Conditions of Entry
1. Entry instructions form part of these Conditions of Entry.
2. Entry into this Promotion is deemed to be acceptance of these Conditions of Entry. The Promoters’ decision not to enforce a specific restriction does not constitute a waiver of that restriction or of the Conditions of Entry generally.
3. Entry is only open to residents of Victoria aged 18 years or over who are a Hume & Iser Home Timber & Hardware ‘DIY Rewards’ loyalty program member (“Eligible Entrants”). Eligible Entrants must ensure that their contact details registered on their ‘DIY Rewards’ loyalty program membership are accurate and up to date at the time of the draw in order to be contacted in the event they are the winner.
4. The shareholders, directors, management and employees (and their spouse/de facto) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion.
5. Entry commences at 7.30am on Monday 01 September 2014 and closes at 5.30pm on Wednesday 31 December 2014 (the “Promotional Period”).All times indiciated are in AEST/AEDST, as per local Victorian time.
6. To receive an automatic entry, Eligible Entrants must spend $50 or more in a single transaction (excluding the purchase of Gift Cards) at Hume & Iser Home Timber & Hardware during the Promotional Period and present their ‘DIY Rewards’ membership card at the time of purchase (“Eligible Purchase”). Eligible Entrants will receive one (1) entry for every $50 increment spent in an Eligible Purchase. For the sake of clarity, an Eligible Entrant that spends between $100 and $149.99 in an Eligible Purchase will receive two (2) entries, an Eligible Entrant that spends between $150 and $199.99 in an Eligible Purchase will receive three (3) entries, etc.
7. Incomplete transactions will be deemed invalid.
8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per $50 increment spent in an Eligible Purchase; and (b) each entry must be submitted in accordance with the entry instructions.
9. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at

the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
10. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
11. The draw to determine the winner will be conducted as follows:
The first valid entry drawn (by computer-generated selection) at 212F Pty Ltd, Level 7, 606 St Kilda Road, Melbourne VIC 3004 at 2:00PM on Wednesday 28 January 2015 will win one (1) white Volkswagen Golf 90TSI DSG with automatic transmission, valued at $27,490 AUD (“Prize”). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
12. The winner will be notified in writing, and their name will be published online at
www.humeiser.com.au from Wednesday 11 February 2015.
13. Prize includes standard fittings, 12-months registration in Victoria, 12-months compulsory third party insurance, on road costs, stamp duty and dealer delivery charges. All ancillary costs or accessories not expressly provided are the responsibility of the winner. The Prize excludes comprehensive insurance, operational costs, fuel, personal costs and any other ancillary or incidental costs related to the Prize or anything else not specifically mentioned in this Condition, which are the responsibility of the winner. It is a condition of accepting the Prize that the winner acknowledges that they may incur ongoing costs associated with the Prize which are the entire responsibility of the winner. The winner will need to collect the Prize from Symes Motors Volkswagen, 191 High Street Bendigo, Victoria, LMCT 1140. The Prize will not be delivered to the winner.
14. To claim the Prize, the winner must be capable of obtaining motor vehicle registration of the motor vehicle Prize in his or her name in accordance with the applicable Victorian legislation. If the winner is, through any legal incapacity or otherwise, unable to register the Prize in their own name, then such winner may assign the Prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee.
15. It is a condition of being awarded the Prize that the winner must, following notification and prior to the awarding of the Prize, confirm their full name and address, and provide the Promoter with a copy of their current and valid Australian driver’s license. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the Prize is awarded. The winner must sign all documentation necessary to enable the Promoter (or its nominated dealer) to register the Prize in the winner's name prior to the winner’s collection of the car from Symes Motors Volkswagen, 191 High Street Bendigo, Victoria, LMCT 1140. All costs associated with travel to and from the dealership is at the winner’s own

cost. The Promoter accepts no responsibility for any mechanical, body or paint repairs or repairs or maintenance of any kind relating to the Prize after the date and time of Prize collection by the winner.
16. Total Prize pool value is $27,490 AUD (current as at 01 May 2014). The Prize is not transferable or exchangeable and cannot be taken as cash. The Prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in Prize value. The Prize value is the recommended retail price including GST (if applicable).
17. Any vehicles depicted in any promotional material are not necessarily the same colour or grade as the Prize vehicle, and are for illustration purposes only.
18. The Prize will be the actual vehicle on display in-store at Hume & Iser Home Timber & Hardware during the Promotional Period. Subject to agreement by Symes Motors Volkswagen and subject to the winner agreeing to pay any additional amount requested by Symes Motors Volkswagen, the winner may add optional extras and accessories to the Prize at the winner’s expense.
19. If for any reason the winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited.
20. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
21. All entries become the property of the Promoter. No responsibility is accepted for late, lost or misdirected entries. The Promoter’s decision in relation to any aspect of the Promotion is final and binding on every person who participates, and no correspondence will be entered into.
22. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter, its officers, employees, contractors, representatives and agents shall not be liable for any claims, losses (including loss of opportunity), damages, injuries, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential loss, or arising as a result of any negligent act or omission) as a result of, or arising out of, or in any way connected with:

any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
any theft, unauthorised access or third party interference;
any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter);
any variation in the prize value to that stated in these Conditions of Entry;
any tax liability incurred by a winner or Eligible Entrant; and/or
the Prize (including the use or attempted use of the Prize).
24. Eligible Entrants’ personal information ("Personal Information") will be collected to enable the Promoter to administer and promote this Promotion and the winner. The Personal Information of the winner may be provided to others assisting, including Prize suppliers and deliverers, and to authorities that regulate this Promotion. Entry is conditional on providing this Personal Information. The Promoter will also use and handle Personal Information as set out in its Privacy Policy, which can be viewed at
www.homehardware.com.au. The Privacy Policy also contains information about how Eligible Entrants may opt out, access, update or correct their Personal Information, how Eligible Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose Eligible Entrant’s Personal Information to any entity outside of Australia. If an Eligible Entrant does not truthfully provide all requested Personal Information, the Promoter may determine that they are not eligible to win the Prize.
25. All Eligible Entrants acknowledge that the Promoter can rely on these Conditions of Entry even if the Promoter only learns of a person’s ineligibility to enter after the Promoter has awarded a Prize to the ineligible person. Return of a Prize or payment of its equivalent value to the Promoter can be required by the Promoter if this occurs.
26. If for any reason the conduct or operation of this Promotion is interfered with or disrupted in any way beyond the reasonable control of the Promoter (including but not limited to, vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, fraud, tampering, technical failures or any other causes beyond the control of the Promoter), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrant; or (b) to cancel, terminate, modify or suspend or recommence the Promotion, subject to the approval of the authorities that have issued permits for its conduct.
27. The Promoter assumes no responsibility for any incorrect or incomplete information which may be communicated in the course of administering this Promotion.
28. As a condition of entering this promotion, an Eligible Entrant consents to, in the event they are the winner, the Promoter using the Eligible Entrant’s

name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Eligible Entrant agrees that, in the event they are the winner, the Eligible Entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
