CIL iPAD COMPETITION JULY-NOVEMBER 2014 - TERMS AND CONDITIONS
PARTICIPATION

1. This competition ("Competition") is conducted by AAI Limited ABN 48 005 297 807, AFSL 230859, trading as CIL Insurance, of Level 28 Brisbane Square, 266 George Street, Brisbane, Queensland 4000 ("Promoter"). Please direct any postal correspondence to Level 35, 530 Collins Street, Melbourne, Victoria 3000. Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

2. Entry to the Competition constitutes acceptance of these Terms and Conditions. All entry instructions and prize information published by the Promoter form part of these Terms and Conditions.

3. The Competition is only open to individuals who: (i) are residents of Australia aged 18 years or older as at time of entry; and (ii) are not employees of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) are not a spouse, de-facto spouse, parent, child or sibling (whether natural or by adoption) of any employee specified in 3(ii)(“Eligible Entrant”).

4. The Competition as a whole is made up of two (2) component competitions (being Competition 1 and Competition 2, and each is referred to as a “single competition”). The entry period ("Entry Period") and draw date for each single competition is specified in the table below. Except as otherwise stated, the terms and conditions of entry into each single competition are identical.

5. Except as otherwise indicated:
(a) all amounts stated in these Conditions are stated in Australian dollars;
(b) all times stated in these Conditions are the time in Melbourne, Australia.
ENTRY

6. To enter Competition 1 and/or Competition 2, Eligible Entrants must do one of the following during the relevant Entry Period:

a) to enter at an event during which the Promoter is in attendance, an Eligible Entrant must fully complete the Promoter’s entry form including First Name, Last Name, and Email address, nominate whether they are an existing customer, and agree to the terms and conditions and to receive CIL Insurance marketing communications; or

b) to enter via the internet, an Eligible Entrant must use a compatible browser to visit cilinsurance.com.au (“Competition Website”) and follow the directions to complete the online entry form. To obtain an entry into the Competition, the Eligible Entrant must fully complete the entry form including First Name, Last Name, and Email address, nominate whether they are an existing customer, and tick the boxes agreeing to the terms and conditions and to receive CIL Insurance marketing communications.

It is a condition of entry that Eligible Entrants consent to receive CIL Insurance marketing communications.

7. Entry by an Eligible Entrant into Competition 1 during the Entry Period will also automatically result in entry into Competition 2, unless the Eligible Entrant has already won a Prize. Entries are limited to one per person.

8. All Eligible Entrants must ensure that the Promoter receives their entries during the Entry Period for each applicable competition. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of submission by the Eligible Entrant. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures in any telecommunications service or equipment.

9. The Promoter may, at its absolute discretion, declare any or all entries made by an Eligible Entrant invalid if the Eligible Entrant tampers with the entry process, benefits from such tampering or their entry is in not in accordance with these Terms and Conditions or otherwise acts in a manner that is disruptive, dishonest or calculated to jeopardise the fair and proper conduct of this Competition.

10. The Promoter reserves the right to require an entrant to verify the validity of entries, including an Eligible Entrant’s identity and age, and to disqualify any entrant who has breached the entry criteria explained in these Terms and Conditions. Errors and omissions may be accepted at the Promoter’s discretion. Proof considered suitable for verification is at the Promoter’s discretion.
INTERNET ENTRIES

11. Eligible Entrants must submit their internet entries manually. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service. There is no cost for entering the Competition but when entering via the internet connection and usage rates may apply. Eligible Entrants should obtain details of such costs from their service providers.
DRAW AND PRIZES

12. The draws will be held at Frank Moore Advertising, Level 6, 7 Bowen Crescent, Melbourne, VIC 3004.

13. There is a total of 4 Prizes to be won as follows:

PROVISIONS APPLICABLE TO THE PRIZES GENERALLY

14. Each Prize is valued at $749. The total Prize pool for the whole Competition is $2,996 including GST.

15. The Prizes are valued as at 2 June 2014. The Prize value is the recommended retail value (including GST) in Australia. The Promoter accepts no responsibility for any variation in Prize value, or for any tax implications that may arise from prize winnings.

