Terms and Conditions – Leader News/Disney On Ice Family Weekend Adventure Competition

General

1. The Promoter is Leader Associated Newspapers Pty Ltd (ABN 34 004 337 446) of 1 Chapel Street, Blackburn, Victoria. Telephone number 03 9875 8250.

2. Information on how to enter and prizes forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

3. If there is any inconsistency between these Terms and Conditions and anything else that refers to this competition, these Terms and Conditions will prevail.

Who can enter

4. Entry is open to residents who reside within the Leader Community Newspapers’ distribution area (refer to end of these Terms and Conditions for Leader Distribution Area Suburbs List) except employees and immediate families of the Promoter and their associated companies and agencies. Immediate family includes the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.

5. Entrants under 18 years of age must obtain the prior permission of their parent or legal guardian in order to be able to enter. The Promoter may require any such entrant’s parent or legal guardian to sign a release at the Promoter’s discretion in which the parent or legal guardian accepts responsibility for the acts and forbearances of the winner. The release will include the parent or legal guardian’s full name, address and telephone number. Failure to agree to the release and provide these details will invalidate the winner’s entitlement to the prize, subject to State and Territory legislation. If the competition winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian.

6. The Promoter reserves the right to request winners to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity or proof of registration ownership in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

When to enter

7. The competition commences on Monday, May 9, 2016 at 12:05am AEST and concludes on Thursday, May 19, 2016 at 9:00am AEST. Entries must be received by the Promoter prior to the competition close date and time.

8. The time of entry will in each case be the time the online entry is received by the Promoter’s database, not at the time of transmission by the entrant.

9. The Promoter accepts no responsibility for any late, lost or misdirected entries including entries not received by the Promoter or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason. Entry via computer generation and not attributable to a valid phone account is invalid and will not be accepted.

How to enter

10. Entrants may enter the competition by logging onto www.leadernews.com.au /competitions and registering their details including (but not limited to) full name, address, postcode, telephone number, e-mail address and codeword (if required) to complete their entry. The cost of accessing the promotion website will be dependent on the entrant’s Internet Service Provider.

11. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.

12. The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases.

Number of Entries permitted

13. Only one entry per person. Multiple entries submitted by one person will be deemed invalid.

Draw and Notification of winner

14. The winners will be the first valid entries submitted in accordance with these terms and conditions that is drawn by random computer selection at 10.00am AEST on Thursday, May 19, 2016 at Leader’s head office at 1 Chapel Street, Blackburn.

15. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the competition result or any other decisions the Promoter makes in connection with the Promotion.

16. The major prize winner will be notified by telephone as soon as possible after the draw and by mail within two days of the draw. Runner-up prize winners will be notified by mail within two days of the draw. Names of all winners (first initial, surname and postcode) will be published at www.leadernews.com.au/competitions as soon as possible after the draw.

17. Disney On Ice merchandise packs must be collected by winners from Leader’s head office at 1 Chapel Street, Blackburn by Friday, June 10, 2016. Packs not collected by this date may be forfeited and another winner selected.

18. Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).

19. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

20. Major prize winner’s details will be given to the prize provider for accommodation booking and prize provision purposes. Further discussions may be required with the major prize winner to ascertain number of eligible children taking part in the Disney On Ice Family Weekend Adventure.

Prize on offer

21. Individual prize value is up to $1161.50 (including GST) plus money-can’t-buy Disney On Ice cart ride. Total prize pool value is up to $2931.50 (including GST) plus money-can’t-buy Disney On Ice cart ride as at Monday, May 9, 2016.

22. One (1) major prize winner will receive a Disney On Ice Family Weekend Adventure valued at $1161.50 (plus money-can’t-buy opportunity) including:

• tickets for their family (two adults and up to three children aged under 16 years) for the 10am performance of Disney On Ice presents Magical Ice Festival at Rod Laver Arena on Sunday, July 3, 2016 (RRP $242.50);

• a Disney On Ice merchandise pack for each child (up to three children) (RRP $80 each - $240);

• a money-can’t buy opportunity for up to three children (aged between 4 and 10 years of age who meet height and weight restrictions) to ride in the Disney On Ice cart during the performance; and

• overnight accommodation (for two adults and up to three children) in a two-bedroom penthouse at Rydges Melbourne on Saturday, July 2, 2016 plus car parking, and buffet breakfast the next morning (Sunday, July 3, 2016) (RRP $679).

