The promoter is Cellarmaster Wines Pty Ltd Level 2, 26 Waterloo Street, Surry Hills NSW 2010 ABN 95 076 727 949, Licence No. 51205679 (“Promoter”).
The promotion is subject to these Terms and Conditions. Any additional information is available by visiting cellarmasters.com.au/tassiecomp or cellarmasters.com.au/tascomp, or on the promotional email by the Promoter.
Participation in this promotion shall be deemed acceptance of these Terms and Conditions.
This promotion runs from 12:00am AEDT on Monday 17 November 2014 and closes 11:59PM AEDT Sunday 4 January 2015 (“Promotion Period”). The winner will be notified via telephone and email on Wednesday 7 January 2015. The winner’s name will also be published in The Australian Newspaper on Wednesday 21 January 2015.
The winner will be drawn at random from valid entries at Level 2, 26 Waterloo Street, Surry Hills NSW 2010 at 11:00am AEDT Tuesday 6 January 2015. There will be one prize draw and one winner.
All entries remain the property of the Promoter and may be entered into a database and used for future promotional, marketing and publicity purposes including email contact.
If the winner of the draw cannot be contacted within 100 days, is unable to satisfy these terms and conditions or forfeits or does not claim their prize within 100 days, then the Promoter will conduct a second chance draw at 11am AEST Tuesday 21 April 2015 at Level 2, 26 Waterloo Street, Surry Hills NSW 2010. The second chance winner will be notified by email on Wednesday 22 April 2015 and also published in The Australian Newspaper on Wednesday, 6 May 2015.
The winner’s prize is outlined in paragraph 9 below.



PRIZE DETAILS

9.1 Two return economy airfares from the winner’s nearest capital city to Hobart (inclusive of airline taxes)
9.2 Two nights accommodation at Zero Davey (Luxury Water View Studio, breakfast included, plus wine and cheese platter on arrival)
9.3 Car hire for two days (pick up and drop off at Hobart airport)
9.4 A wine tour of Riversdale Estate (on the Saturday of the weekend the prize is taken)
9.5 Total prize value: $2000 including GST (estimated prices dependant on departure city and travel dates)
9.6 Travel date exclusions:
9.6.1 Winner must travel before 30 November 2015.
9.6.2 The winner cannot choose to travel between:
9.6.2.1 1 – 6 October 2015
9.6.2.2 4 – 9 June 2015
9.6.2.3 2 – 8 April 2015
9.6.2.3 5 – 10 March 2015
9.6.3 If the winner cannot travel within the appropriate dates then they forfeit their prize and no compensation will be paid in lieu.

The prize winner has three calendar weeks from the day of notification by the Promoter they have been selected as the winner to advise the Promoter representative of the dates they would like to travel. The Promoter representative will be the representative who contacts the winner to notify them of their win.
The prize value is the recommended retail value as provided by the supplier and is correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the prize occurring between mailing date and date the prize is claimed. Prize values are in Australian dollars.
It is a condition of accepting the prize that the prize winner must comply with these Terms and Conditions and the prize supplier’s directions or requirements.
The prize is not transferable or redeemable for cash. The prize or any element of the prize cannot be exchanged for any other prize or prizes. The contents of the prize will be at the Promoter’s sole discretion. The prize is subject to availability and the terms and conditions of the entities supplying the prize.
If the prize chosen by the winner or any element thereof is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to Tasmanian Gaming Commission.
The prize cannot be used in conjunction with any Frequent Flyer Programme. Frequent Flyer points will not be provided.
Only one (1) prize will be awarded.
The Promoter makes no warranties or representations about the fitness for purpose or suitability of any element of the prize and will not accept responsibility for the quality or fitness for any purpose of the prize, or the failure of the prize to be of merchantable quality.


Entry into the promotion is open to all Australian residents over the age of 18 years, except for Northern Territory residents and employees of the Promoter, its agents and its affiliates associated with this promotion and their immediate families (“Eligible Entrants”).
To enter this Cellarmasters “Win a Weekend for Two in Tasmania” promotion, Eligible Entrant’ must purchase one or more “$69 + delivery Christmas Dozens” from this promotional emails (“Eligible Purchase”) during the Promotion Period. For every Eligible Purchase made, the customer receives one (1) entry into the promotion.
Entrants can receive multiple entries by making multiple Eligible Purchases. Customers will also receive one entry if they purchase the bonus buy “$95.88 + delivery Pelican Point Reserve Shiraz 2014” which is only available once a “$69 + delivery Christmas Dozen” is purchased from this promotional emails. Eligible entrants can order cases from Cellarmasters in one of the following ways:

Orders must be paid in full with no split payments, during the Promotion Period.

