Terms and Conditions


1.Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

2.This is a game of skill and chance plays no part in determining the winners.

3.Entry is open to residents of Australia aged between 5 and 12 years old. However, employees and their immediate families of the Promoter are not eligible to enter.

4.The competition commences on Friday 6 March, 2015 at 17:30 (AEDT) and concludes on Friday 24 April, 2015 at 17:00 (AEST).

5.The competition will be advertised on Digital advertisements, the Discovery Kids website and on the Discovery Channel.

6.The promotion is open to two (2) age categories, 5 to 8 years old and 9 to 12 years old. To enter, participants must:

a.go to www.dkids.com.au/wild-but-true/competition (the “WEBSITE”); and

b.select the category which corresponds to their age; and

c.follow the on-screen ‘Wild But True colour & win!” instructions to choose and complete the digital colouring-in picture; and

d.follow the on-screen instructions to provide;

i.For the 5 to 8 age group: a ‘fun fact’ about jellyfish

ii.For the 9 to 12 age group: a ‘fun fact’ about Kangaroo; and


e.complete the entry form with all the details required, including (but not limited to) full name and email address. Mandatory details will be indicated on the entry form.

7.Entrants must obtain the prior permission of a parent or guardian over the age of 18 to enter.

8.Entrants in the competition may enter as many times as they like.

9.Illegible, incomprehensible and incomplete entries will be deemed invalid.

10.Any entry that is made on behalf of an Entrant by a third party will be invalid.

11.The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is strictly prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using a Repeat Entry Device, the Promoter may disqualify that entrant without notice. To ensure fairness, the Promoter may undertake automatic and/or manual audits of entries and may deem entries ineligible if it is reasonably believed that they are frivolous, incomprehensible, incomplete, or otherwise not genuine.

12.Entries must be received be 17:00 (AEDT) on Friday 24 April, 2015. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason

13.The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

14.The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner’s entry is of a type described in this clause.

15.Two (2) Winners (one from each age category) will each receive a family trip to Australia Zoo, 1638 Steve Irwin Way, Beerwah QLD 4519, including;

i.Return economy flights for two (2) adults and two (2) children to Sunshine Coast Airport

ii.Two (2) nights’ accommodation in a minimum 3 star accommodation for two (2) adults and two (2) children

iii.One (1) family day-pass to Australia Zoo

16.Total Major Prize pool is valued up to $10,000.00 (including GST).

17.The Winners and their companions are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

18.The winners and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Adelaide or Perth). If the winner is from Tasmania, ACT or NT connecting flights from these cities to the nearest flight departure capital city will be included in the prize package for the winner and travelling companions). If the winners reside in Queensland then the flight component of the prize will not be included and the winner and their travelling companion will responsible for making their way to and from hotel.

19.The winner must be accompanied by an adult in the participation of the prize.

20.The prize must be taken by Saturday 30 January, 2016 and is subject to hotel and flight availability. The prize is not available during peak times such as public holidays and school holidays (if applicable) and cannot be changed once the booking has been made.

21.Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.

22.A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.

23.Prizes cannot be transferred, exchanged or re deemed for cash.

24.It is a condition of accepting the Prize that the Winner must comply with all the conditions associated with use of the Prize and the Prize supplier’s requirements. It is each Prize winner’s responsibility to first check with the Prize supplier in respect of any such conditions of use.

25.If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.

26.Unless expressly stated in these terms and conditions all other expenses become the responsibility of the Winner.

27.The Promoter reserves the right to refuse to allow a Winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a Winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

28.Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

29.By accepting the Prize, the Winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

30.In the event that for any reason whatsoever a Winner does not take an element of the prize at the time stipulated by the Promoter then that element of the Prize will be forfeited by the Winner and cash will not be awarded in lieu of that element of the Prize.

31.Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

32.Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

33.If the competition winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian.

34.Each entry must be an original work and must not infringe the copyright or any other rights of any third party. Each entrant warrants that:

a.each entry is their own original work and is not copied in any manner from any other works;

b.he/she owns all rights and interest in the entry submitted and have obtained all express consent from all persons whose face appear in the photo or photos submitted to enter the entry for this Competition in accordance with these Terms & Conditions;

c.he/she has the full power and capacity to grant the rights and consents set out in these Terms and Conditions; and

d.he/she will fully indemnify the Promoter against any loss or damages suffered by the Promoter in the event any of the warranties set out in this clause are false.

35.Entrants will retain ownership of copyright in their entry; however, as a condition of entry, each entrant:

a.agrees that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and videos) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter in any media for its promotional purposes, without compensation to the entrants; for this purpose, each entrant grants to the Promoter a non-exclusive, perpetual, worldwide, transferable and royalty-free licence in any such written answers, photographs /images and videos; and

b.consents to any act or omission by the Promoter which may infringe any of the entrant’s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant’s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.

36.Two (2) Winners will be judged from all valid entries received during the Promotional Period. The judging panel consisting of the Discovery Kids representatives will judge all the valid entries on their originality and creativity. The judging will take place at Discovery Networks Asia-Pacific, Level 1, 19 Harris St, Pyrmont, NSW 2000 from Monday 27 April, 2015 at 13:00 (AEDT). The Winners will be the Entrants who, in the sole opinion of the judges, have submitted the entries which best meet the judging criteria.

37.The Winners will be announced on Friday 15 May, 2015 at 15:00 (AEDT) and will be notified in writing within 2 working days of the announcement date.

38.All reasonable attempts will be made to contact the Winners. If a prize remains unclaimed or unallocated or forfeited for any reason, by 13:00 (AEST) on Monday 27 July, 2015 the prize will be re-allocated to the entrant who has submitted the next entry which best meets the judging criteria in this particular category excluding the entrant who has failed to claim their prize. The winner(s) of the unclaimed, prize judging will be notified in writing within 2 working day of this judging.

39.Prizes will be awarded to person named in the entry.

40.Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

41.The Promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.

42.It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

43.In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.

44.Entrants enter the Competition at their sole risk. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

45.The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

46.The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

47.If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.

48.All entries become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s Privacy Policy. By entering the Competition, the Prize Winner agrees to the use of their name, image, and photographs submitted to the Promoter without compensation, and agree that the Promoter may request further photographs or organise a shoot at the Promoter’s sole expense in order to secure a required photograph promoting the Wild But True Colouring-In Competition.

49.The entrant consents to the Discovery Networks Asia Pacific, to collect their personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying the winner and prize fulfilment). The entrant’s personal information may be disclosed to third party service providers for this purpose. Their personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter. If the entrant is not willing for this to occur the entrant cannot participate in the promotion.

50.The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and by entering the Competition, the entrant is taken to consent to Discovery Networks Asia Pacific’s Privacy Policy which contains information, amongst other things, about how the entrant may access personal information that is held by Discovery Networks Asia Pacific about them and seek correction of such information. See http://corporate.discovery.com/privacy-policy/ to view Discovery Networks Asia Pacific’s APP Privacy Policy in full. The Promoter’s APP Privacy Policy also contains information about how the entrant may complain about a breach of the APPs, or a registered code that is binding on the Promoter’s organisation and how [company name] will deal with such complaints. Discovery Networks Asia Pacific generally does not give an entrant’s personal information to anyone outside Australia.

51.The Promoter is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). If you are not willing for this to occur you cannot participate in the Promotion.
