Entry Restrictions
Entrants and their companion must be 18 years of age or over. However, where an entrant is under 21 years of age, that entrant must be accompanied by a parent or guardian who is 21 years of age or over whilst taking the Prize.
The Promoter may require entrants and their companion to provide proof of age in a form acceptable to the Promoter. Should an entrant or their companion be unable to satisfy this requirement, the entrant will be ineligible for the prize.
Entrants and their companion must be able to take the prize before 5th August, 2017. Not to be taken over US or Australian Public, School or National holidays. Not valid between 12 December 2016 and 12 January 2017.
Dates and schedules of the prizes are not under the Promoter’s control and are subject to change. The Promoter takes no responsibility for any date or schedule changes.
Entrants and their companion must be the holder of a current passport with at least 6 months validity from the travel date.
The prize winner and their companion are responsible for any visa requirements associated with the prize. If the winner and/or their companion is unable to obtain a relevant visa or travel document, and/or is refused entry into The US, the winner may forfeit the prize.
If requested by the Promoter (in its sole and absolute discretion), entrants and their companion must sign an indemnity and exclusion of liability form in order to be eligible to win and participate in the prize.
Entrants must nominate a personal contact number being either a personal mobile number or home phone number (and not a business number) to be eligible for the prize (Personal Contact Number).
By entering the Promotion, an entrant grants the Promoter the right to call that entrant on their Personal Contact Number and put the call to air.
Entrants in the Promotion must be able to receive a phone call from a representative of the Promoter (on their Personal Contact Number, as defined below) between 12:00pm AEST and 10:00PM AEST between 8th August, 2016 and 12th August 2016 and in accordance with the requirements outlined in the Entry Method to be eligible to be awarded the prize.
If the entrant does not answer their phone by the time that phone goes to a message bank, the entrant consents to the Promoter broadcasting that entrant's voicemail message including their full name and/or business name live on air.
Each entrant acknowledges and agrees that their whole voicemail message may be broadcast on-air during the Promotion Period.
Each entrant warrants that they have received all consents from third parties that may ordinarily answer their Personal Contact Number in the entrant's absence to be broadcast live on-air if that third party answers the relevant phone live on-air. If a third party answers an entrant's Personal Contact Number, that entrant will not be eligible for a prize as determined by the Promoter in its absolute and sole discretion.
An entrant who has won prizes to the value of $10,000 or more, in any promotion(s) run by the Promoter in the previous six (6) months prior to their Entry in this promotion is ineligible to enter this promotion.
The promotion begins at 5:00pm AEST on 5 August 2016.
Entries into the promotion close at 2:00pm AEST on 12 August 2016.
Online Entry
During the Promotion Period entrants will be invited via Station on-air commercials to visit the Station Website and fully complete the online entry form in the manner required, including by providing their full name, mobile telephone number, current and valid email address, age, state, and answering in 25 words or less the question, “Why do you want to win a trip to LA?” (Answer).
Each valid entry will be individually reviewed by representatives of the Promoter (Judges) based on the Judging Criteria.
At various times during the Promotion Period the Judges (in their sole and absolute discretion) will:
(a) select up to 10 entrants judged to have submitted the ‘best’ entries based on the Judging Criteria (in the Promoter’s sole and absolute discretion) from all valid entries submitted by 5:00PM AEST that day during the Promotion Period (each, a Selected Entrant);
(b) contact up to 10 Selected Entrants (in the absolute and sole discretion of the Promoter) by telephone and place them on the standby list for that day; and
(c) invite the Selected Entrant who submitted the ‘best’ Online Entry based on the Judging Criteria to appear on air to participate in the On Air Challenge between 7:00PM AEST and 10:00PM AEST (Contestant).
On Air Challenge
(a) During the Promotion Period, the Promoter will have one
predetermined item (as determined by the Promoter in its sole and absolute discretion) that will be the ‘object of the day’ which will be placed in a tub of water to determine whether it sinks or floats (Nominated Item).
(b) The Contestant, during a specified time period (as determined by the Promoter in its sole and absolute discretion), will be asked to tell representatives of the Promoter whether the Nominated Item will float, or if it will sink in a tub of water.
(c) The Promoter will place the Nominated Item in a tub of water and after a nominated period of time (as determined by the Promoter in its sole and absolute discretion), the Promoter will determine (in its sole and absolute discretion) whether the Nominated Item sinks or floats.
(d) If the Contestant correctly identifies if the Nominated Item sinks or floats (as applicable and as determined by the Promoter in its sole and absolute discretion), they will be placed on the finalist list (Finalist).
(e) If the Contestant does not correctly identify if the Nominated Item sinks or floats (as applicable and as determined by the Promoter in its sole and absolute discretion), they will not be awarded a place on the finalist list, and the On Air Challenge will conclude for that day.
