TERMS AND CONDITIONS:

1. These Terms and Conditions apply to the Daiso Refer a Friend Competition ("Competition"), conducted by Daiso Industries (Australia) Pty Ltd (ABN 8016 0576 134) of PO BOX 495, Chadstone VIC, 3148 (“Promoter”).
2. Information on how to enter forms part of these Terms and Conditions. Entry into the Competition is deemed acceptance of these Terms and Conditions.
3. Entry into the Competition is only open to Australian residents who are registered members of Facebook, except those ineligible persons described in clause 4.
4. Entry into the Competition is not open to:
employees of the Promoter, their immediate families or those persons living in the same household as such employees; or
affiliated companies, agents, wholesalers or retailers of the Promoter.
Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
 5. The Competition will comprise of the following separate competitions:
competition one commences on 06/10/2014 at 9:00am AEST and concludes on 10/10/2014 at 4:00pm AEST;
competition two commences on 13/10/2014 at 9:00am AEST and concludes on 17/10/2014 at 4:00pm AEST;
competition three commences on 20/10/2014 at 12:00PM AEST and concludes on 24/10/2014 at 4:00pm AEST; and
competition four commences on 27/10/2014 at 12:00PM AEST and concludes on 31/10/2014 at 4:00pm AEST,(each, a "Promotional Period").
 6. To enter, participants must, during a Promotional Period:
 Visit the Daiso Australia Official Facebook Page at https://www.facebook.com/DaisoAustraliaOfficial ("Timeline");
In the comment section of the latest competition post, type a response to our competition post in 25 words or less ("Answer") and;
Tag a friend in the Answer.
 7. Participants under the age of 18 must obtain prior permission of his/her parent or legal guardian to enter the Competition. The parent or legal guardian may be required to verify the granting of consent and/or sign a release at the discretion of the Promoter. Failure of a participant’s parent or legal guardian to verify consent and/or sign a release upon request by the Promoter will invalidate all of the participant’s entries.
 8. Entry into the Competition is limited to one entry per person per Promotional Period.
 9. The Promoter reserves the right, at any time, to verify the validity of entries and participants (including a participant’s identity and address) and to disqualify any participant who:
submits an entry that is not in accordance with these Terms and Conditions;
tampers with the entry process; or
submits an entry that the Promoter, in its sole discretion, deems to be offensive, inappropriate, defamatory or otherwise not in keeping with the spirit of the Competition.
 10. Failure by the Promoter to enforce any of its rights under these Terms and Conditions at any stage does not constitute a waiver of those rights.
 11. All entries and each work submitted as an entry or part of an entry (“Work”) becomes the property of the Promoter. Work(s) will not be returned to any participant. As a condition of entry, each participant grants to the Promoter, its affiliates, and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable and sub-licensable license to use and exploit all intellectual property rights (including without limitation, copyright) in and to the Work and consents to the Promoter doing (or omitting to do) any acts in respect of the Work(s) which may otherwise constitute an infringement of the participant’s moral rights. For the avoidance of doubt, the Promoter may use all or any part of a participant's Work(s) for any purposes at its discretion, including, without limitation, using the participant's Work(s) for promotional, marketing or publicity purposes, whether in respect of this Competition, the Promoter, or otherwise. Each participant warrants that:
all details provided in their entry are true and correct and that the entry is their own original creation and work, and does not infringe the intellectual property rights (including copyrights) of any other person;
They will not submit any entry that the Promoter may deem in breach of intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 13, or otherwise unsuitable for publication;
they will obtain prior consent from any person that is mentioned in their entry to the uses and the terms herein;
they will obtain full prior consent from any person who has jointly created or has any rights in the Work(s) to the uses and the terms herein; and
they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
 12. A breach of the warranties set out in clause 11 will result in the participant's entry being invalid. Without limiting any other terms herein, each participant agrees to indemnify the Promoter in relation to all loss, damage or costs incurred by the Promoter resulting from the participant's breach of any of the warranties set out in clause 11.
 13. The Promoter accepts no responsibility for late, lost or misdirected entries not received by the Promoter or delays in the delivery due to technical disruptions, network congestions or for any other reason.
 14. There will be four prizewinners, one for each Promotional Period. Each of the four prizewinners will win a prize pack consisting of 10 – 11 beauty or personal care products ("Prize") valued between $28.00 and $30.80 in total ("Prize Value"). The Promoter does not guarantee that the Prize will comprise of products identical to those shown in the promotional material for the Competition. If the Promoter is unable to provide the Prize due to no or low stock levels or for any other reason, the Promoter will, except as prohibited by law, provide a substitute prize that it considers in its sole discretion to be of equal value to the Prize. The Prize Value is based on the recommended retail prices at the time of publication of this Competition and is inclusive of GST. The Promoter accepts no responsibility for any change in the Prize Value between the time of publication of this Competition and the date of redemption of the Prize by a prizewinner.
