Terms and Conditions

1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.Entry is only open to residents of Australia with a valid email address. Employees and their immediate families of the Promoter and its agencies and companies associated with this competition are ineligible. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3.If an entrant is under 18 years of age, they must obtain their parent’s or guardian’s approval prior to entering the promotion. If a winner is under 18 years of age the prize will be awarded to the winner’s parent or guardian on their behalf.

4.Promotion commences at 12.01am AEST on 15/12/2014 and closes at 11.59pm AEST on 13/03/2015 (“Promotional Period”).

5. To be eligible to enter, individuals must purchase any specially marked Rip, Bite & Win Drumstick product including individual Drumstick ice-cream cone (RRP $3.80) and Drumstick Multi Pack 4 or 6 (RRP $7.99) during the Promotional Period (“Promotional Product”).

6. To enter, purchase any Promotion Product from a participating store (“Eligible Purchase”). Each Promotional Product will contain an 8 character unique code (“Entry Code”). The Entry Code is located either under the sleeve of a single cone or on the inside of the multi-pack 4 or 6 box

7. To enter, individuals must set up a Drumstick Collector Account and input Entry code.

8. To set up a Drumstick Collector Account, the individual must visit www.drumstick.com.au during the Promotional Period and follow the prompts to the promotion entry page, input all of the requested details (including but not limited to their first, last name & title, a valid email address, their State/Territory of residence and date of birth) to set up a Drumstick Collector account.

9. Once a Drumstick Collector Account has been established, entrants can input the Entry Codes (from all Eligible Purchases) and ‘bank ‘the codes throughout the Promotional Period. Each entry code may only be banked once.

10. When entrants have accrued enough Entry Codes, they can select the redeem option on the website to ‘cash out’ for any of the following prizes during the promotional period.

Ticketmaster eGift Cards
Once entrants have chosen to redeem their ‘banked’ entry codes for a $25 Ticketmaster eGift Card, one (1) $25 Ticketmaster eGift Card will be emailed to the entrant’s nominated email address.

Ticketmaster eGift Cards are redeemable at participating Ticketmaster outlets located within Australia, online at www.ticketmaster.com.au, or by telephoning 136 100.

Unless otherwise stated the Ticketmaster eGift Card must be used by the 10/04/2015 or will be forfeited.

A limit of two (2) Ticketmaster eGift cards per household (people living at the same address) applies during the promotional period.

Questions or problems relating to Ticketmaster eGift Cards should be directed to 136 100 between the hours of 9.00am and 5.00pm on Monday to Friday, by writing to Customer Services at Ticketmaster, GPO Box 762, Melbourne VIC 3001, Australia or by e–mailing via the website at www.ticketmaster.com.au/h/help. Ticketmaster eGift cards are not refundable or redeemable for cash. Use of all Ticketmaster eGift Cards are subject to the full terms and conditions set out at www.ticketmaster.com.au/h/giftcards_tc.html

2 for 1 Movie Voucher (eVouchers)
If entrants have selected to redeem their ‘banked’ Entry codes to ‘cash out’ for a 2 for 1 Movie Voucher offer, they will be required to go to drumsticktickets.com.au and enter their Credit card details where prompted and pay $20.50 (comprising a $1 booking fee per ticket issued and $19.50 single ticket cost)during the promotional period to take advantage of the 2 for 1 Movie Voucher offer.

Two (2) single adult Movie Vouchers will then be issued digitally (as e-tickets) to the email address nominated by the entrant. “Movie Voucher” refers to a pre-paid voucher, issued digitally and valid for 6 months from the date of issue, which entitles the holder to redeem a Movie Ticket from participating cinemas (either in person or online) for standard (2D) movie sessions, subject to availability, except that the voucher cannot redeemed:

a.   for any movie session after 5.00pm on a Saturday;
b.   for Gold Class, or special or group screenings;
c.   for movie marathons or special events; or
d.   in conjunction with any other offer or discount.