Entries that are incomplete or are not completed in accordance with these Terms and Conditions will not be accepted. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence), and to disqualify any entrant who tampers with the entry process. The Promoter is not responsible for entries that are not received, or are received late, by the Promoter.



TRAVEL



It is a condition of accepting the prize is that the prize winner and guest may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
The prize winner and guest are responsible for ensuring that they are able to travel to Hobart, Tasmania in taking the prize. As a condition of entry, the prize winner and their guest must not be subject to any restrictions on their rights to travel to and from Hobart, Tasmania.
The prize winner and their guest must travel at the same time and depart from the same capital city and are responsible for transport from their respective residence to the airport at their nearest capital city for the flights (Sydney, Melbourne, Brisbane, Adelaide, Perth or Canberra).
It is the sole responsibility of the prize winner and their guest to ensure that their personal travel documentation is valid. Any fines, penalties, payments and expenditure incurred as a result of not meeting such requirements are the sole responsibility of the prize winner and their guest. Travel insurance is advisable for the prize winner and their guest to protect against the additional costs incurred in the event of unforeseen circumstances, however, such arrangements and costs are the sole responsibility of the prize winner and their guest.
Airfare tickets are available on the regular scheduled services of the airline. Flight itineraries may have to be adjusted depending on the airline’s departure city and their current flight schedule. Frequent Flyer points are not available.
A credit card imprint or cash deposit may be required from the prize winner at check in to the hotel for any incidental charges, not included in the prize.



GENERAL



The prize winner is advised that tax implications may arise as a result of accepting the prize and he/she should seek independent financial advice prior to acceptance of the prize.
It is a condition of accepting the prize that the prize winner and guest may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
The Promoter and their associated agencies, make no representation as to the safety, conditions or other issues that may exist at the destination.
The Promoter is not responsible for any cancellation, postponement, delay or rescheduling of transport, or any other unforeseeable circumstances which may prevent the Prize winner from taking the prize (in whole or in part) and any costs incurred as a result including, without limitation, any ancillary accommodation costs will be the sole responsibility of the prize winner.
The Promoter reserves the right to refuse to allow the prize winner and his/her guest to take part in any or all aspects of the prize, if the Promoter determines, in its absolute discretion, that a prize winner or guest are not in the mental or physical condition necessary to be able safely to participate in the prize.
The prize must be taken as stated and are not exchangeable or redeemable for cash. The prize cannot be transferred to any other person, unless agreed to in writing by the Promoter.
The Promoter encourages responsible drinking. Legal-aged consumers should be advised to consider safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines ­ up to 6 standard drinks on any one day, no more than 3 days a week for males and up to 4 standard drinks on any one day, no more than 3 days a week for females.

Where any aspect of the Promotion is affected by sabotage, theft, fraud or mistake, or an entry does not comply with these Terms and Conditions, the Promoter may in its absolute discretion declare that a person is or is not an Eligible Entrant and elect not to award or cancel the prize.
To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including indirect or consequential loss) suffered or for personal injury which is suffered or sustained in connection with the conduct of the Promotion or from participation in the Promotion or redemption of the prize. The prize may have terms and conditions of use (for example, it may expire after a certain period of time) and the winner is responsible for complying with those terms.
Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the competition and all entries of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the entrant to produce within the requested time appropriate photo identification or other documentation (to the Promoter’s satisfaction, in its sole discretion) in order to confirm the entrant’s identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the entrant in entering the competition, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter or an entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that entrant will be ineligible and deemed invalid.
The Promoter reserves the right to waive any conditions set out herein and if the law permits. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
In the case of a force majeure event (war, strike, act of God) and if the law permits, the Promoter may in its absolute discretion modify, cancel or suspend the promotion, subject to written directions from Tasmanian regulatory bodies.
The Terms and Conditions within may be amended and edited during the Promotion Period without notice to the entrants.