Further discussions will be required with the major prize winner to ascertain number of eligible children taking part in the Disney On Ice Family Weekend Adventure.

23. Five (5) runner-up prize winners will receive tickets for their family (two adults and two children aged 2-16 years) for the 6pm performance of Disney On Ice presents Magical Ice Festival at Rod Laver Arena on Sunday, July 3, 2016 (RRP $194) plus two Disney On Ice merchandise packs (RRP $80 each). Each prize valued at $354.

24. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

25. Prizes cannot be transferred, exchanged or redeemed for cash.

26. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. Winners should check passes for full terms and conditions. It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties.

27. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

28. All entrants agree that if they win the prize, they will not, and their companions will not, sell or otherwise provide their story and/or photographs to any media or other organisation, including the internet. Photographs will be allowed only at the discretion of the Promoter.

29. Event tickets are only valid for the date specified on the passes by the provider, and are subject to any terms and conditions imposed by the provider. Once awarded, the Promoter is not liable for any voucher or pass that has been lost, stolen, forged, damaged or tampered with in any way.

30. The major prize winner (and their companions) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers, laundry charges, activities (unless specified), incidentals, taxes, gratuities, services charges and all other ancillary costs. Travel insurance is recommended to protect against the additional costs incurred in the event of unforeseen circumstances. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.

Disney On Ice Show Participation: Additional Terms and Conditions

31. Publicity: By entering, you agree that whether or not you are selected as a winner, we, our group companies and those with whom we or they have commercial alliances (eg prize providers and trademark licensors), and without payment of any fee or obtaining any further consents (a) may use and disclose information about or depicting you (eg your image and/or voice) to promote goods and services using such media (including electronic media such as email, SMS and social media platforms) and in such ways as is reasonable in the circumstances; and (b) will be given such co-operation as is reasonably requested of you as regards participation in media requests, eg being interviewed and photographed. Where the promoter is not Feld Entertainment (Australia) Pty Ltd ABN 49 083 865 409, you agree that the promoter has a commercial alliance with the company.

Disney On Ice Show Participation: Law and our liability

32. If you win a prize to participate in an Ice show as part of the Promotion: You acknowledge that if you win a prize to participate in an Ice show (the “Show”) as part of the Promotion, you or a person nominated by you (“the Nominated Person”) will be provided with the opportunity to sit in a sledge in the get up of a cart (“Cart”) and to be moved around the ice rink on which the Show is presented, (the “Cart ride”). If you accept that opportunity, you agree that the Cart ride is a recreational activity undertaken during the Show and you further acknowledge that participation in the Cart ride by you and/or the Nominated Person (subject to the acknowledgment in “Your Warranty regarding an unaccompanied Nominated Person” below) involves activities on and near ice and also involves risks which include any Obvious Risk and the following notified risks:

(a) a Nominated Person travelling in the Cart unrestrained and unaccompanied by you or an adult;

(b) stumbling, slipping and/or falling and/or coming into physical contact with the ice or another person or persons while entering or exiting the ice rink, or being on the ice, or being seated in, travelling in or exiting the Cart (“activities”) due to any act or failure to act by you or a Nominated Person or by a person assisting, or meant to assist you or a Nominated Person to undertake the activities or by any person on the ice rink or in the Cart;

(c) travelling to and from the place where the Cart ride is to occur;

(d) anything being thrown by a person including a person on the ice or a member of the audience at or toward or near the Cart ride, you, the Nominated Person or any person on the ice during the Cart ride;

(e) a person on the ice propelling, or meant to be propelling, the Cart, failing to control or to properly control (partly or at all) the direction or movement of the Cart;

(f) a collision or action being taken to avoid or minimise the risk of collision between the Cart and a person on the ice or any other thing on the ice;

(g) the Cart failing to remain on the ice or leaving the ice, either fully or partially; and

(h) any coming into contact with a person that has, or persons that have, an infectious or contagious illness or disease.

(“Notified Risks”).

33. In this clause, propelling the Cart includes manually pulling or pushing the Cart, putting the Cart in motion, accelerating or decelerating the Cart, turning the Cart, and bringing the Cart to a stop.

34. To the extent permitted by Law, you voluntarily (a) assume and shall ensure that each Nominated Person voluntarily assumes all Obvious Risks and Notified Risks and (b) assume sole responsibility and decision making in respect of the safety and welfare of each Nominated Person in relation to the Cart ride. This includes to the extent permitted by law voluntarily assuming risks of any and all loss, injury or damage caused by, or arising from, an Obvious Risk or a Notified Risk.

