Terms and Conditions of Entry
1. Terms and Conditions: Information on how to enter and prizes form part of the Terms and Conditions of Entry.
Participation in the Win a Car Promotion (“Promotion”) is deemed acceptance of these Terms and Conditions of Entry.
2. Promotion Period: Entry into the Promotion commences from 9am on 1 December 2015 and closes at 1.59pm on 14
February 2016 (“Promotion Period”).
3. Entry: Customers can obtain an Entry into the Promotion by:
a) Becoming a Race In Rewards Member at a Participating Venue during the Promotion Period (maximum of one entry per
person for this entry method), or
b) Providing and adding details of an email address to their own existing or new Race In Rewards Member Profile
(maximum of one entry per person for this entry method), or
c) Providing and adding details of a mobile phone number to their own existing or new Race In Rewards Member Profile
(maximum of one entry per person for this entry method), or
d) Being a valid Race in Rewards Member and presenting a valid Member Card when spending $5 or more on food or
beverage (in one transaction) in a Participating Venue during the Promotion Period (maximum of one entry per
transaction).
Bonus Entries may also be earnt by swiping a valid Race in Rewards Member Card at a kiosk located at a Participating
Venue during the Promotion Period and participating in the Win A Car game available on the kiosk, in accordance with the
instructions on the kiosk. Please refer to the kiosk for additional terms and conditions for this entry method. Entries will
be awarded randomly as part of this entry method, as generated by the kiosk software application, and there is a maximum
of one entry per day per card permitted for this entry method. Should the Win a Car game not be functional on the kiosk
at a given time, this method of entry will not be available at that time.
When a Customer receives an Entry Form, they must fully and legibly complete their details on the Entry Form and place it
in the Entry Box or Barrel at the Participating Venue during the Promotion Period. Entry into the Promotion is subject to
the availability of Entry Forms at the Venue. Participating Venues are The Beach Hotel, located at 97 Beaconsfield Pde.,
Albert Park; Moe Racing Club, located at Waterloo Rd., Moe; and Bairnsdale Sporting and Convention Centre, located at .
117 Omeo Hwy., Bairnsdale. Entries may also be distributed at the Promoter’s discretion to customers attending a
Participating Venue during the Promotion Period. Entry Forms are available whilst stocks last.
4. Eligibility: Entry is open to Australian residents aged 18 years or over. Playing a gaming machine, or participating in a
loyalty scheme that requires either expenditure on gaming machine play, or agreement to receive gaming machine
advertising, does not enable you, or contribute to your qualification, to enter or participate in this Promotion. Entry is not
open to employees or Committee Members of the Venue, the Promoter or agencies associated with this Promotion. Entry
is subject to customers meeting the conditions of venue entry at the Participating Venue.
5. Draws and Car Giveaway Event:
Draws: A Draw will take place at each Participating Venue at 2pm on each of the following dates: Sunday 6December
2015, Sunday 13 December 2015, Sunday 20 December 2015, Sunday 27 December 2015, Sunday 3 January 2016, Sunday
10 January 2016, Sunday 17 January 2016, Sunday 24 January 2016, Sunday 31 January 2016, Sunday 7 February 2016 and
Sunday 14 February 2016.
Each Draw will comprise entries received during the Promotion Period by the Participating Venue where the Draw is taking
place. Once an Entry Form is drawn as a Winner, that Entry Form will not be placed back into the Entry Barrel for future
Draws. The first valid entry drawn in each Draw will be deemed the Winner. The Winner will receive an Invitation for
themselves and a Guest to attend the Event*, valued at $200.
Car Giveaway Event: The Winner of each Draw will be invited (the “Invitee”) to attend the Car Giveaway Event, which will
be held at the Moe Racing Club, located at Waterloo Rd., Moe at 1pm on 21 February 2016. The Event will include a lunch
meal (as provided) and deluxe drinks package at the function Event. Each Invitee may bring a Guest to the Event, however
this Guest may not participate in the “Car Giveaway Competition”. Should the Invitee wish to nominate a proxy to
participate on their behalf in the Car Giveaway Competition, they may nominate either their Guest or a Moe Racing Club
staff member (if wishing to nominate Moe Racing Club staff member, this must be requested in writing at least 24 hours
prior to the Car Giveaway Event).
The Invitee (or their proxy) must be ready to take their turn to participate when requested at the Car Giveaway
Competition – failure to do so will result in the Invitee forfeiting their chance to participate in the Car Giveaway Promotion.
Invitees will be asked to participate in the Car Giveaway Event barrel draw in the date order in which they were drawn as
Winners at each Participating Venue, with the Winner from the respective date’s Draw at The Beach Hotel going first, the
Winner from the Draw at Moe Racing Club going second and the Winner from the Draw at Bairnsdale Sporting and
Convention Centre going third. In this order, each Invitee (or their proxy) will be asked to randomly select a number from a
barrel. This number will indicate the order in which the Invitees (or their proxy) will select a Promotional Key. A
Promotional Car and 33 Promotional Keys will be available at the Car Giveaway Competition. Each Winner (or their proxy)
will be invited to participate and to select one Key from the Promotional Keys made available, then use that key to try and
open the Promotional Car. One of the 33 keys will open the Promotional Car. The Winner whose Promotional Key opens
the Promotional Car will be deemed the Major Prize Winner.
