Conditions of entry

Entry Restrictions Open only to Australian residents who: (a)are aged 18 or over; (b)hold a valid and current driver’s licence from any State or Territory within Australia;and(c)are able to take the prize in February 2016 on specific dates to be advised by the Promoter. Directors, officers,management and employees(and the immediate families of directors, officers, management and employees)of the Promoter, or of the agencies or companies associated with this competition are ineligible to enter. Competition Period 12:01am (AEST) on 20/06/15 to 11:59pm (AEDT) on 30/11/15. Entry Method During the Competition Period, entrants must: (a)visithttp://capementellecoasthouse.com.au (Website); and (b)fully complete and submit the online entry form, including by providingtheir full name, address, age, gender and any additional information as required by the Promoter. Draw Details 10am(AEDT) on 02/12/15at Tribe Marketing, 1 Kent Street, The Rocks, Sydney NSW 2000(Tribe Marketing). Winner Determination The first valid entry randomly drawn from all valid entries received during the Competition Period will win the prize. Prize Details There is 1 prize to be won. The prize is a 2 night getaway in Margaret River, WA for the winner and 1 companion (who must be aged 18 or over) on dates to be advised by the Promoter in February 2016valued at up to $4,999(inc GST) depending on the winner’s point of departure.See paragraph 6 for full prize details and conditions. Prize PoolThe total prize pool is valued at up to $4,999(inc GST). Entry Limits Limit of 1 entry per person. Winner Notification and Publication The winner will be notified by phone and in writing within two days of the draw and their name and state/territory of residence will be published on the Website on 02/12/15 for a period of 28 days. Prize Claim Date and Time The prize must be claimed by 11.59pm (AEDT) on 17/01/16. Unclaimed Prize Draw Details10am(AEDT) on 18/01/16 at the same location as the original draw. Unclaimed Prize Draw Winner Notification and Publication Any winner in the Unclaimed Prize Draw will be notified by phone and in writing within two days of the Unclaimed Prize Draw and their name and state/territory of residence will be published on the Website on 18/01/16for a period of 28 days.
1 Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions. 2 The competition will be conducted during the Competition Period. 3 Entries must be received during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses or aliases may be disqualified. Automatically generated entries may be disqualified. 4 The Promoter is not liable for late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, correspondence or claims for prizes due to error, omission, tampering, theft, destruction or otherwise. 5 The draw will be conducted at the time, on the dateand at the locationas stated in the Draw Details. 6 The prize isas stated in the Prize Details and consistsof the following for thewinner and their companion: (a) return transfers between the winner’s place of residence and their closest Australian capital city airport (maximum distance for transfers is 100km); (b) return economy airfares (including airfare taxes) from the winner’s nearest Australian capital city to Perth, WA (flights are not included if the winner resides in WA)and, in such case, the winner and their companion are responsible for making their own way to the hire or other location in Perth nominated by the Promoter; (c) car hire or other transport arrangements for transfer between Perth, WA and Margaret River (as determined by the Promoter, depending on the prize supplier(s) conditions); (d) 2 nights accommodation at the ‘CoastHouse’ property, including selected meal hampers (contents as determined by the Promoter), a 750ml bottle of Cape Mentelle wine on arrival, an on-site3 course gourmet dinner experience with a private chef and a 1 hour on-site massage; (e) a gourmet breakfast at the White Elephant Cafe, Gnarabup Beach to the combined value of $100 (inc GST); (f) a 1 hour private guided walk to Cape Mentelle; (g) a 2 hour private Cape Mentelle winery tour including return transfers between the Coast House property and Cape Mentelle winery; and (h) a dinner and movie screeningexperienceat Cape Mentelle winery. Flights, activities and accommodation are subject to booking and availability. The prize must be taken on dates to be advised by the Promoter in February 2016. The Promoter is not liable if thewinner is unable to take the prize on the dates advised, for anyreason. All other costs associated with the prize, including but not limited to any additional transfer costs, additional meals, additional taxes, insurance and other ancillary costs are the responsibility of thewinner and his/her companion, as incurred. The winner and their companion must depart and return at the same time. The prize is subject to any additional terms and conditions specified by the prize supplier(s). 7 In the event that the value of the breakfast at White Elephant Cafe offered as part of the prize is less than the amount specified by the Promoter, the balance will be forfeited and no cash will be supplied in lieu. Any costs incurred over the specified amount for the breakfast are not the responsibility of the Promoter and must be borne by the winner and their companion, as incurred. 8 With respect to the car hire component of the prize, the prize winner (or their companion) must be aged 25 years or over and must have a current Australian driver’s licence. The car hire is also subject to any terms and conditions specified by the car hire provider. If these requirements are not met, the car hire component of the prize will be forfeited by the prize winner and no cash or alternative prize will be provided in lieu. 9 The winner will be notified in accordance with the Winner Notification and Publication section of these conditions. By entering this competition, each entrant requests that his or her full address not be published and that for the purposes of applicable South Australian regulations, their name and address not be published at all (except to the extent as may be required under the laws of other states/territories). 10 The winner(and their companion)must, at the Promoter’s request, participate in all promotional activity (such as publicity, photographyand filming) surrounding the winning oftheprize, free of charge, and they consent to the Promoter using their names, imagesand footage in promotional materialand advertisements. 11 In order to participate in the activities awarded as part of the prize, the winner and their companion must comply with applicable height, weight, health and fitness requirements and any other requirements normally associated with the relevant activities. It is the winner’s responsibility to ensure that they and their companion are sufficiently healthy and fit so as to safely take the trip and undertake the activities awarded as part ofthe prize. The Promoter reserves the right to deem that the winner and their companion are not sufficiently healthy or fit. The winner and their companion must comply with all requirements and directions of the people responsible for the conduct of the relevant activities. The winner and their companion may be required to sign an indemnity and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this competition and/or providing the prize prior to undertaking the activities included in the prize. If the winner or their nominated companion does not sign the form provided by the Promoter within the time requested by the Promoter, the winner’s entry or claim will be deemed invalid. 12 The Promoter may require the winner to provide proof of identity, proof of age and proof of residency. Identification consideredsuitable for verification is at the Promoter’s discretion. 13 If a winning entry is deemed not to comply with these conditions of entry including if thewinner is unable to take the prize on dates to be agreed with the Promoter in February2016, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraph5. 14 The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person (including without limitation the winner or their companion) who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate. Thewinner is fully responsible for the acts and omissions of their companion and the Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, the winner and their companion if their companion breaches these conditions, whether or not legally bound by them. 15 The Promoter may in its absolute discretion cancel the prize or otherwise cease to provide any benefit of the prize to thewinner (and their companion) if the winner (or their companion), in the opinion of the Promoter, is under the influence of alcohol or any other