Appear On-Air
On 12 August 2016, the Promoter (in its sole and absolute discretion) will:
(f) Contact the Finalists on the finalist list (in the absolute and sole discretion of the Promoter) by telephone; and
(g) invite the Finalist who submitted the ‘best’ Online Entry based on the Judging Criteria to appear on air to be awarded the Prize. If they successfully appear on air (as determined by the Promoter in its sole and absolute discretion) they will be deemed the winner and awarded the Prize. If for any reason they are unable to be contacted, or is otherwise unable to, or decline to, appear on air, or their phone line drops out, or they are inaudible the Promoter (at its sole and absolute discretion) may decide to replace them by contacting the Finalist who submitted the next ‘best’ Online Entry based on the Judging Criteria (as determined by the Promoter in its sole and absolute discretion) and invite them to appear on-air to be awarded the Prize. The Promoter will repeat this process until a Finalist is able to be contacted and confirms their eligibility and ability to appear on-air to be awarded the Prize.
Final On Air Challenge (if applicable)
If by 12 August 2016, no Contestant has correctly identified whether the Nominated Item sinks of floats (as determined by the Promoter in its sole and absolute discretion) and there are no Finalists on the finalist list, the Promoter will (in it sole and absolute discretion):
(a) Invite the Contestant who submitted the ‘best’ Online Entry that day (as determined by the Promoter in its sole and absolute discretion) in accordance with the Judging Criteria to appear on- air to participate in the final On-Air Challenge; and
(b) conduct a final On-Air Challenge in the same manner as outlined above with a different Nominated Item until a Contestant successfully identifies (as determined by the Promoter in its sole and absolute discretion) whether the relevant Nominated Item sinks of floats;
(c) If the Contestant correctly identifies if the Nominated Item sinks or floats (as applicable and as determined by the Promoter in its sole and absolute discretion), they will be deemed the winner and awarded the Prize.
(d) If the Contestant does not correctly identify if the Nominated Item sinks or floats (as applicable and as determined by the Promoter in its sole and absolute discretion), they will not be awarded the Prize, and the Promoter will invite the Contestant who submitted the next ‘best’ Online Entry that day to appear on-air to participate in the final On-Air challenge as a Contestant;
(e) The Promoter (in its sole and absolute discretion) will continue to conduct the On Air Challenge until a Contestant successfully identifies (as determined by the Promoter in its sole and absolute discretion) whether the relevant Nominated Item sinks of floats and is deemed a winner and awarded the Prize.
The Promoter may (in its sole and absolute discretion) provide additional clues and hints to the Contestant during an On-Air Challenge however the Promoter is under no obligation to do so.
All decisions of the Promoter are final and no correspondence will be entered into.
If for any reason a Selected Entrant/Contestant/Finalist is unable to be contacted, or is otherwise unable to, or declines to, appear on air, or their phone line drops out, or they are inaudible the Promoter (at its sole and absolute discretion) may decide to replace that Selected Entrant/Contestant/Finalist by contacting another entrant and inviting them to participate in the On-Air Game as a Selected Entrant/Contestant/Finalist. The Promoter will repeat this process until an entrant is able to be contacted and confirms their eligibility and ability to participate in the On-Air Game as a Selected Entrant/Contestant/Finalist.
For the avoidance of doubt, if an entrant is spoken to by a representative of the Promoter, it does not mean they have been selected as a that Selected Entrant/Contestant/Finalist and they may not be invited to participate in the On-Air Game and/or be awarded a prize.
For the avoidance of doubt, Selected Entrants must appear on air during the Promotion Period to be deemed a winner and awarded a prize (if applicable).
Entrants may submit as many entries as they wish however each entry must be submitted via a separate online entry form and must independently comply with these Terms of Entry.
All valid entries will be individually judged by representatives of the Promoter by 12th August, 2016 at the Promoter’s premises. All valid entries will be judged based on the Judging Criteria. The winner will be notified in accordance with the Notification of Winners information set out below.
Each valid entry will be individually judged (by representatives of the Promoter) based on enthusiasm and creativity of entry.

Where the Prize winner’s ordinary state of residence is WA, SA, VIC or QLD, the winner will also receive:
Two (2) adult economy return airfares from the Australian capital city closest to the ordinary residential address of the Prize winner and their companions to Sydney, New South Wales, Australia (inclusive of airfare related taxes and charges). For the avoidance of doubt, if the Australian capital city closest to the ordinary residential address of the Prize winner is New South Wales, the Prize winner will not receive this element of the Prize. In addition, this portion of this Prize cannot be used to only fly in companions whose ordinary residential address is outside New South Wales. In the event that the ordinary residential address of the Prize winner is not New South Wales, the winner and their two (2) companions must depart from the Prize winner’s ordinary residential address.
Travel Prize Terms and Conditions
The winner and their companion (if any) may be required to sign a code of conduct and/or a legal release or releases in the form determined by the Promoter in its sole discretion prior to participating in the prize. Failure to do so as determined by the Promoter (in the Promoter’s absolute and sole discretion) will result in the prize winner forfeiting their prize.
All components of the prize are to be arranged by a representative of the Promoter and/or an agent nominated by the Promoter in its sole discretion.
Redeeming the prize and any tickets, passes or vouchers issued as part of the prize is conditional on acceptance of terms and conditions as detailed by the Promoter, any prize providers and the airline carriers in accordance with normal travel practices.
