Introduction
1. The Promoter is V8 Supercars Australia Pty Ltd (ACN 077 053 484) of 45 Nerang Street, Southport, 4215, Queensland (“V8 Supercars”).
2. Instructions and information on how to enter form part of the Conditions of Entry.
3. By registering and participating in the Promotion, participants agree to be bound by these Conditions of Entry.
4. V8 Supercars reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms and conditions, at any time. It is your responsibility to check these Terms and conditions periodically for changes.
Eligibility Criteria
5. Entry is open to Australian residents only. Directors, management and the employees of V8 Supercars and promotional partners, agencies and suppliers associated with this Promotion and the immediate family members of these people are ineligible to enter. You must be over 18 to enter.
How to enter
6. The Promotion commences 7:00am on Saturday, 2 August 2014 and concludes at 7:00pm Saturday 16 August 2014 (“Promotion Period”).
7. To enter:
o Purchase a valid 3 day entry ticket to the Sydney Motorsport Park 400 and input the transaction number.
o Purchase either a
1. 3 day Trackside ticket; or
2. 3 day Fanstand ticket; or
3. 3 day Grandstand ticket.
o Head to v8supercars.com.au/10hotlaps fill out the competition form.
o Answer the following question “In 25 words or less describe why would you make a good passenger in the V8 Supercar?” Remember to keep it clean and amusing!
8. This is a game of skill and chance plays no part in determining the winner. Entries must be the entrant’s original work.
9. Only one entry per person permitted.
10. Entries must be received during the Promotion Period.
11. No responsibility is accepted for late, lost, misdirected or illegible/inaudible entries.
12. All entries become the property of V8 Supercars and will not be returned. V8 Supercars may use, and may disclose in any newspaper, advertisement, publication, media statement or other general and promotional material, any materials entrants provide in relation to the Promotion for V8 Supercars’ promotional and business purposes.
Prizes
13. All valid entries will be judged by representatives of the Promoter based upon, among other things, literary and creative merit. The best valid entry, as determined by the judge/s, will be awarded the major prize.
14. Winners will be announced daily from Friday 08 August 2014 for 10 days. Last winner announced Sunday 17 August and results will be published on V8 Supercars' website. If a winning entry is invalid, that entry will be discarded and the prize will be awarded by drawing another entry in accordance with these Conditions of Entry.
15. 10 x major prizes:
o 10 x V8 Supercars Hot Laps:
1 Hot Lap for each daily Winner
Total of 10 Winners
Note: Any general expenses associated with this prize are not included in the prizing
16. Total approximate maximum prize pool $100,000
17. Prizes are not transferable or exchangeable and cannot be taken as cash.
18. V8 Supercars’ decision is final and no correspondence will be entered into.
19. If a prize, or element of a prize, is unavailable for any reason, V8 Supercars reserves the right to substitute another prize of equal or greater value for that prize, or element of it, subject to the approval of any relevant authority.
20. In the event of the prize not being accepted or claimed within 2 days of the draw, the relevant winner’s entry will be deemed invalid and V8 Supercars reserves the right to conduct such further draws until prizes have been allocated to valid winners, at the same location as the original draw as are necessary to distribute the prize.
General entry provisions
21. V8 Supercars accepts no responsibility for any tax implications that may arise from winning of the prizes. Independent financial advice should be sought.
22. V8 Supercars and its agencies and companies associated with this Promotion are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this Promotion. If the Promotion is not capable of being conducted due to circumstances beyond the Promoter’s control, including due to any technical or communications problems, the Promoter reserves the right to amend, suspend or cancel the Promotion subject to approval from any relevant authority.
23. V8 Supercars reserves the right to disqualify all entries from any entrant who tampers with, or benefits from tampering with, the entry process or the Promotion.
24. Nothing in these Conditions of Entry limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees under the Competition and Consumer Act 2010 (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, V8 Supercars (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury and any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion.
25. Except for any liability that cannot be excluded, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury and any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the following:
1. any technical difficulties or equipment malfunction (whether or not under V8 Supercars’ control);
2. any fraud, theft, unauthorised access or third party interference;
3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by V8 Supercars) due to any reason beyond the reasonable control of the V8 Supercars;
4. any variation in prize value to that stated in these Conditions of Entry;
5. any tax liability incurred by a winner or entrant;
6. taking or use of all or part of a prize; or
7. the function, working order or availability of or access to any website operated by V8 Supercars.
25. The entrant releases and agrees to keep V8 Supercars indemnified and held harmless from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by V8 Supercars arising out of the entrant’s:
1. participation in the Promotion;
2. taking or use of all or part of a prize; and
3. any claim by a third party arising from an act or omission by the entrant.
26. The Promoter is not liable for any failure to comply with these Conditions of Entry. If any part or provision in these Conditions of Entry is found to be invalid, void, voidable, unenforceable or illegal, that part or provision will be read down so that it is not invalid, void, voidable, unenforceable or illegal. If the term or condition cannot be read down, it will be severed and the remaining provisions will continue in full force.
27. These Conditions of Entry constitute the entire agreement between the entrant and V8 Supercars as to its subject matter.
Collection and use of personal information
28. V8 Supercars may use any personal information entrants provide in connection with this Promotion for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. V8 Supercars may disclose the information for those purposes to its related bodies corporate and contractors. If entrants do not provide the information requested, they will not be able to enter the Promotion.
29. By participating in the Promotion, each entrant acknowledges and agrees that a further primary purpose for collection of personal information by the Promoter is to enable the Promoter to contact the entrant in the future in relation to this Promotion, other promotions, special offers and promoting and marketing goods and services of the Promoter, including by telephone. Entry is conditional on providing this information which will be handled in accordance with the Privacy Policy available at
www.v8supercars.com.au. Entrants can access and request correction of their personal information by contacting V8 Supercars Australia Pty Ltd at 45 Nerang Street, Southport, QLD 4215.
30. If the entrant has elected to receive electronic commercial messages from V8 Supercars, V8 Supercars may, for an indefinite period, unless and until otherwise advised by an entrant to the contrary (e.g. through the use of an unsubscribe facility), use the entrant’s personal information for promotional, marketing, publicity, research, profiling and customer satisfaction purposes, including sending electronic commercial messages to the entrant.
31. If the entrant has elected to receive direct mail from V8 Supercars, V8 Supercars may, for an indefinite period, unless and until otherwise advised by an entrant to the contrary, use the entrant’s personal information for direct mail, promotional, marketing, publicity, research, profiling and customer satisfaction purposes
