1.
This competition is a promotion run by Energex Limited ABN 40
078 849 055 (“Promoter”).
2.
Information on the prize and how to enter form part of these
terms and conditions. Entries not completed in accordance
with these terms are ineligible. Participation in this competition
constitutes acceptance of these terms and conditions.
3.
The competition is open to all persons (who are aged 18 years
or over) and businesses that satisfy all of the following:
a)
the applicant’s premises where the eligible demand
response enabled air-conditioner is installed is located in
South East Queensland;
b)
the applicant’s premises where the eligible demand
response enabled air-conditioner is installed is connected
to the Promoter’s electricity distribution network and has a
National Meter Identifier in place at the time the PeakSmart
Compatible Air-conditioner Program application was lodged
with the Promoter.
c)
the applicant has purchased, installed and connected an
eligible demand response enabled air-conditioner compliant
with the Promoter’s Positive Payback PeakSmart Compatible
Air-conditioner Program; and
d)
the applicant successfully submits an application for a
Positive Payback PeakSmart Compatible Air-conditioner
Program reward to the Promoter between 12:01am Australian
Eastern Standard time, Thursday 1 May 2014 and 11:59pm
Australian Eastern Standard time Thursday 31 July 2014.
4.
The winner of the prize will be drawn at 10:00am Australian
Eastern Standard time on Friday 15 August 2014 at the
Promoter’s office, 26 Reddacliff Street, Newstead QLD 4006.
5.
The prize is the amount of the GST inclusive purchase price of
the winner’s eligible demand response enabled air-conditioner
or, where the winner has purchased more than one -eligible-
demand response enabled air-conditioner as part of their
Positive Payback PeakSmart Compatible Air-conditioner
Program application, the purchase price of the highest value
eligible demand response enabled air-conditioner purchased,
in both cases
up to a maximum of $3,000.00
(GST inclusive amount).
6.
The prize amount equal to the GST inclusive purchase price of
the winner’s eligible- demand response enabled air-conditioner
includes any discount to purchase price received by the winner
and excludes charges for:
a)
delivery;
b)
installation of the air-conditioner;
c)
installation of the Signal Receiver;
d)
testing; and
e)
extended warranty cover.
7.
The prize value is inclusive of GST. Any taxes which may be
payable as a consequence of the winner receiving the prize are
the sole responsibility of the winner. Should a GST registered
enterprise win the competition, a valid tax invoice in a form
acceptable to the Promoter will be required by the Promoter in
order for the business to claim the prize.
8.
There will be one winner in this competition that will be chosen
at random from all eligible entries received. The winner of the
prize will be the first entry drawn. The Promoter’s decision is
final and no correspondence will be entered into (other than
notifying the winner of the prize). The results of the competition
will not be published.
9.
Entry to this competition is by the applicant successfully
submitting a completed Positive Payback PeakSmart
Compatible Air-conditioner Program application online at
www.energex.com.au/positivepayback and the applicant filling
in their first name, last name, email address, postal address,
telephone contact number, eligible demand response enabled
air-conditioner make and model, the Promoter’s Signal Receiver
(DCR) number, and attaching both their PeakSmart Installation
Form and their proof of purchase that shows their purchase
price for the eligible demand response enabled air-conditioner.
10.
A list of all demand response enabled air-conditioners eligible
for participation in the Promoter’s Positive Payback PeakSmart
Compatible Air-conditioner Program can be viewed on the
Promoter’s website at
www.energex.com.au/positivepayback.
11.
Only one entry per residential or business premises
is permitted.
12.
The winner will receive their prize by cheque payment drawn by
the Promoter made out to the winner as set out in the winner’s
Positive Payback PeakSmart Compatible Air-conditioner
Program application form.
13.
The Promoter may substitute a prize of similar nature and/or like
or greater value.
14.
The Promoter reserves the right to check the details of the proof
of payment provided by the winner with the issuer of the proof
of payment.
15.
The prize will be sent to the winner’s postal address as set out
in their Positive Payback PeakSmart Compatible Air-conditioner
Program application form.
16.
The prize is not transferable or exchangeable.
17.
The winner will be notified by mail, phone or email using the
postal address, telephone number or email address as set out
in the winner’s Positive Payback PeakSmart Compatible Air-
conditioner Program application form.
18.
If the winner is unable to be contacted within 3 months of the
draw a redraw will occur. In the event that a redraw is required
it will be held at 10am Australian Eastern Standard time on the
day that the redraw is conducted at the Promoter’s office, 26
Reddacliff Street, Newstead QLD 4006 and the redraw winner
will be notified by mail, phone or email using the postal address,
telephone number or email address as set out in the winner’s
Positive Payback PeakSmart Compatible Air-conditioner
Program application form.
19.
All entries become the property of the Promoter. The Promoter
accepts no responsibility for Positive Payback PeakSmart
Compatible Air-conditioner Program applications unsuccessfully
submitted in the timeframe outlined in clause 3.d) above.
20.
The information that entrants provide will be used by the
Promoter for the purpose of conducting the competition, and
to periodically keep entrants informed about the goods and
services provided by the Promoter. By entering this competition
entrants consent to the use of their contact details for the
purposes described in this clause. Details of the Promoter’s

21.
If for any reason this competition is not capable of being
conducted by the Promoter as intended, whether because
of computer virus, mobile phone failure, bugs, tampering,
unauthorised intervention, fraud, technical failures, or any
other cause beyond the reasonable control of the Promoter
which in the Promoter’s opinion affects the administration of the
competition, security, fairness or integrity, the Promoter may in
its sole discretion, cancel, modify or suspend the competition,
subject to the approval of the Queensland Office of Liquor and
Gaming Regulation as may be required.
22.
The Promoter will not be liable for any loss or damage (including
but not limited to indirect, economic or consequential loss) or for
any personal injury sustained in connection with this competition
or taking the prize (including but not limited to any delays in
delivery of the prize) except for any liability which cannot be
excluded by law. The Promoter makes no representations or
warranties as to the quality, suitability or merchantability or any
goods or services offered as the prize. To the extent permitted
by law, the Promoter is not liable for any loss (including but not
limited to indirect, economic or consequential loss) suffered to
person or property by reason of any act or omission, deliberate
or negligent, by the Promoter or its employees or agents, in
connection with the arrangement for the supply, or the supply,
of goods and services by any person to the prize winner,
and where applicable, to any persons accompanying the
