the week 3 inspection to a total value of $300

Week 3: Bin inspections at the randomly selected properties in Hutton Street and Berry Court Klemzig found no food waste in a green organics bins. The prize pool for the week 4 inspection is at a total value of $400

Week 4: Bin inspections at the randomly selected properties in Grand Junction Rd and Hopkins Street Wingfield found no green organics bins placed out for collection. The prize pool for the week 5 inspection is at a total value of $500
Competition Terms and Conditions

 
General

1. The Promoter of this competition is the City of Port Adelaide Enfield (“the Council”) of 163 St Vincent Street, Port Adelaide SA 5015, telephone number: (08) 8405 6600.

2. Entry into the competition is automatic to all Residents of the Council over the age of 18 years except Elected Members of the Council, employees of the Council and/or KESAB, and immediate family members of Elected Members or employees of the Council and/or KESAB.

3. Residents can ‘opt out’ of the competition:

3.1 by contacting KESAB environment solutions on (08) 8234 7255; and/or

3.2 by attaching a note to the lid of the Residents’ green organics bin with the words “No Inspection”.

4. All Residents (that do not opt out of the competition) agree to be bound by these Terms and Conditions.
Interpretation

5. For the purposes of the Terms and Conditions, the following definitions apply:

5.1 correct bin usage in relation to a property is as described in clause 16 of the Terms and Conditions;

5.2 correct food waste disposal in relation to a green organics bin is assessed to have occurred where any food waste is found therein;

5.3 a green organics bin is assessed as being ‘contaminated’ if any of the following items are found therein: any non-compostable materials examples include but are not limited to plastic bags, non- compostable food packaging, rocks, building materials, metals, plastics, glass and/or nappies;

5.4 food waste includes loose food, food in compostable bags, and/or food waste wrapped in newspaper or paper towel;

5.5 immediate family members includes spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparents, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin; and

5.6 a Resident is, subject to the eligibility requirements set out in the Terms and Conditions, a person who occupies rateable property in the Council area and who is responsible for the sorting and removal of waste from the property, which includes putting waste from the property out for collection.
Competition Period

6. The competition commences on Monday 2 June 2014 at 12.00am Australian Central Standard Time (ACST) and concludes on Sunday 10 August 2014 at 11.59pm ACST.

7. No inspection of bins will be undertaken after the closing date and time.
Draw

8. On a weekly basis, the Council’s Waste Management Officer (“the Officer”) will randomly select 2 rateable properties within a suburb in which a green organics waste collection is scheduled. The first randomly selected property is Property 1 and forms the priority for inspection. The second randomly selected property is Property 2.

9. If the bins at Property 1 are inspected, the bins at Property 2 will not be inspected irrespective of the outcomes of any inspection of the bins at Property 1.

10. Inspection of the bins at Property 2 will only occur if:

10.1 Property 1 has not placed bins out for collection; or

10.2 Property 1 has not placed a green organics bin out for collection; or

10.3 bins out for collection cannot be reasonably ascertained as belonging to Property 1; or

10.4 bins placed out for collection were emptied by the contracted waste collection company prior to the inspection being conducted; or

10.5 the inspection of the contents of bins placed out for collection in connection with Property 1 is unable to occur for any other reason.

11. If bins at both Property 1 and Property 2 are unable to be inspected, no prize will be awarded for that week and the weekly prize will jackpot and will be added to the prize or prize pool for the next scheduled property bin inspection pursuant to clause 8 of the Terms and Conditions.
Inspection of Bins

12. Bin inspections will be conducted by two persons employed by and under the direct guidance and training of KESAB environment solutions. The purpose of a bin inspection is to determine whether correct bin usage has occurred in relation to a property.

13. If requested to cease inspection of a bin by the Resident of the property (once the Resident has proved their identity as the occupier of the property to the bin inspector) the bin inspector will discontinue the inspection immediately.

14. Bin inspectors will maintain any information regarding personal contents identified whilst inspecting the bin in the strictest confidence.

