TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these
Terms and Conditions.
2. Entry is only open to residents of Australia aged 22 years and over who hold a full current valid driver’s licence in an Australian State or Territory,
which is not cancelled or suspended.
3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family
means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent,
grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The promotion commences 6 April, 2016 at 16:00 AEDST and promotion closes 23:59 AEST 20 April, 2016 (“Promotional Period”). The judging and
announcement will take place on 21 April, 2016 at 11.00am AEST at BMW’s office: 783 Springvale Road, Mulgrave, VIC. The winners will be
notified by phone and in writing using the contact details given in their entry on 21 April, 2016.
5. To enter, eligible individuals must complete the following steps during the Promotional Period:
(a) visit

o Postcode
o What is the make and model of the car you currently own/drive?
(c) input their answer the question “If you could drive a BMW M2 for one day only, where would you drive to and why?” (“Promotional
Question”), in 25 words or less; and
(d) submit the fully completed entry form.
6. Incomplete or indecipherable entries will be deemed invalid.
7. Only one (1) entry permitted per person.
8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entr ant.
The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
9. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative
merit of the answer provided to the Promotional Question.
10. The Promoter’s and judges’ decision is final and no correspondence will be entered into.
11. Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to their answer to the
Promotional Question, comments, recordings and images (“Content”). The Promoter shall not be liable in any way for such Content to the full
extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant
and agree that:
(a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property,
privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing,
threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise
unsuitable for publication;
(b) their Content shall not contain viruses or cause injury or harm to any person or entity;
(c) they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
(d) the Content is the original artistic/literary work of the entrant that does not infringe the rights of any third party;
(e) they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the
Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
(f) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation,
privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
12. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royaltyfre e,
perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall
include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without
compensation, restriction on use, attribution or liability.
13. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of
residence) and reserves the right, in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of
these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise
fair and proper conduct of the promotion. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce
any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation
from such an offender are reserved.
14. The best twenty (20) valid entries, as determined by the judges, will be deemed the prize winners and will each receive:
A BMW M Driving Experience one (1) day course on May 2, 2016, which includes:
• A day at Phillip Island Circuit from 11.00am - 5.00pm valued at $1,395 per person;
• Lunch and Afternoon tea;
• Coffee, tea and drinks provided continuously throughout the day;
• Return flights for the winner only, from their nearest capital city to Melbourne, VIC valued at up to $700.00, depending on date
and point of departure. Flights are only provided if winner ordinarily resides more than 250km from Melbourne GPO; and
• Transfers to and from Melbourne airport from Phillip Island valued at up to $250.00, depending on date of booking (only provided
if winner resides more than 250km from Melbourne GPO).
If a winner ordinarily resides within 250km of Melbourne GPO, then the prize does not include airfares, accommodation or
airport/accommodation transfers and these components of the prize are not redeemable for cash. In other cases, the Promoter may (at its sole
discretion) provide one (1) night’s accommodation to a winner on account of flight schedules and BMW M Driving Experience course timings. This
is valued at up to $350 (including GST) but excludes in room charges, gratuities, laundry, entertainment and optional meals.