 15. Each valid entry will be individually judged on the basis of the creativity and uniqueness of the Answer. The prizewinner will be the participant who provides the most creative and unique Answer in the opinion and sole discretion of the Promoter’s panel of judges. This is a game of skill and chance plays no part in the determination of the winner. Judging will take place at the conclusion of each Promotional Period, at 4pm AEST on 10/10/2014, 17/10/2013, 24/10/2014 and 31/10/2014 at the Promoter's head office. 
 16. The valid prizewinners will be notified immediately after the judging by having their name published on the Promoter’s Facebook page.
 17. The Promoter’s decision is final and the Promoter will not respond to correspondence from participants about its decision. The Prize is not transferrable or exchangeable and is not redeemable for cash.
 18. If for any reason whatsoever a prizewinner does not claim his/her Prize within 7 days of the announcement of the prizewinner on the Promoter’s Facebook page, then the Prize will be forfeited by the prizewinner for the relevant Promotional Period and cash will not be awarded in lieu. In this case, there will be no prizewinner for that Promotional Period.
 19. If a participant’s contact details change during the Promotional Period, it is the participant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
 20. If the prizewinner is under 18 years of age, the Prize will be awarded to the prizewinner’s parent or legal guardian.
 21. Once a Prize has left the Promoter’s premises, the Promoter takes no responsibility for damage, delay or loss in transit.
 22. Any costs incurred by a participant in submitting an entry or otherwise participating in this Competition is the participant’s sole responsibility. Liability for any tax on any benefits provided to a participant will be the participant’s responsibility.
 23. If this Competition is interfered or tampered with in any way, or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the Promoter, the Promoter reserves the right, it its sole and absolute discretion and to the fullest extent permitted by law, to: (a) disqualify any participant; or (b) modify, suspend, terminate or cancel the Competition, as appropriate.
 24. By accepting the Prize, the prizewinner agrees to participate in and cooperate as required with all reasonable media editorial requests relating to the Prize, including but not limited to, being interviewed, photographed, and/or filmed. The prizewinner grants to the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable and sub-licensable license to use and exploit all intellectual property rights (including without limitation, copyright) in and to any material created pursuant to the prizewinner’s participation in editorial activities and consents to the Promoter, its affiliates and sub-licensees doing (or omitting to do) any acts which may otherwise constitute an infringement of the participant’s moral rights. The prizewinner acknowledges that the Promoter is free to use this material and to exercise its rights in relation thereto, and the prizewinner will not be entitled to any fee for such use.
 25. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorised access to, or alteration of, the Competition. The Promoter is not responsible for any problems or technical malfunction of any telephone, network or lines, computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant’s or another person’s computer related to or resulting from participation in or downloading any material in this Competition.
 26. The Promoter is bound by the Australian Privacy Principles under the Privacy Act 1988. The Promoter may request and collect the participant’s personal information, including name, address and email address, so that the participant can participate in this Competition. If the information requested by the Promoter is not provided, the participant may not participate in this Competition. The Promoter may use the participant's personal information to conduct the Competition and may disclose it to organisations that provide it with administrative services in respect of the Competition, including to Thinktank Social Pty Ltd. The Promoter is unlikely to disclose the participant's personal information overseas. By submitting an entry, the participant consents to the Promoter’s use and disclosure of the participant’s personal information for such purposes and to the Promoter's Privacy Policy available at /privacy/.  All personal information will be stored securely at the office of the Promoter. Participants may request access to, update or correct their personal information held by the Promoter by contacting the Promoter in writing at the address set out in clause 1. Participants may also contact the Promoter in writing if the participant has any privacy concerns or wish to make a privacy complaint. Further information is set out in the Promoter's Privacy Policy available at /privacy/.
 27. This Competition and these Terms and Conditions are governed by and construed in accordance with the laws of the State of Victoria and the Commonwealth of Australia. The participants agree to submit to the exclusive jurisdiction of the courts of the State of Victoria and the Commonwealth of Australia.
 28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which would contravene any statute or cause any part of these Terms and Conditions to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these Terms and Conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of this Competition, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize Value to that stated in these Terms and Conditions; (e) any tax liabilities incurred by a participant or prizewinner; and/or (f) redemption, taking and/or use of a Prize.
 29. The Promoter is in no way sponsored, endorsed or administered by, or associated with, Facebook. Participants acknowledge that they are providing information to the Promoter and not to Facebook. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Facebook. By entering into this Competition, the participants acknowledge that, except for any liability which cannot be excluded by law, Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by a participant, as a result of participating in the Competition (including redemption, taking and/or use of a Prize) and the participants agree to fully release Facebook from any and all such claims that may be asserted against Facebook in connection with this Competition. The information that participants provide to the Promoter will only be used for the purposes as disclosed in these Terms and Conditions and in accordance with the Promoter's Privacy Policy available at /privacy/.

Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Facebook. By entering into this Competition, the participants acknowledge that, except for any liability which cannot be excluded by law, Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by a participant, as a result of participating in the Competition (including redemption, taking and/or use of a Prize) and the participants agree to fully release Facebook from any and all such claims that may be asserted against Facebook in connection with this Competition. 1. These Terms and Conditions apply to the Daiso Refer a Friend Competition ("Competition"), conducted by Daiso Industries (Australia) Pty Ltd (ABN 8016 0576 134) of PO BOX 495, Chadstone VIC, 3148 (“Promoter”).
2. Information on how to enter forms part of these Terms and Conditions. Entry into the Competition is deemed acceptance of these Terms and Conditions.
3. Entry into the Competition is only open to Australian residents who are registered members of Facebook, except those ineligible persons described in clause 4.
4. Entry into the Competition is not open to:
employees of the Promoter, their immediate families or those persons living in the same household as such employees; or
affiliated companies, agents, wholesalers or retailers of the Promoter.
Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
 5. The Competition will comprise of the following separate competitions:
competition one commences on 06/10/2014 at 9:00am AEST and concludes on 10/10/2014 at 4:00pm AEST;
competition two commences on 13/10/2014 at 9:00am AEST and concludes on 17/10/2014 at 4:00pm AEST;
competition three commences on 20/10/2014 at 12:00PM AEST and concludes on 24/10/2014 at 4:00pm AEST; and
competition four commences on 27/10/2014 at 12:00PM AEST and concludes on 31/10/2014 at 4:00pm AEST,(each, a "Promotional Period").
 6. To enter, participants must, during a Promotional Period:
 Visit the Daiso Australia Official Facebook Page at https://www.facebook.com/DaisoAustraliaOfficial ("Timeline");
In the comment section of the latest competition post, type a response to our competition post in 25 words or less ("Answer") and;
Tag a friend in the Answer.
 7. Participants under the age of 18 must obtain prior permission of his/her parent or legal guardian to enter the Competition. The parent or legal guardian may be required to verify the granting of consent and/or sign a release at the discretion of the Promoter. Failure of a participant’s parent or legal guardian to verify consent and/or sign a release upon request by the Promoter will invalidate all of the participant’s entries.
 8. Entry into the Competition is limited to one entry per person per Promotional Period.
 9. The Promoter reserves the right, at any time, to verify the validity of entries and participants (including a participant’s identity and address) and to disqualify any participant who:
submits an entry that is not in accordance with these Terms and Conditions;
tampers with the entry process; or
submits an entry that the Promoter, in its sole discretion, deems to be offensive, inappropriate, defamatory or otherwise not in keeping with the spirit of the Competition.
 10. Failure by the Promoter to enforce any of its rights under these Terms and Conditions at any stage does not constitute a waiver of those rights.
 11. All entries and each work submitted as an entry or part of an entry (“Work”) becomes the property of the Promoter. Work(s) will not be returned to any participant. As a condition of entry, each participant grants to the Promoter, its affiliates, and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable and sub-licensable license to use and exploit all intellectual property rights (including without limitation, copyright) in and to the Work and consents to the Promoter doing (or omitting to do) any acts in respect of the Work(s) which may otherwise constitute an infringement of the participant’s moral rights. For the avoidance of doubt, the Promoter may use all or any part of a participant's Work(s) for any purposes at its discretion, including, without limitation, using the participant's Work(s) for promotional, marketing or publicity purposes, whether in respect of this Competition, the Promoter, or otherwise. Each participant warrants that:
all details provided in their entry are true and correct and that the entry is their own original creation and work, and does not infringe the intellectual property rights (including copyrights) of any other person;
They will not submit any entry that the Promoter may deem in breach of intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 13, or otherwise unsuitable for publication;
they will obtain prior consent from any person that is mentioned in their entry to the uses and the terms herein;
they will obtain full prior consent from any person who has jointly created or has any rights in the Work(s) to the uses and the terms herein; and
they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
 12. A breach of the warranties set out in clause 11 will result in the participant's entry being invalid. Without limiting any other terms herein, each participant agrees to indemnify the Promoter in relation to all loss, damage or costs incurred by the Promoter resulting from the participant's breach of any of the warranties set out in clause 11.
 13. The Promoter accepts no responsibility for late, lost or misdirected entries not received by the Promoter or delays in the delivery due to technical disruptions, network congestions or for any other reason.