All travel must be completed by August 12, 2017 and is subject to availability which may depend on applicable blackout periods as advised by any prize provider, select seat class with airlines or specific room category availability with accommodation partner.
The winner and/or their companion must have a valid credit card.
Passports and visas spending money, meals, additional activities and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed in
the Prize Details above are the responsibility of the winner and his/her nominated companion (if any) as incurred.
It is the winner's responsibility to organise transport to/from the airport departure/return point.
The winner is responsible for any amendments fees issued by airlines or other prize suppliers as a result of an action of the winner and/or their companion, once booking is confirmed and ticketed.
The Promoter takes no responsibility for loss or injury suffered by a winner and/or their companion (if any) as a result of taking the prize.
It is recommended that the winner and their nominated companion (if any) have valid travel insurance for their period of travel and adequate for the countries of travel.
No portion of the prize is redeemable for cash. The prize is not refundable or transferable.
The Promoter and prize providers accept no responsibility for any changes and/or cancellations to the events or activities. In the event that one or more event or activity is no longer available, the remainder of the prize shall constitute the complete and total prize. The Promoter will not enter into any further correspondence with the winner and his/her nominated companion.
All components of the prize must be taken together and when offered or are forfeited. Any element of the prize not taken will be deemed to be forfeited.
The prize winner and their companion must travel together and participate in the prize together at all times.
If the winner and their companion miss any of the arranged flights, the winner will forfeit the prize (at the Promoter’s absolute and sole discretion).
The winner and their companion must not be under the influence of any drugs and may consume alcohol in moderation but must not be under the influence of alcohol during any activities to the extent that it impairs or affects their understanding, judgment or participation in the activities, and subject to any limitations of the Promoter, any prize supplier and prevailing laws and regulations.
The prize winner and their companion consent to the Promoter conducting a criminal record check prior to their participation in the prize. The Promoter may, in its sole and absolute discretion, refuse the prize winner and/or their companion’s participation in the prize, if the prize winner and/or their companion have a criminal record or any criminal charges pending. In these circumstances, the prize winner and/or their companion will forfeit all claims in relation to the prize.
The winner and their companion must be in good health and must not have any pre-existing medical conditions that would prohibit them from entering this promotion or participating in any way in the prize.
The winner and their companion (if any) must hold a current and valid passport with at least 6 months validity from the travel date of the prize. The winner and their companion must provide a copy of their passports at the time of winning to verify the validity. If the winner and/or their companion do not supply their passports as requested, the winner will forfeit the prize as determined by the Promoter in the Promoter’s absolute and sole discretion.
The winner and their companion (if any) must prepare all necessary paperwork and apply for any relevant visas to enable them to travel to, and remain in, The US and participate in the prize (at their own cost). The winner should consult the Embassy or Consulate of The US for up-to-date information to ensure they can obtain the required visa prior to travel, in order to accept the prize. If the winner and/or their companion is unable to obtain a relevant visa or travel document, and/or is refused entry into the The US, the winner may forfeit the prize, in the sole and absolute discretion of the Promoter.

Any necessary vaccinations are the responsibility of the winner & their companion.
Entering this promotion and taking the prize is subject to prevailing terms and conditions of any accommodation/transport/experience/ services/transfers/travel insurance or tour providers, and in particular, health, behaviour, age and safety requirements. The prize winner and their companion must follow all reasonable directions given by the Promoter and any prize supplier during the course of their participation in the prize, including all directions in relation to health, age, behaviour, safety and legal and responsible consumption of alcohol. No compensation will be payable if the winner and/or their companion are unable to use any element of the prize as stated for whatever reason, including refusal of entry or departure into or out of The US or participation in any other activities for health, age, behaviour or safety reasons. If the winner or their companion fails to participate in the prize in the manner required, as stated in this condition and/or in the reasonable opinion of the Promoter or any prize supplier, the balance of the prize will be forfeited with no compensation payable.
The winner and their companion must adhere to any and all local government laws and regulations, including around the consumption of alcohol and gambling. The Promoter takes no responsibility for any actions taken by local authorities if the winner and/or their companion break any local laws. The winner and their companion should make themselves aware of the local laws and penalties of The US. Serious and severe penalties exist for underage drinking and drug offences. The death penalty can be enforced in some states of the USA for criminal acts such as murder, rape and crimes against the state including treason and threats to Homeland Security including acts of terrorism.
The winner and their companion must be in good health and must not have any pre-existing medical conditions that would prohibit them from flying to, entering and remaining in The US, or participating in any way in the prize. The winner and their companion must declare to the Promoter and/or any supplier any health-related issues that may affect their safe participation in any part of the prize and obtain a written clearance from their doctor in this respect.
The winner and their companion may be required to attend, undergo and pass any appropriate training, briefings, safety demonstrations, requisite medical tests and other requirements of the Promoter and any partnering clients as determined by them in their absolute discretion.
The Promoter and/or any prize supplier in their absolute discretion: (a) reserve the right to refuse to allow the winner or their companion to take part in any or all aspects of the prize if they reasonably believe the winner or their companion poses a safety risk; and (b) may cancel the relevant component of the prize if the conditions are deemed dangerous.