34. Your Warranty regarding an unaccompanied Nominated Person: You warrant that having regard to Obvious Risks and Notified Risks and the other terms of these Official Rules, you will only nominate and allow a Nominated Person to be involved in the Cart ride who is suitable for that involvement without being accompanied by you. A reference in the terms of these Official Rules to participation by you in the Cart ride excludes you being on the ice or in, or near, the Cart during the Cart ride.

35. Safety requirements: Without limiting the “Your Warranty regarding an unaccompanied Nominated Person” in subclause 34, you agree to be bound by the procedures and specifications for the Cart ride, including requirements in the interests of safety including the maximum weight, size or height of a Child permitted to participate in the Cart ride (“Child’s characteristics”) which may be advertised as part of the Promotion of the Cart ride and/or otherwise notified to you prior to or, if reasonably appropriate, during the Cart ride. Devices which are required by individuals for mobility, such as wheelchairs, cannot be accommodated in the Cart for safety reasons.

36. To the extent permitted by Law:

(a) neither of us is liable to the other for any liability loss, cost, damage, injury, expense or demand whatsoever and howsoever caused (including by breach of contract or tort, by default or negligence, pursuant to any occupier’s liability and by breach of privacy rights) arising from the participation by you and/or a Nominated Person in the Cart ride;

(b) each party releases and indemnifies the other from any liability loss, cost, damage, injury, expense or demand whatsoever and howsoever caused (including, without limitation, by breach of contract or tort, by default or negligence, pursuant to any occupier’s liability and by breach of privacy rights) and arising from the participation by you and/or a Nominated Person in the Cart ride; and

(c) if, notwithstanding the preceding clauses 36 (a) and (b), either party becomes liable to compensate, or does so compensate, the other party for any liability, loss, cost, damage, injury, expense or demand arising from the participation in the Cart ride by you and/or a Nominated Person in the Cart ride, then the parties agree that their liability to each other is limited to the cost of the Cart ride. If contrary to clauses 36 (a) and/or (b), we become liable to compensate, or do so compensate, a Nominated Person, then you agree to indemnify and reimburse us for that compensation.

37. If any or all of clauses 36 (a), (b) and (c) for any reason do not apply, and the Show takes place in Australia, then we as a corporation supplying recreational services in Australia are permitted in Australia under sections 64 and 139A of the Australian Consumer Law to limit liability for death or personal injury in relation to the supply of those recreational services and, to the extent permitted by Law, we limit our liability for death or personal injury in relation to the supply of those recreational services to AUD100,000 per occurrence.

38. You are responsible for each Nominated Person. You warrant that you are a person legally responsible for each Nominated Person, are able to enter into the terms of these Official Rules on behalf of or in connection with the Nominated Person and agree to be responsible in all respects for each Nominated Person.

39. You agree that we have no obligation to run the Cart ride in any Show.

40. Participation of a Nominated Person in the Cart ride is at our absolute discretion.

41. We can withdraw the participation of, or cease the participation of, a Nominated Person in the Cart ride at any time before or during a Cart ride and a Nominated Person may be refused access to, or removed from, the Cart by us at any time. Other than a refund of any price actually paid by you to participate in the Cart ride (which you agree will be your sole remedy), we will not be liable for any loss, cost or other harm suffered by you or a Nominated Person nor shall we be liable to satisfy any claim by or pay any compensation to you or a Nominated Person arising from us exercising our discretion under this clause.

42. In this clause 42:

(d) Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth) and any applicable similar consumer protection laws in the states and territories of Australia that mirror the provisions of that schedule.

(e) Cart, Cart ride, Nominated Person, Notified Risks and Show have the meanings given above;

(f) Child permitted to participate in the Cart ride means a person between the ages of 4 and 10 years of age who meets the Child’s characteristics in subclause 36;

(g) ice includes the ice rink and other locations on which performers perform in the Show;

(h) ice rink includes a gate or other access point to the rink and any surround or border delineating the rink;

(i) Law means either laws applicable in Australia exclusively or laws applicable in New Zealand exclusively, such that if the Show takes place in Australia, the law of the State where the Show occurs and in Australia includes the Australian Consumer Law as well as any applicable State and Federal law to that State or if the Show takes place in New Zealand, the laws of New Zealand including the Fair Trading Act 1986 and the Consumer Guarantees Act 1993.

