‘Win an Intel NUC’ Terms and ConditionsImportant: Please read these terms and conditions (these "Terms" and Conditions") before entering the contest. This is a legally binding agreement between you and Intel establishing the terms and conditions under which you are entitled to participate in the contest. By entering the contest, you confirm that you have read and understood, and agree to abide by, these terms and conditions.
Organiser
The ‘Win an Intel NUC contest’ is organised by Intel Australia PTY LTD and/or its affiliates (“Intel”).
Eligibility
This contest is open to participants aged 18 years and above, who are residents of Australia only. All entries must be submitted within the contest period. Entries submitted outside of the contest period will be disqualified from the contest.
Not eligible
The following are not eligible to participate in the contest:
• employees of Intel and their immediate family members.
• employees of any party which is directly involved in organising, promoting or
conducting the contest.
• employees of external auditors who are directly involved in the contest.
Contest specifics
This contest is for each participant to submit a creative photo that shows why they need to downsize their desktop. Entries must be original material created by the participant. Entries that contain content not originally created by the participant (as determined by Intel in their sole discretion) shall be disqualified from the contest. All entries shall not breach any intellectual property rights belonging to any party. You represent and warrant to Intel that (i) you are the sole and exclusive owner of your entry, or you have all right and authority to grant the rights in your entry to Intel, and affiliates and/or its agents and contractors. Entries cannot contain any commercial material, whether in part or in full. Entries that contain commercial content (as determined by Intel in its sole discretion) shall be disqualified from the contest. All recording, transportation, accommodation, personal costs and/or any other costs, fees and/or other expenses that are incurred to participate in this contest and to redeem the prize is the sole responsibility of the respective winner. This contest is in no way sponsored, endorsed or administered by, or associated with Facebook. You understand that you are providing your information to Intel, and not to Facebook. This is a competition of skill and entries will be judged on creative merit and general appeal by Intel. The contest period shall be from Thursday 18th September 2014 after 17.00 AEST
and concludes on Wednesday 1st October 2014 at 17.00 AEST. All entries received outside the contest period will be disqualified. By entering the contest and entering the information/contact details required, you agree that Intel may use the information/contact details that you provide for purposes of administering the contest and to contact the prize winner.

The "Win an Intel NUC contest" promotion is a competition asking users to submit a creative photo that shows why they need to downsize their desktop via Facebook for their chance to win an Intel NUC. Please see above for entry mechanics and below for more information about the prizes.
How prize winners will be selected
• Entries will be judged on creative merit and general appeal by Intel.
• Intel reserves the right to select another prize winner if an original prize winner is subsequently disqualified from the contest or fails to claim a prize by 2 November 2014.
• Participants must have a valid Facebook account to enter.
• Eligibility of participants only extends to those residing in Australia, and who are over 18 years of age.
PrizesThere will be 3 winners selected at the conclusion of the contest period. Each
winner will receive a fully built Intel NUC, (consisting of an Intel Core i3 NUC, 4GB RAM, Intel 180GB SSD, Windows 8.1 Professional O/S, WiFi module, cable, assembly and testing) valued at approximately $799.00AUD*. There is a total of 3 prizes to be won and the total prize pool is approximately $2397.00AUD*.*Based on the retail prices as published on Mwave Australia website at:

How prize winners will be notified
Intel will respond to each winners’ Facebook post with a request to send Intel a private message on Facebook (or via the Facebook Messenger app) notifying Intel of the winner’s physical residential or office address at which the winner will accept delivery of the prize.
Claiming a prize
Prizes will be sent out to the winners’ nominated residential or office address via courier, once confirmed by the winner via private message. Prize winners will be required to provide address details in order to claim prizes.
Intel is not responsible for loss or damage of prizes.
If winner/s do not claim their prize/s within two weeks of the contest end date, their prize will be re-awarded to the next-most deserving winner, judged at Intels’ sole discretion. Any prizes remaining unclaimed by 17:00 AEDT on 30 November 2014 will expire.
