Terms and Conditions             




1.   Information  on  how  to  enter  forms  part  of  the  terms  of  entry.  Entry  into  the competition is deemed acceptance of these terms and conditions.

 

1.   The Promotion is a game of  skill,  and chance plays no part  in determining the winners.

 

2.   Entry is open to all residents of Australia who are 18 years of age or over. However, employees and their immediate families of Fairfax Media, Salmat Digital Pty Limited, Roadshow Films Pty  Ltd,  and their  associated agencies and companies are not eligible to enter.

 

3.   The competition commences on Wednesday 14 October 2015 at 09:00am (AEDT) and concludes on Friday 30 October 2015 at 11:59pm (AEDT).



 

4. The competition will be advertised on Goodfood.com.au, Facebook.com/GoodFoodAu, The Sydney Morning Herald, The Age.

 

5.   To enter, participants must either:

 

   a.   Visit www.goodfood.com.au/burnt; and

 

    b.   register  their  details including  (but  not  limited  to)  name,  address,  phone number, e-mail address; and

 

   c.   Answer in 25 words or less: “In 25 words or less tell us about the best meal you have ever eaten”? ; and

 

   d.   Agree  to  become  a  Fairfax  member  and  start  receiving  “GoodFood Newsletter” as well as communications from Village Roadshow and Good Food Gift Cards.

 

6.   Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.

 

7.   Illegible, incomprehensible and incomplete entries will be deemed invalid.

 

8.   Entrants in the competition may only enter once.

 

9.   The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

 

10. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.



11. Entries must be received by 11:59pm (AEDT) on Wednesday 30 October 2015 The time of entry will in each case be the online entry is received by the Salmat Digital Pty Limited database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.

 

12. Any entry that is made on behalf of an Entrant by a third party will be invalid.

 

13. The cost of accessing the promotional website will be dependent on the entrant’s

individual Internet Service Provider.

 

14. There will be one (1) Major prize winner and ten (10) Minor prize winners.

 

15. The major prize winner will receive a trip to London, England for two (2) adults, including:*

 
•Return economy flight for the winner and their companion from either the nearest capital city  in Australia (nearest to the Winner’s place of residence) to London, valued up to $5,800.00

 
• Return airport/hotel private transfers, valued up to $280.00

 
•Five (5) night’s hotel accommodation at The Langham Hotel, in a twin share room for two (2) people, valued up to $3,200

 
• One (1)  dinner for  two (2)  people  at  The Langham  Hotel, valued up to

$200.00

 
•One (1) lunch for two (2) people at Michelin restaurant of choice in London, valued up to $420.00

 
• One (1) Borough Market Food Tour in London, valued up to $390.00

 
• Spending Money, valued up to $1,000.00

 
• Travel insurance for winner and their companion, valued up to $400.00

 

* Travel must be completed within 6 months of the closing date of the competition’. Prize must not to be taken over UK or Australian Public or National holidays or between 12 December 2015 and 12 January 2016.

 

16. The total value of the Major Prize is up to $11,690.00 (inclusive of GST).

 

 

17. Each Minor Prize consists of:

 
• One (1) Good Food Card, valued up to $100.00
• One (1)  double pass to see Burnt movie, valued up to $40.00

 

The total minor prize value is $1,400.00 (inclusive of GST).

 

18. Total Prize Pool value is = $13,090.00 (inclusive of GST).

 

19. Prizes cannot be transferred and cannot be redeemed for cash.

 

20. For  the  minor  prizes,  Before  dining  visit  goodfoodgiftcard.com.au  to  activate, check/record  expiry  and view participating  restaurants  (these  do  not  necessarily match all restaurants featured in the Good Food Guides). Redeem card for food and drinks. Card expires 12 months from date of issue and cannot be extended. Lost or

21. Unless expressly stated, all costs and expenses associated with taking the Major Prize and the Minor prize are the responsibility of the Major Prize and the Minor Prize Winners, including:

 
• Spending money, except as specified in clause 15;
• Meals and drinks, except as specified in clause 15;

 
•Transport to/from an airport departure or return point, except as specified in clause 15
• Activities except as specified in clause 15; •Taxes (excluding departure and any other flight associated taxes included within the prize),
•Energy  surcharges,  gratuities,  services  charges,  passports,  visas,  travel insurance and all other ancillary costs.


 

22. The winner and travelling companion must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest flight departure capital city airport for flight departure ().