Total prize pool value is approximately $25,725.
15. Spending money, additional meals, taxes, insurance, transport to and from departure point, additional transfers, items of a personal nature, inroom
charges and all other ancillary costs are not included. Prize must be taken on 02/05/16. Itinerary to be determined by the Promoter in its
absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize
and service providers. Winners may be required to present their credit card at time of accommodation check in.
16. All winners must produce their valid Australian Driver’s License and sign the electronic BMW Indemnity Form provided to them on the day of the
course – a sample copy of this is available at
http://nsc.bmw.com.au/_common/shared/insights/driving_experience/pdf/indemnity.pdf. Failure to
complete this form within the time frame required by the Promoter, will result in the winner forfeiting their right to the prize.
17. BMW take out an insurance policy for each winner, with an excess of $3000, however this would only be applicable in the case of considerable
negligence. BMW’s focus for these days is both winner safety and making sure winners have a fun and memorable day driving some great cars.
Whilst BMW are driving on a closed race circuit we make it clear to winners it is not a race. We know also that driving in this sort of environment
may challenge some people however BMW never encourage or force customers to drive outside of their own customer levels, BMW make that
abundantly clear prior to setting out.
18. The winner of the prize must hold a current valid driver’s licence issued in an Australian State or Territory. The winner acknowledges that motor
racing is a dangerous activity, which may result in injury to or death and participates at his/her own risk. Prize must be taken on 02/05/16. BMW
Australia will provide the prize (“Prize Supplier”). The winner (a) must attend, undergo and pass any appropriate training, briefings, safety
demonstrations, required medical tests and other requirements (including blood alcohol testing) of the Promoter and the Prize Supplier as
determined by them in their absolute discretion; (b) must declare to the Promoter or the Prize Supplier any health-related issues that may affect
his/her safe participation in the prize and obtain a written clearance from their doctor in this respect; (c) must not have any heart condition or
history thereof, or other medical conditions that would make it dangerous to participate in the prize; (d) must not be under the influence of any
drugs or alcohol; (e) must comply with all directions of the Promoter, the Prize Supplier, the nominated driver and race officials; and (f) must wear
all safety and other equipment required. The Promoter and the Prize Supplier in their absolute discretion (a) will nominate a qualified driver; (b)
reserve the right to refuse to allow the winner to take part in any or all aspects of the prize if they reasonably believe the winner poses a safety < br /> risk or for any other reason; (c) may cancel the prize if the conditions are deemed dangerous. If the prize is varied for any reason beyond the
control of the Promoter it may not be rescheduled and in which case, no compensation will be offered.
19. In the unlikely event of an incident that results in considerable damage, BMW will review the circumstances leading up to that event. If BMW feel
that a winner has deliberately gone against the instructions given by one of BMW’s experienced trainers and as a result of this behaviour,
damaged the car, BMW may need to consider the excess.
20. All other items of personal nature and costs apart from those listed above are at the cost of each winner. Values are provided by the suppliers and
are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the prize occurring between
publishing date and date the prize is claimed. All prize values are in Australian dollars.
21. The prizes are not transferable or redeemable for cash. The prizes (or any element of a prize) cannot be exchanged for any other prize/s. The
contents of the prizes will be at the Promoter’s sole discretion. The prizes are subject to availability and the terms and conditions of the entities
supplying the prizes. Any ancillary costs associated with redeeming a prize are not included. These are the responsibility of the winner.
22. The prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable, exchangeable and cannot be redeemed as
cash. The prize is not valid in conjunction with any other offer. The Promoter accepts no responsibility for any variation in the prize value. Prize < br /> winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to
acceptance of their prize.
23. In acceptance of the prize, the winner acknowledges that they may incur ongoing costs associated with the prize which are the entire
responsibility of the winner.
24. Prize is subject to the standard terms and conditions of individual prize and service providers.
25. In the event that for any reason whatsoever a winner does not take or redeem a prize (or an element of a prize) at or by the time stipulated by the
Promoter, then the prize (or that element of the prize) will be forfeited by the winner and cash will not be awarded in lieu of the prize.
26. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its
discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification.
27. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the
promotion, or suspend or modify a prize.
28. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)
the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or < br /> suspend the promotion.
29. If a medical circumstance in some way restricts your ability to enter the promotion through the required mechanic, you are still eligible to
enter however you must briefly state your circumstances upon entry.
30. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter.
Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a
winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal
documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a
condition of accepting the prize the winner signs any such legal documentation.
31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
32. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as
provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection
laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the
Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for
any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out
of the promotion.
33. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers,
employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury or death; or any loss or
damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry
or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the < br /> reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a
winner or entrant; or (f) participation in the BMW Drive Day and/or use/taking of the prize.
34. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify
any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
35. All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this
promotion is governed by the Privacy Notice (see Contents Page for location in this issue).
36. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or
recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any
outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
37. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties,
including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will
also use and handle PI as set out in its privacy policy, which can be accessed by visiting

www.caradvice.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an
indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending
electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and
direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter. The
Promoter will not disclose entrants’ personal information to any entity outside of Australia.
38. By entering this promotion, the entrant consents to receipt of any email regarding the promotion, and other emails which inform the entrant of
