GAME OF SKILL: Terms and Conditions
1. Information on how to enter and prizes form part of these conditions of entry. Entry into this competition is
deemed acceptance of these conditions of entry. Only entries which are submitted and comply with these
conditions of entry may take part in this competition. These Terms and Conditions must be read together with
the terms provided on the Promotion entry page. In the event of any conflict, the terms on the entry page
supersede any conflicting terms in these Terms and Conditions.
2. The Promotion is a game of skill. The Promoter is Studiocanal Pty Ltd (ABN 64 096 774 015), Level 50, 680
George Street, Sydney NSW 2000.
3. To enter the Promotion, entrants must provide their name, address, email and answer the skill question on the
entry page http://wayf-au.tumblr.com/competition
4. Competition starts on 12:01am on 06/08/2015 (AEST) and ends at 11:59pm (AEST) on 27/08/2015.
5. The time of entry will in each case be the time the online entry is received by the Promoter’s database. The
Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions or for any
other reason.
6. To enter, entrants must during the promotional period dates specified above complete all the required fields on the
website including their full name, email address, postal address and in 25 words or less let us know "Tell us in 25
words or less what song would be the soundtrack to your life and why?" and then click on the submit/enter button
where entries will be sent to online@studiocanal.com.au. All entries must be legible and the original work of the
entrant. Each entry will be judged by an independent panel of judges at the Promoter’s premises within 5 days of
the promotion’s closing date.
7. The Promoter will, at its discretion, select the best answer/s based upon originality, creativity, and
adherence to the word limit. Chance plays no part in determining the winner. The Promoter’s decision is
final and no correspondence will be entered into.
8. Each entry must be the entrant’s original work. By entering the promotion, entrants consent to the
Promoter making copies of the whole or any part of their entry and otherwise exploiting the entry to
publicise the Promotion or for any other purposes and undertake to the Promoter that their entry is not, and its
use by the Promoter will not be, in breach of any third party intellectual property rights.
9. Entries that in the Promoter’s opinion are offensive, defamatory or otherwise inappropriate or that
infringe any third party rights will be invalid.
10. Should any prize be unclaimed 5 business days after winner notification, a new winner or winners will be
selected, in accordance with the above procedure.
11. Entry is limited to one per person. Any additional entries citing the same email address will be
disqualified. Employees of the Promoter, their partners, agents and suppliers associated with the Promotion
and their immediate families are not eligible to enter. Incomplete, indecipherable or illegible entries will be
deemed invalid.
12. Entry into the Promotion is free. However, any costs associated with accessing the entry page are the
responsibility of the person seeking access and are dependent on the internet service provider used.
13. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an
entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in
accordance with these Terms and Conditions or with the terms on the entry page or who tampers with the entry
process.
14. Prizes are not transferable or exchangeable and cannot be taken as cash. Winner(s) cannot
change, vary, subst itute or extend any element of the prize (in whole or in part).
15. There will be one major prize which includes 1x Fuj ifilm Instax Mini 8 in WHITE $99.00 RRP , 1x
We Are Your Friends T-Shirt $49.95 RRP, 1x We Are Your Friends Power Bank $19.95 RRP and 1x In season double
pass to We are Your Friends $40 RRP, total prize value $208.90. There will be 10 runner up prizes
include a We Are Your Friends T-Shirt $49.95 RRP and a We Are Your Friends Power Bank $19.95 RRP, total prize
value $69.90
16. The prize winner will be notified by email within 5 days of the judge’s decision or draw as
applicable. Names of prize winners will be published on the Promoter’s website. http://wayfau.
tumblr.com/competition within five business days of judging.
17. To claim their prize, prize winners may be required to provide supporting identification. If the winner,
for any reason, does not take any element of the prize at the time stipulated by the Promoter, then
the winner forfeits the prize, with no compensation or further liability of the Promoter.
18. All entries become the property of the Promoter. Entrants consent to the Promoter and prize suppliers using
the entrant's name, likeness, image and/or voice in the event they are the winner (including photograph, film
and/or recording of the same) in any media for an unlimited period without remuneration for the
purpose of promoting the Promotion (including any outcome), and promoting any products or services
manufactured, distributed and/or supplied by the Promoter or prize suppliers associated with the Promotion.