The Major Prize is a MY15 Holden Cruze Equipe 1.8 litre petrol automatic sedan, valued at $22,090 inc GST. On road costs
(including dealer delivery, registration and stamp duty) valued at $3504 are also included, for a total prize value of $25,594.
A First Service at 1500km and One Year Roadside Assistance are also included in the Major Prize.
Timing, preparation of Promotional Keys and Promotional Cars, and conduct and management of the Car Giveaway
Competition and Event, will be undertaken by a representative of Moe Racing Club. This representative’s decision on all
matters is final and no correspondence will be entered into.
If a Winner cannot be contacted prior to the Car Giveaway Event, they will forfeit their chance to a) attend the Car
Giveaway Event and b) participate in the Car Giveaway Competition. A Winner who does not attend the Car Giveaway
Event at the time specified forfeits their chance to participate in the Car Giveaway Competition. Additional rules for the
conduct of the Car Giveaway Event may be made available to Invitees at the Event.
*Refer to Clause 7 for terms and conditions of the prizes.
6. Total Value of the Promotion: The total value of all prizes in the Promotion is $32,194.
7. Prize Terms and Conditions: Prizes are not transferable or exchangeable. Prizes are not redeemable for cash. In the event
that for any reason a Winner or Major Prize Winner doesn’t take an element of the prize in the time stipulated, then that
element of the prize will be forfeited. The Promoter reserves the right to substitute any prize for a similar product of equal
or greater value should the Prize be unavailable for any reason at the time of the Draw, Event or prize distribution. For
Winners of Invitations to the Car Giveaway Event, transport to the Event and all other costs and charges associated with
attending the Event are the responsibility of the Winner. For the Major Prize, insurance, petrol, options and all other
ancillary costs are the responsibility of the Prize Winner. Images used in promotional collateral and advertising are used in
good faith and for advertising purposes only; the Major Prize may differ in appearance.
8. Notification & Delivery: The Winners will be notified by phone and in writing. The Major Prize Winner will be notified in
writing and their details will be published at
www.moeracingclub.com.au. The Major Prize Winner must collect their Prize
from the Venue at a mutually agreed convenient time between the Venue and the Major Prize Winner, within 28 days of
the Car Giveaway Event.
9. Valid Entry Forms: Entry Forms are void if stolen, forged, mutilated, photocopied or tampered with in any way. Printing
error/s and other quality control matters relating to the production of the Entry Forms will not invalidate an otherwise
valid prize claim. Only original Entry Forms will be accepted and they must fulfil all the requirements of the Promoter’s
verification tests and procedures. Incomplete, indecipherable or illegible entries will be deemed invalid. The Promoter
reserves the right, at any time, to verify the validity of claims/entries and claimants (including the entrant’s age, identity,
place of residence and employer) and to disqualify any entrant who submits a claim/entry that is not in accordance with
these Terms and Conditions of Entry, or any entrant who tampers with the entry or claims process or who may benefit
from such tampering. No responsibility is accepted for any late, lost or misdirected entries or prize claims. Any entry or
prize claim not complying with these Terms and Conditions of Entry will be deemed invalid.
10.No Waiver: Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. Promoter’s Decision is Final: In the event that there is a dispute concerning the conduct of the Promotion, Event or the
awarding of a prize, the decision of the Promoter is final and no correspondence will be entered into.
12. Cancellation/Delay/Modification: If, for any reason, any part of the Promotion is not capable of running as planned
(including issues caused by technical glitches, programming or software errors) the Promoter reserves the right to cancel,
terminate, delay, relocate, modify or suspend any or all elements of the Promotion, subject to written direction from any
regulatory authority.
13. Force Majeure: The Promoter will not be responsible for any act, omission, failure or delay by the Promoter which is due to
an act of God, riots, terrorism, storms, fire, labour or industrial dispute, strike or any other acts which are not reasonably
within the control of the Promoter.
14. Substitution of Prizes: Subject to any written direction from the VCGLR, the Promoter reserves the right to cancel or
change the prizes offered under the Promotion due to circumstances beyond the Promoter’s reasonable control, or if there
are any changes to the law that would or might render the Promotion, or any prizes offered under the promotion,
unlawful.
15. Privacy: Personal information contained on the Entry Forms will be used for the purpose of determining and/or contacting
a Prize Winner and will be disclosed to third parties, including but not limited to the Venue, the Promoter, agents,
contractors, prize suppliers and Australian regulatory authorities, and may also be used otherwise as authorised by such
customers (for example, if a customer has consented to receive marketing materials). Entry is conditional on providing this
personal information. All entries become the property of the Venue. You can gain access to the personal information held
by phoning or writing to the Promoter at the address listed below.
16. Publicity: Entrants consent to the Promoter and/or the Venue using the entrant’s name, likeness, image and/or voice,
should they be a Winner. This includes photograph, film and/or recording of the same in any media for an unlimited period
without remuneration, for the purpose of promoting this competition. The Promoter and/or Venue will endeavour to
arrange such activities at the convenience of the Winner.
17. Limitation of Liability: The Promoter, its employees, the Venue, its employees and the agents shall not be liable for any
loss, damage or personal injury whatsoever (including negligence) which is suffered, incurred or sustained in any way in
connection with this Promotion, except for any liability which cannot be excluded by law.
18.Governing Law: The laws of the State of Victoria govern this Promotion.