 

 

23. If the winner/s is under the age of 18 as at the date of the judging date, a parent or legal guardian adult must accompany the minor in the participation of the prize.

 

24. The prize must be taken by 10:00 on Saturday 30 April 2016 and is subject to hotel and flight availability at time of booking. The prize cannot be changed once the booking has been made. Any alterations to confirmed flights and/or accommodation and/or  scheduling  arrangements will  be  at  the  expense  of  the  winner  and  their travelling companion.

 

25. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule.  Frequent Flyer points are not available from any airline.

 

26. Flights are economy class and may be indirect. The airline’s Conditions of Carriage apply to all flights.

 

27. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.

 

28. It   is   the   traveller’s   personal   responsibility   to   ensure   that   they   have   valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any  fines,  penalties,  payments  or  expenditures  incurred  as  a  result  of  such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers.

 

29. Fairfax Media, Salmat Digital, and the prize supplier make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.

 

30. FOR ALCOHOL PRIZES: Legal aged consumers should be advised to consider the safe drinking levels recommended in the National Health and Medical  Research Council Australian Alcohol Guidelines that are available at:

31. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.

 

32. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.

 

33. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.  It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

 

34. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

 

35. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

 

36. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.

 

37. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Fairfax Media  or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.

 

38. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

 

39. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

 

40. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

 

41. If the competition winner is under 18 years of age, the prize may be awarded to the

winner’s parent or legal guardian in the Promoter’s discretion.

 

42. Winners will be judged from all entries received throughout the promotional period and one (1) Major prize winner and ten (10) minor prize winners will be selected by a judging panel at Fairfax Media 1 Darling Island, Pyrmont, Sydney, NSW 2009 at

12:00pm on November 5th, 2015. The Major Prize Winner will be the Entrant who, in the sole opinion of the judges, has submitted the most creative and original 25 words or less answer to the question in point 5c) and the Minor Prize Winners will be the next 10 best entries as selected by the judging panel. The Prize Winners will be notified by telephone and in writing within 2 days of the Prize Determination Date.



43. The judge’s decision is final and the promoter will not enter into correspondence

regarding the Competition result

 

44. Prizes will be awarded to person named in the entry. However, in a dispute, the prize will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).

 

45. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

 

 

46. All reasonable attempts will be made to contact the Winners. If a prize remains unclaimed  by  a  winner  or  unallocated  or  forfeited  for  any  reason,  by  9am  on November  12th,  2015  ,  the  prizes  will  be  re-allocated  to  the  entrant  that  has submitted the entry which best meets the judging criteria excluding the entrant that has failed to claim the prize.  This Unclaimed Prize Determination will take place at Fairfax Media at Fairfax Media 1 Darling Island, Pyrmont, Sydney, NSW 2009 at 9am on November 13th 2015.  The winner/s of the Unclaimed Prize Determination will be notified  by  telephone  and  in  writing  within  2  days  of  the  Unclaimed  Prize Determination.

 

47. FOR EVENT BASED PRIZES: The Prize must be taken by 10:00 on Saturday 30

April 2016. If a winner and travelling companion are, for whatever reason, unable to travel before and on a nominated date, or do not take an element of the prize within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof

 

48. It is a condition of  accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

 

49. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

 

50. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions

 

51. The Promoter and the prize supplier shall not be liable for any loss or  damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter and the prize supplier are  not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may  occur  in  the  course  of  the  administration  of  this competition  including  any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

 

52. The Promoter reserves the right in its sole discretion to disqualify any individual who the  Promoter  has  reason  to  believe  has  breached  any  of  these  conditions,  or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

 

53. Fairfax  Media,  Salmat  Digital  Pty  Limited  and  their  associated  agencies  and


companies and the prize supplier assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

 

54. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect  the  administration,  security,  fairness or  integrity  or  proper  conduct  of  this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition

 

55. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.

 

56. AUTOMATIC OPT-IN: By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment  or  other  compensation  to  the  entrant,  including  sending  the  entrant electronic messages.

 

57. The Promoter, is collecting the entrant's personal  information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Salmat Digital Pty Limited for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.

 

58. The  Promoter  will  not  share  your  personal  information  with  other  organisations unless:

 

a)   You give us your express consent, or

b)   Sharing is otherwise required or permitted by law, or

c)   This is necessary on a temporary basis to enable our contractors to perform specific functions.

 

59. Entrants’  personal  information  may  be  disclosed  to  State  and  Territory  lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.
