Terms and Conditions:

1.Information on how to enter and prizes forms part of these Terms and Conditions. By entering this promotion, you accept these Terms and Conditions.
2.This promotion commences Monday, 8 February 2016 and entries close at Monday, 29 February 2016, 11:59PM (AEDT) (“Promotion Period”).
3.Entry is only open to Australian residents who, at the time of entry and at the time of the draw:
a. are aged 18 years or over;
b. are Optus customers with an active Optus mobile telephone, landline telephone, mobile broadband or landline internet service (each a “Service”);
c. have a valid passport with at least 6 months validity from the final date of travel in the Prize;
d. do not have a criminal record, outstanding warrants or any infringement notices that would prevent them from entering the USA.
4.Entrants must comply with the Promoter’s trading terms throughout the Promotional Period and must not have overdue monies owing as at the time of the draw in order to be eligible to claim any prize.
5.Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.
6.To enter, entrants must, during the Promotional Period:
a. be a registered member of Optus Perks;
b. go to optusperks.com.au/iheart and:
i. tell us in 25 words or less which singer you would like to sing a duet with and why; and
ii. provide a valid name, email address, mobile phone number details.
7.Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
8.Incomplete or indecipherable entries will be deemed invalid.
9.All valid entries received during the Promotion Period will be entered into the judging to be held on Thursday, 3 March 2016, 3:00PM (AEDT) at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park, NSW 2113.
10.This is a game of skill and chance plays no part in determining the winner.
11.The first valid entry judged to be the most creative will win. The winner will be notified by email or phone by 4 March 2016. Judges’ decision is final and no correspondence will be entered into.
12.The winner must claim their prize by Thursday, 17 March 2016 5:00PM (AEDT). If the winner does not claim their prize by this date, such further judging will be conducted at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park NSW 2113 on 18 March 2016 at 9:00AM AEDT, as is necessary for an unclaimed prize. The winners of any unclaimed prize will be notified by telephone or in writing.
Prize
13.The following prize will be awarded to the winner:
i. Two tickets to the 2016 iHeartRadio Music Awards in Los Angeles on Sunday, 3 April 2016 local time, which is a “money can’t buy” event;
ii. Five nights in a twin share room in 4-star accommodation in Los Angeles, at a location to be determined solely by the Promoter, from Saturday, 2 April 2016 to the morning of Thursday, 7th April 2016, local time;
iii. Two return economy-class flights from the Winner’s nearest capital city to Los Angeles USA, arriving on Saturday, 2 April 2016 and departing from Los Angeles, USA on Thursday, 7th April 2016. *Dates, airlines and carriers are at the discretion of the Promoter;
iv. Return airport transfers from Los Angeles airport to the hotel accommodation for 2 people;
v. Return transfers from accommodation to the iHeartRadio Music Awards Event; and
vi. AU$1,000 spending money, awarded to the winner in the form of a prepaid Visa Debit card.
(Total Prize Value approximately $9,600)
14.Additional spending money, visas, luggage costs, meals, taxes, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included and at the winner’s expense. Winners will be required to provide a credit card and their passport upon checking in to the hotel. If the winner does not have a credit card, they will be asked for a cash deposit to cover incidentals.
15.The winner and their companions are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. All travelers will require a passport valid for at least six (6) months on date of travel. The winner and their companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. All persons entering the US must meet US entry requirements.
16.The Prize winner and their companion consent to the Promoter conducting a criminal record check prior to their participation in the Prize. The Promoter may, in its sole and absolute discretion, refuse the Prize winner and/or their companion’s participation in the Prize if the Prize winner and/or their companion have a criminal record or any criminal charges pending. In these circumstances, the Prize winner and/or their companion will automatically forfeit the Prize.
17.Winners must be available to travel at a time determined by the Promoter between Friday 1st April and Thursday 7th April 2016. The total nights spent in the United States of America will be five (5) nights so the winner may not be away for the entire time specified above. Exact travel dates are subject to airline availabilities.
18.Please note the winner and their guest must travel together and must leave from the winners nearest capital city as specified in their entry.
19.The Prize is subject to booking and flight availability at time of booking. The Promoter accepts no responsibility for the cancellation or rescheduling of any flights. Prize must be taken by at the times and dates specified by the Promoter and in accordance with these terms and conditions. If the winner is unable to travel on the nominated dates, then the Prize will be forfeited by the winner and the Promoter may in its discretion, award the Prize to the next valid entry drawn from the entries into the draw. Frequent flyer points will not form part of the Prize.
20.The Prize winner and their companion must adhere to any and all local government laws and regulations, including around the consumption of alcohol. The Promoter takes no responsibility for any actions taken by local authorities if the Prize winner and/or their companion break any local laws. The Prize winner and their companion should make themselves aware of the local laws and penalties of the USA
21.The Australian Department of Foreign Affairs and Trade issues travel warnings and updates for travelers. The Promoter recommends that the Prize winner and their companion consult www.smarttraveller.com.au for advice and information prior to undertaking travel.
22.The Prize winner and their companion must be in good health and must not have any pre-existing medical conditions that would prohibit them from flying to, entering and remaining in USA, or participating in any way in the Prize. The Prize winner and their companion must declare to the Promoter and/or any prize supplier any health-related issues that may affect their safe participation in any part of the Prize and obtain a written clearance from their doctor in this respect.
23.If the Promoter determines, in its absolute discretion, that the winner is not in the necessary condition to safely participate in the Prize, the Promoter reserves the right to refuse to award to the winner any part of the Prize.
24.Prize is subject to the standard terms and conditions of individual prize and service providers.
25.Total Prize value in the Promotion is estimated at AU$9,600 (including GST) and inclusive of a “money can’t buy” experience.
26.In the event that for any reason whatsoever the winner does not take an element of the Prize at the time stipulated by the Promoter then that element of the Prize will be forfeited by the winner.
27.The Prize (including any unused portion) cannot be transferred, exchanged or redeemed for cash. The Promoter retains the right to substitute the Prize with a prize of equal or greater value (including where the Prize is unavailable).
28.The Promoter’s decision is final and no correspondence will be entered into, including in the event of a dispute. The Prizes must be taken as offered and cannot be varied.
29.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
30.If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
31.Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
32.The Promoter is not responsible for any incorrect or inaccurate information, either caused by promotional website users or by any of the equipment or programming associated with or utilised in this Promotion, or by any technical error that may occur in the course of the administration of this Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
33.If for any reason this Promotion is not capable of running as planned due to any reason, including but not limited to infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion.
34.It is a condition of accepting the Prize that the winner may be required to sign a release of liability in a form to be determined in the absolute discretion of the Promoter.
35.The winners agree to participate in any news and media/PR activities surrounding the Promotion. All entrants consent to the Promoter using their name, likeness, image and/or voice during the Promotion and in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
36.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) and Cricket Australia exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the Prize. Nothing in these Terms and Conditions alters an individual’s statutory guarantees as set out in the Competition and Consumer Act or similar State and Territory laws, where it is illegal to do so.
37.The Promoter collects personal information in order to conduct the promotion, and entry is conditional upon providing it. The Promoter may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Some of the parties mentioned above may be located overseas; please refer to the Promoter’s privacy policy atwww.optus.com.au/privacy for details. The Promoter will also use and handle personal information as set out in that privacy policy. Entrants should direct any request to opt out, access, update or correct personal information to the Promoter and direct any complaints regarding treatment of their personal information according to the Privacy Policy. All entries become the property of the Promoter.