19. If the Promotion is interfered with in any way or is not capable of being conducted as anticipated due to any
reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to
the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel
the Promotion. The Promoter reserves the right to substitute a prize with a prize of equal or greater value if a
prize is for some reason unavailable.
20. The details contained in your entry are protected by security safeguards as detailed in the Promoter’s privacy
policy. Entrants’ personal information is collected to enable identification of the winners. Your personal
information will only be disclosed to the Promoter and its related bodies corporate for these purposes. Your
personal information will only be disclosed to any third party to the extent necessary to fulfil a prize and for no
other reason without your consent.
21. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to
notify the Promoter. A request to access or modify any personal information should be directed to the
Promoter.
26. Prize values are based upon the recommended retail prices at the opening date of the Promotion
(inclusive of GST). The Promoter accepts no responsibility for changes in prize value between then and the prize
redemption date.
27. Winners should seek independent financial advice as tax implications may arise from accepting a prize.
28. Prizes are not transferable, exchangeable or redeemable for cash. If for any reason the winner does not take
the prize or an element of the prize by the time stipulated by the Promoter, then the prize or t hat element of
the prize will be forfeited. Without limiting the foregoing, the Promoter may, at its absolute discretion,
substitute cash for any prize (the amount of cash being equal to the prize value).
29. In order to participate in the Promotion and/or the activities which may be awarded as part of the prize, the
winner (and their companion/s, as applicable) must comply with any applicable height, weight, health, fitness,
skill, and any other requirements normally associated with the particular activity. It is the entrant’s responsibility
to ensure that they (and their companion/s, as applicable) are sufficiently healthy and fit so as to safely
participate in the Promotion and/or undertake the activities awarded as part of the prize. The Promoter and
applicable prize supplier/s reserve the right to disallow the winner and/or their companion to take part in any or
all aspects of the Prize, if the Promoter or supplier determines, in its absolute discretion, that the winner and/or
their companion is not in the mental or physical condition necessary to safely participate in the Promotion or
prize.
30. If the Promotion is communicated about or administered on Facebook® it is in no way sponsored,
endorsed or administered by, or associated with, Facebook®. Entrant information is provided to the Promoter
and not to Facebook®. Each entrant completely releases Facebook® from any liability in connection with this
Promotion.
31. Entrants acknowledge that the prizes may be subject to additional terms and conditions imposed by third
parties. The winner must become acquainted with any such additional terms and conditions prior to taking
the prize.
32. The Promoter, its partners, agents and suppliers make no representations or warranties as to the quality
suitability or merchantability of any goods or services offered as prizes. To the extent permitted by law, the
Promoter, its partners, agents and suppliers are not liable for any loss or damage suffered to person or property
by reason of any act or omission, deliberate or negligent, by the Promoter or its partners, agents or suppliers or
its or their employees, in connection with the supply of goods and services to the prize winner/s and, where
applicable, to any persons accompanying the prize winner/s. This clause does not affect any rights a
consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by
law, any liability of the Promoter, its partners, agents and suppliers for breach of any such rights is limited to the
payment of the costs of having the prize supplied again.
33. If for any reason this competition is not capable of running as planned, including due to infection by computer
virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control
of the promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this
competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with
the entry process.
34. In the case of the intervention of any outside agent or event which changes the result or prevents or hinders it's
determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil
unrest, strikes; the promoter may in its discretion cancel the event and recommence it from the start on the same
conditions subject to any government regulation.
35. All entries become the property of the promoter ("we/us") on receipt and we reserve the right to use any personal
information provided by an entrant ("you") to enter you in the competition and conduct the competition. If you do
not provide us with all or part of the personal information requested we may not be able to enter you into the
competition
36. By entering into the competition each entrant consents to the promoter sending that entrant commercial
electronic messages (such as email and SMS) in relation to this competition. If an entrant wants to stop receiving
these messages they need only reply to any received message and include in that reply the word "unsubscribe"