(j) Obvious Risk means a risk that is generally known as arising from the Cart ride or which ought to be reasonably known to you and/or a Nominated Person; and

(k) State means the State or Territory of Australia where the Show attended by you actually occurs.

Disney On Ice Show Participation: Your rights under Consumer Law and who you give your commitments to

43. Regardless of anything else in these Official Rules, nothing in these Official Rules excludes, restricts or modifies the application of Consumer Laws or the exercise of any rights or remedies you may have under Consumer Laws where any such exclusion, restriction or modification would contravene Consumer Laws. “Consumer Laws” refers to the Australian Consumer Law under Schedule 2 of the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law and Fair Trading Act 2012 (Vic) and any applicable similar consumer protection laws in the states and territories of Australia.

44. In respect of your promises under these Official Rules, we, in entering into the terms of these Official Rules shall be deemed to be doing so for ourselves and also as agent for and on behalf of and for the benefit of each of Our Associates and, to this extent, each of Our Associates shall be deemed to be a party to the terms of these Official Rules and your promises under these Official Rules are enforceable by each of ourselves and each of Our Associates directly. In these Official rules, ‘Our Associates’ includes (with each corporation individually described as a Principal) any or all of:

(a) a director, officer, employee, agent or subcontractor of us;

(b) Feld Entertainment (Australia) Pty Ltd ABN 49 083 865 409

(c) the Walt Disney Company;

(d) Buena Vista Theatrical Group Limited;

(e) Ringling Bros Barnum and Bailey Combined Shows Inc;

(f) any related body corporate of the Principal within the meaning of, in Australia, the Corporations Act 2001;

(g) a body corporate that is engaged in a joint venture with us or with a Principal;

(h) if we transfer to, or licence, anyone to undertake any of our obligations under the terms of these Official Rules, any transferee or licensee respectively,

(with each of the above individually described as a Principal); and

(i) any director, officer, employee, agent or subcontractor of a Principal or of any the entities in paragraphs (b) to (h) inclusive

Further General Terms and Conditions

45. Subject to complying with all relevant State and Territory legislation, the Promoter reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of the competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.

46. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

47. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.

48. Entrants are responsible for any cost associated with accessing the promotional website. Access to that site is dependent on the Internet service provider.

49. If an entrant uses any form of software or third party application to enter multiple times (including scripting software), organises for a third party to enter on their behalf in breach of these terms and conditions or enters using incorrect contact details, his or her entry will be deemed invalid. If such an entrant wins a prize, the entrant must immediately return the prize to the Promoter. The Promoter has sole discretion to determine whether an entrant has breached this clause. The Promoter reserves the right to request whatever documentation it deems necessary to confirm whether an entrant has breached this clause. Entrants must provide whatever documents the Promoter requires upon request.

50. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.

51. The Promoter will make reasonable efforts to deliver prizes to the addresses provided by competition entrants. If a prize is returned to the Promoter because it could not be delivered to the address provided, the Promoter cannot guarantee that it will be able to resend the prize to the prize winner. The Promoter and its associated agencies and companies will not be liable for any damage to or delay in transit of prizes.

52. The Promoter reserves the right to redraw the prize if an entrant who claims to be a prize winner is unable to satisfy these terms and conditions.

Copyright, Statutory guarantees, Waiver and liability

53. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s submission, image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with News Life Media or News Limited or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.

54. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.

55. The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

56. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

57. All entries become the property of the Promoter. The Promoter collects personal information about you for the purposes of conducting this promotion. Any disclosure of such information will be made as required by law and in accordance with these terms and conditions but no further use of this information will be made without prior consent.

58. The Promoter collects information about you, including for example your name and contact details which you provide when registering or using our services as well as information from data houses, social media services, our affiliates and other entities you deal or interact with for example by using their services. We collect and use that information to provide you with our goods and services, to promote and improve our goods and services, to provide you with targeted advertising based on your online activities, for the purposes described in our Privacy Policy and for any other purposes that we describe at the time of collection. We may disclose your information to our related companies, including those located outside Australia. Any of us may contact you for those purposes (including by email and SMS) at any time. We may also disclose your information to our service and content providers, including those located outside Australia. If you do not provide us with requested information we may not be able to provide you with the goods and services you require.
