4. Only one entry per person will be permitted.
5. The promotion within Australia commences on 24th September 2014 (Australian Eastern Standard time) and closes at 12:00am (midnight) (Australian Eastern Daylight Standard time) on 4th November 2014. For the removal of doubt the promotion will close at the same time and date in the local time of each country participating in the promotion.
The judging will be done by a panel of judges appointed by the Promoters. The judging of the entire competition will take place at the Bauer Media Australia Office at 73 Atherton Road, Oakleigh, Victoria Australia 3166 and will begin on November 11, 2014. The winner will be notified in writing using the contact details given in their entry.
6. For Australian residents: To enter, individuals must go to http://www.motormag.com.au/autotrophy and follow the prompts to the competition page and complete the survey of which you are instructed to do and fill in the entry form including full name, address, current email address, daytime telephone number and answer to the competition question in 25 words or less: “If you could drive your AMG GT anywhere on earth, where would you go, and why?” and submit the entry as instructed.
For overseas residents as outlined in clause 2, must follow the prompts to enter the competition as stipulated in their country.
7. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
8. In Australia: The Entrant warrants to the Bauer Media Pty Ltd that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify Bauer Media Pty Ltd against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
9. In Australia: Bauer Media Pty Ltd is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future Promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. Bauer Media Pty Ltd is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
10. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoters.
11. The Promoters reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoters’ discretion. Failure by the Promoters to enforce any of its rights at any stage does not constitute a waiver of those rights.
12. The best (1) valid entry from all entries received during the entire promotional period as determined by the judges will be deemed the major prize winner and will win: In the event the winner is from Australia:
A Mercedes-AMG GT valued at up to A$360,000. (Price is in Australia dollars is an estimated value only. Price is based on European pricing the car’s value. Value of the prize may vary state to state and upon recommended Australian retail value advised by Mercedes Benz in Australia)
For Australia - The maximum total prize pool is valued at up to $360,000 (in Australian dollars). Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner.
13. Vehicle prize includes 12-months registration and on road costs but excludes comprehensive insurance, petrol, transport and damage from date of delivery. Colour of vehicle is at the sole discretion of the Promoters.
14. Any additional optional extras and accessories, comprehensive insurance and any other insurance, fuel personal costs and any other ancillary costs associated with redeeming the prize are excluded and are the responsibility of the winner. The colour of the prize is at the discretion of the supplying dealer and will be based on availability. Subject to agreement by the supplying dealer, stock availability and subject to the winner agreeing to pay any additional amount requested by the supplying dealer, the winner may choose to include optional extras and accessories. Except as expressly stated in these conditions, the supplying dealer will not provide a substitute model. The supplying dealer will not exchange the prize for cash.
15. It is a condition of accepting the prize that the winner provides the Promoters with their full name, address, license and a copy of their current Australian driver’s license prior to the awarding of the prize winner must have a current valid Australian driver’s license. If the winner is, through any legal incapacity or otherwise, unable to register the vehicle in their own name, then such winner may assign the vehicle prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoters takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoters with certified copies of all required documentation as required by the Promoters before the vehicle is awarded.
16. The winner must provide all information and sign all documentation necessary to enable Promoters to register the prize in the winner's name prior to collection. Receipt of the prize is subject to the winner being able to lawfully take possession of the prize and comply with all registration and compulsory third party insurance requirements of the State/Territory in which the Winner elects to register the prize.
17. The winner must collect their prize from their nearest dealership, as specified by the Promoters, and the prize must be registered prior to collection. The Promoters takes no responsibility for any mechanical, body or paint repairs from the date and time of delivery. Comprehensive insurance, Petrol/ fuel/ diesel costs and any other ongoing costs are the responsibility of the winner
18. If the winner is unable to collect the prize, the winner may incur cost of transporting the prize, if needed, from their nearest dealership to an alternate prize claim point as nominated by the winner and deemed acceptable by the Promoters. Any costs associated with the transport of the prize to an alternate location will be responsibility of the winner.
19. The external and interior colour of the prize is subject to availability at time of redemption of prize. Any number plate details used in the promotional material are representational only.
20. In the event the prize remains unclaimed, an unclaimed prize judging will be held on 11 February 2015 at the same time and place as the original judging in order to distribute any unclaimed prize. The winner will be notified in writing using the contact details given in their entry. Bauer Media Pty Ltd Australian Privacy:
21. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. Bauer Media Pty Ltd will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to Bauer Media Pty Ltd and direct any complaints regarding treatment of their PI according to the Privacy Policy.
In the event the winner is from outside of Australia:
22. The prize is A Mercedes-AMG GT valued at up to 135,000. (Price is in Euros and is an estimated value only. Value of the prize may vary upon recommended retail value in Germany advised by Mercedes Benz Germany).
23. Terms and conditions apply for overseas residents. Entrants must see their own terms and conditions for this promotion in their local country of residents as stipulated in clause 2. In the case of vehicles, the prize will be the stated model with the basic features and previously established extras. The prize does not have to correspond to the illustration. A cash alternative is not possible. The winners will be notified in writing and must confirm receipt of this notification within seven working days otherwise a new winner will be chosen.
General terms:
24. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoters accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
25. In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
26. Prize is subject to the standard terms and conditions of individual prize and service providers.
27. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoters, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
28. In the event that a prize, or part of a prize, is unavailable, the Promoters reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification.
29. The Promoters is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).
30. The Promoters is not responsible nor liable for any prize damaged in transit in the delivery of their prize
31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
32. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoters reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
33. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.
34. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoters. Method of validation (without limitation) will be determined by the Promoters in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoters requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoters. It is a condition of accepting the prize the winner sign any such legal documentation.
35. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
36. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
37. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, the Promoters reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