15. If correct food waste disposal is identified in the green organics bin, an inspection of the general waste bin will be conducted to check for food waste.
Eligibility for Prizes

16. Where upon inspection of the bins presented for collection in relation to a property:

16.1 correct food waste disposal is identified in the green organics bin and that bin is not contaminated; and

16.2 no food waste is found in the general waste bin,

it will be determined that ‘correct bin usage’ has occurred and the Resident of the property will be entitled to receive the prize (or prize jackpot if applicable).

17. If only a green organics bin is presented for collection at the relevant property, and the inspection identifies correct food waste disposal and that the bin is not contaminated, the Resident will be entitled to receive the prize (or prize jackpot if applicable);

18. If only a general waste bin is presented for collection at the relevant property the Resident is not eligible for a prize.

19. The bin inspector’s decision as to whether correct bin usage has occurred in relation to a property (which gives rise to eligibility for a prize on the part of a Resident) is final.
Prize

20. The total prize pool value is $1,000.00 (including GST). The weekly prize for correct bin usage is a Bunnings Gift Voucher to the value of $100.00. The Council reserves the right to substitute this prize for another prize of equal or greater value, subject to any relevant State legislation.

21. Gift vouchers are subject to the terms and conditions imposed by the gift card provider. Once awarded, the Council is not liable for and will not replace any voucher that has been lost, stolen, forged, damaged or otherwise expires.

22. The weekly prize will jackpot each week if correct bin usage is not identified and as a result no weekly prize is awarded.

23. Only one prize will be awarded per property during the term of the competition.

24. In the event that correct bin usage is not identified in relation to any of the bins inspected during the competition period, no prizes will be awarded.

25. No compensation is payable if a winner is unable to or does not use the prize.
Winner Notification

26. Where correct bin usage is identified in relation to a property, the Council will write to the Resident of the property and request that the Resident contact the Officer within fourteen (14) days of the date of the letter to coordinate collection of the prize. Prizes must be collected by Friday 5 September 2014.

27. In the event that contact is not made by the Resident within 14 days, the Officer will attend the property and leave a calling card to request that the Resident contact the Council and explaining the reason for the request.

28. In the event contact is not made by the Resident within 14 days of the leaving of the calling card at the property, the Resident forfeits the prize. The Council may, in its absolute discretion, re-issue the prize to another Resident who is eligible for a prize in accordance with these Terms and Conditions.
Further Terms and Conditions

29. Any instructions relating to the competition on the Council’s website form part of these Terms and Conditions. If there is any inconsistency between these Terms and Conditions and anything else that refers to this competition, these Terms and Conditions will prevail.

30. The Council may, in its absolute discretion, require a prize winner to sign a legal release in a form determined by the Council.

31. The Council reserves the right to publish on the Council’s website, a brief summary of the bin inspection results, street names and suburbs. The Council will not publish details of any property numbers.

32. The Council may, in its discretion, refuse to award any prize to any Resident who fails to comply with these Terms and Conditions.

33. Any decision that the Council makes in connection with the competition is final and the Council will not enter into correspondence regarding the competition result.

34. The Council reserves the right to request prize winners to provide proof of identity and/or proof of occupancy before claiming any prize. Proof of identification and occupancy considered suitable for verification is at the discretion of the Council. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize and no substitute will be offered.

35. Subject to complying with all relevant legislation:

35.1 if for any reason the competition is not capable of running as planned; or

35.2 an event beyond the control of the Council corrupts or affects the administration security, fairness, integrity or proper conduct of the competition; or

35.3 in the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Council’s ability to proceed with the competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism,

the Council may, in its sole discretion, cancel, terminate, modify or suspend the competition or take any other action it considers appropriate in the circumstances.

36. By entering the Competition and/or claiming a  prize, a Resident agrees to release and indemnify the Council from any liability or claim, loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

37. Any Resident who the Council reasonably believes has engaged in any unlawful or other improper misconduct that jeopardises the fair and proper conduct of the competition, including but not limited to conduct that is damaging to the reputation of the Council, is not eligible for a prize. The Council reserves its rights to recover damages or other compensation from such Resident.