 14. There will be four prizewinners, one for each Promotional Period. Each of the four prizewinners will win a prize pack consisting of 10 – 11 beauty or personal care products ("Prize") valued between $28.00 and $30.80 in total ("Prize Value"). The Promoter does not guarantee that the Prize will comprise of products identical to those shown in the promotional material for the Competition. If the Promoter is unable to provide the Prize due to no or low stock levels or for any other reason, the Promoter will, except as prohibited by law, provide a substitute prize that it considers in its sole discretion to be of equal value to the Prize. The Prize Value is based on the recommended retail prices at the time of publication of this Competition and is inclusive of GST. The Promoter accepts no responsibility for any change in the Prize Value between the time of publication of this Competition and the date of redemption of the Prize by a prizewinner.
 15. Each valid entry will be individually judged on the basis of the creativity and uniqueness of the Answer. The prizewinner will be the participant who provides the most creative and unique Answer in the opinion and sole discretion of the Promoter’s panel of judges. This is a game of skill and chance plays no part in the determination of the winner. Judging will take place at the conclusion of each Promotional Period, at 4pm AEST on 10/10/2014, 17/10/2013, 24/10/2014 and 31/10/2014 at the Promoter's head office. 
 16. The valid prizewinners will be notified immediately after the judging by having their name published on the Promoter’s Facebook page.
 17. The Promoter’s decision is final and the Promoter will not respond to correspondence from participants about its decision. The Prize is not transferrable or exchangeable and is not redeemable for cash.
 18. If for any reason whatsoever a prizewinner does not claim his/her Prize within 7 days of the announcement of the prizewinner on the Promoter’s Facebook page, then the Prize will be forfeited by the prizewinner for the relevant Promotional Period and cash will not be awarded in lieu. In this case, there will be no prizewinner for that Promotional Period.
 19. If a participant’s contact details change during the Promotional Period, it is the participant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
 20. If the prizewinner is under 18 years of age, the Prize will be awarded to the prizewinner’s parent or legal guardian.
 21. Once a Prize has left the Promoter’s premises, the Promoter takes no responsibility for damage, delay or loss in transit.
 22. Any costs incurred by a participant in submitting an entry or otherwise participating in this Competition is the participant’s sole responsibility. Liability for any tax on any benefits provided to a participant will be the participant’s responsibility.
 23. If this Competition is interfered or tampered with in any way, or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the Promoter, the Promoter reserves the right, it its sole and absolute discretion and to the fullest extent permitted by law, to: (a) disqualify any participant; or (b) modify, suspend, terminate or cancel the Competition, as appropriate.
 24. By accepting the Prize, the prizewinner agrees to participate in and cooperate as required with all reasonable media editorial requests relating to the Prize, including but not limited to, being interviewed, photographed, and/or filmed. The prizewinner grants to the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable and sub-licensable license to use and exploit all intellectual property rights (including without limitation, copyright) in and to any material created pursuant to the prizewinner’s participation in editorial activities and consents to the Promoter, its affiliates and sub-licensees doing (or omitting to do) any acts which may otherwise constitute an infringement of the participant’s moral rights. The prizewinner acknowledges that the Promoter is free to use this material and to exercise its rights in relation thereto, and the prizewinner will not be entitled to any fee for such use.
 25. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorised access to, or alteration of, the Competition. The Promoter is not responsible for any problems or technical malfunction of any telephone, network or lines, computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant’s or another person’s computer related to or resulting from participation in or downloading any material in this Competition.
 26. The Promoter is bound by the Australian Privacy Principles under the Privacy Act 1988. The Promoter may request and collect the participant’s personal information, including name, address and email address, so that the participant can participate in this Competition. If the information requested by the Promoter is not provided, the participant may not participate in this Competition. The Promoter may use the participant's personal information to conduct the Competition and may disclose it to organisations that provide it with administrative services in respect of the Competition, including to Thinktank Social Pty Ltd. The Promoter is unlikely to disclose the participant's personal information overseas. By submitting an entry, the participant consents to the Promoter’s use and disclosure of the participant’s personal information for such purposes and to the Promoter's Privacy Policy available at /privacy/.  All personal information will be stored securely at the office of the Promoter. Participants may request access to, update or correct their personal information held by the Promoter by contacting the Promoter in writing at the address set out in clause 1. Participants may also contact the Promoter in writing if the participant has any privacy concerns or wish to make a privacy complaint. Further information is set out in the Promoter's Privacy Policy available at /privacy/.
 27. This Competition and these Terms and Conditions are governed by and construed in accordance with the laws of the State of Victoria and the Commonwealth of Australia. The participants agree to submit to the exclusive jurisdiction of the courts of the State of Victoria and the Commonwealth of Australia.
 28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which would contravene any statute or cause any part of these Terms and Conditions to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these Terms and Conditions all conditions, warranties and terms implied by statute, general law or custom.