Entry forms
Intel is not responsible for printing or typographical errors in any contest-related materials or for registrations, entry forms or submissions that are incomplete, lost or misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including electronic, computer, telephone, paper transfer, mail system, human or other error; including inability to access any website associated with the contest. Proof of online submission shall not constitute proof of receipt by Intel. If any information provided on an entry form is found to be misleading or inaccurate, that entry shall be deemed invalid.
Goods as prizes
Where the prizes under the contest are items/goods, these shall be subject to availability and may not be substituted for cash. Intel reserves the right to vary or offer an alternative prize of equivalent monetary value, without giving any reason or prior notice. If prizes involve manufactured items, these shall be subject to the manufacturer's terms and conditions for warranty, service and maintenance, and Intel does not accept any responsibility for them. In particular, to the maximum extent permitted by law, prizes are provided by Intel "as is" without warranties of any kind, including warranties of merchantability, satisfactory quality, non-infringement of intellectual property, or fitness for any particular purpose, and the user of each prize shall use that prize at its own risk.
Taxes, etc.
Taxes and other levies imposed by any relevant applicable government or tax authority, as well as other costs including insurance and incidental costs, that may be levied or incurred on the prize shall be fully borne by the prize winner(s).
Your submission's fitness for publication
By entering the contest, you expressly agree that your entry ("submission") does not contain any image or content that is unlawful, libelous, slanderous, defamatory, includes children or minors, or invasive of another person's right of privacy or right of publicity, or that Intel may reasonably deem harmful, infringing of other's intellectual property rights, vulgar, obscene, derogatory, sexually inappropriate, pornographic, abusive, harassing, violent, threatening, hateful, objectionable with respect to race, religion, creed, national origin or gender, or otherwise unfit for publication. Intel shall not be liable in any way for any submission. Intel shall have no obligation to monitor your submission, but may do so at its discretion. If, Intel, in their sole and absolute discretion, consider your submission inappropriate or unsuitable for publication, Intel may remove your submission from the contest.
Representations and warranties relating to your entry
You represent and warrant to Intel that (i) you are the sole and exclusive owner of your entry, or you have all right and authority to grant the rights in your entry to Intel, its affiliates and/or its agents and contractors.
Promotional activities
You agree to have your name and photo used for promotional purposes at Intel’s discretion. If you are a prize winner, except where prohibited by law, you consent to the use of your name, photo and/or likeness, biographical information, winning entry, submissions(s) and statements attributed to you (if true) for advertising and promotional purposes without any compensation or notice you.
Intel reserves the right to request winners to provide proof of identity and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter. Failure to comply with this term will disqualify the winner from receiving the prize.
Intel’s rights in your submission:
Intel will not return any of your entries, and your entries become the property of Intel.
You grant to Intel and/or their affiliates a non-exclusive, fully transferable, perpetual, irrevocable, royalty free, fully paid-up right and license:
• to adapt, edit, modify, publish, promote, reproduce, distribute, publicly display your entry and make derivative works based on it in any and all media, including any compilation, as Intel and/or their affiliates see fit for any reason,
• to identify you as the author of the entry, and
• to authorise others to do any of the things described above without any obligation to notify or compensate you.
Without limiting the generality of the provisions above, Intel and/or any of its affiliates shall have an exclusive right to publish and use any winning entry(ies) in print and/or electronic form for advertising and promotion of Intel’s products, for exhibition, and for both commercial and non-commercial products and publications, including without limitation, using, downloading, adapting, reformatting, editing and/or resizing the winning entry(ies) as may be necessary and to authorise others to do any of the above without any obligation to notify or compensate the prize winner(s).
Limitation of liability; indemnity:
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia. To the maximum extent permitted by law and except for any liability that cannot by law be excluded, Intel and their affiliates, related corporations, subsidiaries, directors, officers, employees and agents accept no responsibility and shall have no liability whatsoever for any claim, damage, loss, expense, death or personal injury arising out of or in connection with (a) your participation in the contest, and/or (b) if you are a prize winner, the use of the prize. You undertake to indemnify and keep Intel and their affiliates, related corporations, subsidiaries, directors, officers, employees and agents harmless and indemnified against any loss, damage, claims, costs and expenses which may be incurred or suffered by any or each of them arising out of or in connection with your breach of any of these terms and conditions and/or your participation in the contest.