Entrants will be required to nominate, at the time of submitting the online claim form to claim the 2 for 1 Movie Offer, the cinema company (Village Cinemas, Greater Union, Birch Carroll & Coyle, or Event Cinemas) at which the entrant wishes to redeem the Movie Voucher for Movie Tickets. After selecting these options, the entrant will only be able to redeem the Movie Voucher for Movie Tickets consistent with such selections. Entrants will not be able to amend their selections after submitting the online claim form to claim the 2 for 1 Movie Offer. Once a valid claim has been made customers will receive a unique code which, to redeem they can:

Each Movie Voucher must be used by the date specified on the Movie voucher. There will be no refunds or replacements for misplaced, unused or expired Movie Vouchers, nor extensions to the expiry date of any eVoucher. eVouchers are not refundable or redeemable for cash – change will not be given for any unused portion of the value of an eVoucher. Use of all Movie Vouchers and Movie tickets are subject to the terms and conditions of the cinema company which issued the Movie Voucher and Movie ticket, including the cinema company’s right to enforce film classification requirements. 11. Each Entry Code must be ‘banked’ and ‘cashed out’ for a prize no later than 11.59pm AEST 13/03/2015. Requests to ‘bank’ an Entry Code and/or ‘cash out’ a prize received after 11.59pm AEST on 13/03/2015 will not be accepted and shall be automatically forfeited.after 27/02/2015 will not be accepted and shall be automatically forfeited.

12.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence and/or employment) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

13.Incomplete or indecipherable entries will be deemed invalid.

14. Entries and requests to ‘bank’ and Entry code and/or ‘cash out’ prize are deemed to be received at the time of receipt into the Promoter's database, not time of transmission by the entrant.

15. If a prize (or part of a prize) is unavailable for any reason, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

16. The Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

17. There are 5 300 000 participating products with available winning codes for this promotion.

18. The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of a prize.

19. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

20. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

21.The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

22. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, network failure, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to direction from regulatory authorities, including cancelling, terminating, modifying or suspending the Promotion.

23. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry process in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.

24. The:

a) Promoter, the Promoter's related entities, the Participating distributors and all agencies associated with the Promotion; and
b) the employees, agents, directors and contractors, of all entities referred to in this paragraph,

shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of a prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).

25. Entrants will be required to review and accept Terms & Conditions on redemption of prize. By ticking agree to terms & condition, for the avoidance of doubt, each winner acknowledges and agrees that he/she will have no right to call upon the Promoter to deliver up all or any part of the prize and the Promoter will have no obligation to deliver all or any part of the prize to the winner, unless and until the winner signs such documentation. This condition is for the benefit of the Promoter and may be waived by the Promoter at any time.

26. All entries become the sole property of the Promoter.

27. All personal information entrants provide (“Personal Information”) will be collected by the Promoter’s contractor, Edge Loyalty Systems PTY LTD of Level 1, 500 Chapel Street South Yarra VIC 3141 on behalf of the Promoter and used by the Promoter for the purpose of administering this promotion.

28. The Promoter may use and hold the entrants personal information and disclose the entrant’s personal information to the Promoter’s related entities, it’s contractors and agents, the Participating stores, Ticketmaster Australasia PTY LTD and their related entities, Participating Cinemas and all agencies associated with the promotion, for the purpose of conducting this Promotion or communicating with entrants.

29. Personal information may otherwise be used, held or disclosed in accordance with the Peters privacy Policy which can be accessed by visiting www.drumstick.com.au/privacy or as permitted by applicable laws in Australia. If the entrant chooses not to provide their personal information, they may not be able to enter the promotion and/or redeem any prizes.

30. By entering the promotion entrants consent to the storage of their personal information on the Promoter’s database and the use by the Promoter, its related entities, contractors and agents of this Personal information, for future promotional and marketing purposes regarding the Promoter’s products including by contacting the entrant via electronic messaging at the email address provided by the entrant, which messages will contain a functional unsubscribe facility to opt out. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth). Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.

31. Should an entrant's contact details change during the Promotional Period, it is the entrant's responsibility to notify the Promoter using the “Contact Us” form on the online entry site.
