Terms and Conditions:

By entering the Mornings Inside Out competition (“the Competition”), you are agreeing to the following terms and conditions:
1) Information on how to enter forms part of these Terms and Conditions. Entry into this Competition is deemed acceptance of these Terms and Conditions of entry.
WHO CAN ENTER?
2) The Competition is open to residents of Australia, except employees of the Promoter and their immediate families and all companies and agencies associated with this Competition (“Entrants”). Entrants under 18 must seek parent or legal guardian consent to enter the Competition and provide personal information about themselves.
HOW TO ENTER
3) The Competition commences on Tuesday 10th November 2015 at 09:00 AEDT and concludes on Friday 20th November 2015 at 16:00 AEDT (“the Competition Period”).
4) To enter Entrants must, during the Competition Period, go to www.9jumpin.com.au/show/mornings/ and answer in 50 words or less to the Competition question ‘what is their most awkward childhood memory and why?’ Entrants must fill out the entry form provided along with their full name, residential address, daytime contact number and email to the Promoter in order for their entry to be valid.
IN ADDITION the entry must not be, without limitation:
a) late;
b) delayed;
c) incomplete;
d) incomprehensible;
e) unlawful;
f) obscene;
g) defamatory;
h) discriminatory;
i) libellous;
j) threatening;
k) pornographic;
l) harassing;
m) hateful;
n) raciallyorethnicallyoffensive;
o) capableofencouragingofconductthatwouldbeconsideredacriminaloffence;
p) capable of violating any law;
q) capable of giving rise to civil liability.
5) Entries must be received by the Promoter within the Competition Period.
6) All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the Entrant.
7) Multiple entries permitted, subject to the following: each entry must be submitted separately and in accordance with entry requirements and must be substantially unique.
8. entry details remain the property of the Promoter and will not be returned to the Entrant. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use, distribute, broadcast and sub-licence their entries in all media worldwide and acknowledge that they will not be entitled to any fee for such use.
9) The Promoter reserves the right to verify the validity of entries at any time during or after the Competition Period, and reserves the right to disqualify any Entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
10) The Promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. Entrants should not send in original copies of their entries. No responsibility will be taken by the Promoter in the event that the original entry is lost or damaged in editing.
PRIZES
11) There will be one (1) prize awarded to the Entrant whose entry is judged to be the winning major entry. The winner will receive the prize package detailed below for up to two (2) adults one of whom must be at least 18 years of age and up to two (2) children under sixteen (16) years of age:

MINOR PRIZE
Ten Runners-up will receive One (1) Inside out on DVD valued at $39.95
12) Prize pool valued at up to $20,634.50 (includes major and minor prize pool)
13) Package is based on two (2) adults, one of whom must be at least 18 years of age and two (2) children. Children under sixteen (16) years of age.
14) Winners must be in possession of a valid 5-year passport and must have a minimum of 90 days validity for the duration of the prize holiday. All entry visas, ESTA forms, and/or travel documents are the sole responsibility of the winner including visa costs if applicable. DJP Marketing & Promotions Ltd does not arrange entry visas.
15) No purchase is necessary to enter this competition.
16) Prize winner will receive confirmation that they have won a prize via e-mail and by phone (providing a contact number has been provided) within three days of the competition being finished.
17) Personal Information about prize winners will be shared with initiator of prize and their agents to the extent necessary for prizes to be delivered to the prize winners.
18) Winners must provide a copy of their passports to ensure names are spelled correctly and validity of their passports.
19) Winners must give at least 60 days' notice prior to their requested departure date.
20) All prizes are non-transferable. No cash alternative is available for any prize. In the unlikely event that a prize should become unavailable (due to force majeure or prize not being suitable for the winners, etc) DJP Marketing & Promotions Ltd reserves the right to substitute a prize which it may determine as being of equal value.
21) The holidays are subject to availability and blackout dates will apply unless specifically pre-arranged prior to the competition being run. Blackout dates include peak Christmas, Easter and summer holidays
22) The winners must go within 12 months of winning their holiday. Winners will be requested to provide three separate dates of preferred travel and DJP Marketing & Promotions Ltd. Will work towards fulfilling at least one of winner's preferred dates of travel. Winners who do not travel within 12 months will become null and void and no longer entitled to their grand prize.
23) Unless otherwise stated in the package, all other costs including meals and spending money are the responsibility of Winner.
24) Once confirmed in writing, travel dates and names of those traveling are not changeable without incurring extra fees.
25) Winners must sign a legal indemnity form provided by DJP Marketing & Promotions Ltd. prior to departure as standard procedure.
26) Tickets are non-transferable (ie: no name changes allowed). Any alterations to confirmed flights and/or accommodation details will be at the expense of the winner. Once the prize has been
arranged, any changes to the travel, flights, accommodation or scheduling arrangements are the expense of the winner and their travelling companion(s) (if any).
27) Prizes are subject to individual prize supplier terms and conditions (including but not limited to those of the Sponsor).
28) Flights are economy class and may be indirect. The airline’s Conditions of Carriage apply to all flights. The winner and their travelling companion(s) must travel at the same time and depart from and return to the same airport, and are responsible for transport from their residence to the winner’s nearest capital city airport in Australia. The winner and their travelling companion(s) (if any) will be responsible for making their own way to and from their departing Australian airport. These conditions apply for all flights.
29) Winner and their travelling companion(s) (if any) must be eligible to apply for ESTA Visas.
30) Airline flight route and dates of travel are subject to the prize supplier’s absolute and final decision.
31) The prize values are stated in Australian dollars and are correct as at the date of commencement of the Competition Period. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.
32) The prize is a single event trip for the winner and their travelling companion(s) (if any) and cannot be separated into separate trips or components. The winner and their traveling companion(s) (if any) must travel together. All flights for each route must be utilized at the same time, for the same travel dates, to and from the same destination. The air tickets are available on regular scheduled services of each airline and subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airline’s departure city and their current flight schedule. All travel is subject to availability at all times. The winner and their travelling companion(s) (if any) are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed. Travel suppliers/airlines and booking time of flights to be chosen at prize supplier’s discretion. Blackout periods may apply. Frequent flyer points are not available from any airline.
33) It is a condition of accepting the prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay.
34) It is the responsibility of the winner and their travelling companion(s) (if any) to ensure they are checked in for their flights, and arrive at the airport, on the correct date and at the time specified by the relevant airline carrier. The Promoter is not responsible for any costs associated with the winner and/or their travelling companion(s) (if any) missing any of their flights.
35) Unless specified otherwise, the winner and their travelling companion(s) (if any) are responsible for all expenses including, without limitation, transport to and from departure point including but not limited to additional domestic airfares if required, any meals or beverages, any extra sightseeing or activities, any additional accommodation, any additional transfers, any additional insurance, personal spending money, and all other ancillary costs, as well as obtaining any of these. Prize also excludes medical expenses, items of a personal nature, alcoholic beverages, optional tours not outlined, laundry, telephone calls, additional nights, room or flight upgrades, incidentals, energy surcharges, gratuities, service charges, in-room charges or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner and their travelling companion(s) (if any). Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the prize winning domestic airfares provided by the Promoter.
36) It is a condition of accepting the prize that the winner and their travelling companion(s) (if any) must comply with all the conditions of use of the prize and the prize supplier’s requirements (as applicable, including but not limited to those of the Sponsor).
37) The winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
JUDGING
38) Each valid entry received during the Competition Period will be submitted for judging by a panel of judges appointed by the Promoter. Judging will take place at the Promoter’s premises on Monday 23rd November 2015 09:00 AEDT. The one (1) Entrant whose entry is judged to be the most creative and original out of all valid entries received will be deemed the winner and awarded the prize. The Competition is a game of skill and chance plays no part in determining the winner.
39) The prize winner will be notified by telephone and in writing using the contact details given in their entry by Tuesday 24th November 2015.
40) The judges’ decision in relation to any aspect of the Competition will be final and no correspondence will be entered into regarding the result. The Promoter may in its absolute discretion deem entries invalid subsequently to the winner being notified or the winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these Terms and Conditions. In such circumstances, an additional judging will be conducted.
41) The Promoter’s decisions in relation to all aspects of this Competition are final and binding on all who enter and no correspondence will be entered into.
SPECIAL CONDITIONS OF ENTRY
42) All entries must be:
a) the original independent creation of the Entrant;
b) owned by the Entrant; and
c) free of any claims, including copyright or trade mark claims by other parties.
43) If an Entrant’s entry is selected as the winning entry, validation of the Entrant’s circumstances/ the validity of their entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be the winner, the winner will be notified as per these Terms and Conditions. In the event that the Promoter requests the Entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter.
44) The Promoter and any prize supplier (including but not limited to the Sponsor) reserves the right to request the winner and each of their travelling companion(s) (if any) to provide proof of age and identity. Identification considered suitable for verification is at the discretion of the Promoter and the prize supplier (including but not limited to the Sponsor).
45) If for any reason this Competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Competition.
LIABILITY AND RELEASE
46) Except for any liability that cannot be excluded by law, the Promoter, the Sponsor and each of their related entities (including theirs officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or Sponsor; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or an Entrant; (f) participation in the Competition and/or (g) redemption of the prize by the winner and their travelling companion(s) (if any).
47) The Promoter, the Sponsor and each of their related entities (including theirs officers, employees and agents) will take no responsibility for defective prizes or prizes damaged or lost in transit, or late, lost or misdirected mail.
PERSONAL INFORMATION
48) Entry details remain the property of the Promoter. Entrants’ personal information will be collected by the Promoter for the purpose of conducting and promoting this Competition (including for the purpose of identifying and notifying the winner). Without limiting the foregoing, the Promoter may disclose Entrants’ personal information to other parties assisting in the administration of the Competition including to the Promoter’s related entities, prize suppliers, external service providers and authorities that regulate this Competition. If the Entrant consents, the Promoter, its related entities and business partners (as applicable) may also use the Entrant’s personal information for the purpose of sending direct marketing messages with respect to programs, products and services available through any or all of them. Nine will collect, use and handle the Entrants’ personal information in accordance with Nine’s Collection Statement and Privacy Policy Entrants may request access to or correction of their personal information by writing to: Privacy Officer, Nine Network Australia Pty Ltd, Legal Department, PO Box 27, Willoughby NSW 2068 or emailing privacy@nine.com.au.

49) The Promoter is Nine Network Australia Pty Limited (ABN 88 008 685 407) of 24 Artarmon Rd, Willoughby, NSW 2068. The Promoter can be contacted in relation to the Competition by mail to this address or by telephone to (02) 9906 9999.
50) The Sponsor is Carat Australia (ABN: 86 081 878 640) of 105 York street, South Melbourne 3205.
51) The Promoter may amend these Terms and Conditions in its absolute discretion.