16. All ancillary costs that are associated with the acceptance and use of the Prize will be the responsibility of each winner.

17. If a Prize is unavailable for any reason, the Promoter may, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification subject to the approval of any relevant gaming authority, where required. The Promoter accepts no other liability or responsibility for any loss incurred by the winners or any other party if a Prize is unavailable for any reason.

18. The Prizes are non-transferable, non-refundable, non-exchangeable, non-replaceable, and non-redeemable for cash.

19.The winners will be notified by e-mail to the e-mail address provided in their entry as follows:

20. The notification to each winner will state that they have won the Prize and will include instructions as to how the winner is to claim the Prize and establish his/her entitlement to it.

21. The names of the winners will be published on the Promoter's website within 7 days of each Prize being won (including if a Prize is won under any redraw under condition 22), for a period of at least 1 week.

22. Subject, where relevant, to any directions given under the legislation regulating the Competition, if: (i) the Prize is not claimed by the Prize winner within 3 months of the draw for the Prize; (ii) the Prize winner cannot be contacted via the methods set out herein after reasonable attempts; (iii) the Prize is forfeited for any reason; or (iii) the Prize winner is determined by the Promoter to be ineligible, the Prize will be awarded to another Eligible Entrant in a redraw for the Prize. Any such redraw will be made from a pool of entries comprising all those entries that were originally eligible to win the Prize. Redraws, if required, will take place at the address specified in condition 12 and at the following times for the respective single competitions:

Any redraw Prize winner will be notified by a written message that will be sent by e-mail to the e-mail address provided by them in their entry. The prize winner will be notified within 2 days of the determination of the redraw (if any).
GENERAL

23. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.

24. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Eligible Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competitions; (iv) any incorrect or incomplete information which may be communicated in the course of the administering the Competitions (whether as a result of one of the foregoing causes or otherwise); (v) any delay in delivery, or failure of safe delivery of the Prizes. To the extent that such liability cannot be excluded by law, it is limited to the minimum allowable by law.

25. All of the Promoter's decisions are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

26. A Winner accepts the Prize at his or her own risk. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competitions or Prizes, including without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death.
PRIVACY AND MARKETING CONSENT AND DISCLOSURE

27. Entrants’ personal information is collected from entrants by or on behalf of the Promoter to enable the Promoter and its agents to manage, administer and promote the Competition and, where applicable, publicise the winner(s). The personal information may also be provided to persons assisting the Promoter, including prize suppliers and deliverers, marketing agencies and IT providers, and to gaming authorities, media outlets and related companies. The winners’ names will be published on the Promoter’s website. By participating in the Competition, Eligible Entrants consent to these uses and disclosures of their personal information.

28. If an Eligible Entrant does not provide the personal information the Promoter requests, the Promoter may not be able to enter them into the Competition. All personal information is handled in accordance with these conditions and the Promoter’s Privacy Policy. Information about how to access or correct the personal information that the Promoter holds about you, or complain, can be found in the Promoter’s Privacy Policy available online at www.cilinsurance.com.au/privacy .

29. Entry into the Competition also entitles the Promoter and any related companies that use the CIL Insurance brand to let the Eligible Entrant know from time to time about news, offers, products and services they might be interested in (by any medium, including telephone, email, mail, SMS or online marketing). In order to carry out direct marketing, entrants’ personal information will be collected from and disclosed to others that provide us with specialised data matching, trending or analytical services, as well as general marketing services.  We, and other people who provide us with services, may combine the personal information collected from entrants or others, with the information we, or other companies in the Suncorp Group, or our service providers already hold about entrants.  We may also use online targeted marketing, data and audience matching and market segmentation to improve advertising relevance. Each Eligible Entrant agrees that they provide their consent to receive such marketing communications.