Intel’s decision is final and binding
All matters and disputes arising out of or in connection with the contest and/or these terms and conditions shall be subject to the sole decision of Intel and Intel's decision shall be final and binding on all parties. No correspondence will be entertained.
Privacy
The information submitted by you during the registration process or otherwise when
participating in the contest include your name, user generated content (picture), and the potential for other personal information (email address and residential mailing address if you are a successful winner) ("personal information"). Except as provided elsewhere in these terms and conditions, your personal information will only be used by Intel in accordance with applicable data protection laws and regulations and Intel’s privacy policy referred to below, for the purposes of administering your participation in the contest. All personal information collected and used will be retained until no later than 30 November 2014 and then permanently deleted. For more details on Intel's privacy policy, please see:

No warranties
Intel and any agents or contractors (if any) that it may use in the execution and management of the contest do not warrant or represent (either directly or indirectly):
• that participation in and/or access to the whole or any part of the contest, contest materials, content, information and/or functions contained in them will be provided on an uninterrupted, timely, secure and error-free basis; or
• that no computer viruses shall be transmitted or that no damage shall occur to your computer system as a result of any online activity of the contest (if any).
Any material downloaded or otherwise obtained through the internet is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data resulting from such download.
Intel does not warrant or make any representations regarding the use, validity, accuracy, or reliability of, or the results of the use of, or otherwise in respect of the materials on the contest site or any sites linked to the contest site.
Intel’s IP rights not affected
Nothing in the contest shall affect any intellectual property rights of Intel in any product or service which may be the subject matter of the contest. No license is granted under this contest to any person under any of Intel’s intellectual property rights, either expressly, by implication, inducement, estoppels or otherwise. Any such license shall always be express and in writing.
No cheating tolerated
You acknowledge and agree that no form of cheating will be tolerated. If you are found cheating, as determined in the sole and absolute discretion of the Intel, you will immediately be disqualified from the contest. Cheating includes, but is not limited to, using multiple Facebook profiles, tampering with, hacking of the contest site (if any), participating in the contest without meeting the eligibility requirements, using any automated software or device to gain an advantage during the contest, use of the contest beyond the defined rules of the contest, attempting to disable or overwhelm any of Intel’s websites or the contest site (if any), attempting to disrupt any portion of the contest, including but not limited to, allowing somebody else to use your personal information, or tampering with the entry process.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. Caution: any attempt to cause malicious damage or interference with the normal functioning of Intel’s website or the information on the website, or to otherwise undermine the legitimate operation of this contest may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, Intel reserves the right to seek damages to the fullest extent permitted by law. If Intel suffers loss or incurs any costs in connection with any breach of these Terms and Conditions of Entry or any other legal obligation by a participant, the participant agrees to identify Intel (as the case may be) for those losses, damages and costs.
No waiver
Intel’s failure to enforce any provision of these terms and conditions shall not constitute a waiver of that or of any other provision.
Modification of these terms and conditions, etc.
Intel may modify these terms and conditions and/or withdraw or terminate the contest at any time without giving any reason or prior notice. In such event, Intel shall have no liability to any party.
If for any reason this contest is not capable of running as planned, including due to infection by computer virus, bugs, technical failures or any other causes beyond the control of Intel, then Intel reserves the right to discontinue the contest where it will corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion. Intel further reserves the right in its sole discretion to disqualify any individual who tampers, engages in fraudulent activity or other unauthorised intervention with the entry process.
Laws
The contest shall be governed by and interpreted in accordance with the laws of New South Wales, Australia. The contest is void where prohibited or restricted by law, and is subject to all applicable laws.
No third party rights
A person who is not a party to this agreement shall not have any rights to enforce any of its terms. For the purposes of this paragraph, "person" shall mean a human being or a corporate entity (whether or not having a separate legal personality), as the case may be.
