TERMS AND CONDITIONS
On entering this competition you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.
1.2 This is a game of chance and the winner will be drawn randomly.
2. WHO CAN ENTER?
2.1 Entry is open only to residents of over 21 years of age with a full driving licence held for over 12 months.
2.2 There is a limit of 1 (one) entry per person, unless the entrant shares their entry on social media via the thank you page. The entrant will then receive a 2nd entry.
2.3 WARNING: Any attempt by the Entrant and/or his/her family/friends to enter more than the number of times authorized herein, using any third party proxy voting services, using multiple names or e-mail addresses and/or any other fraudulent mechanism(s), including robotic, automatic, programmed or similar methods, shall give the Promoter, in its sole discretion, the right to disqualify the Entrant’s Entry.
Employees and families of the Promoter or the prize suppliers or any of their agencies associated with the Competition or Program are not eligible to enter. This includes a spouse, de-facto spouse, parent, child or sibling (whether full, half, step or by adoption)
3. HOW TO ENTER
3.1 To enter, entrants must visit
www.facebook.com/britzcampervans, and vote for the beach where they would like to “Start your summer story” out of a selection of 8 beaches, then complete the online form.
3.2 Failure to comply with the above conditions or complete all fields required will deem the entry invalid and no correspondence will be entered into.
CRITICAL DATES
3.3 The competition commences on the 8 August 2016 and closes at 5pm on the 18 September 2016.
3.4 The prize draw will take place at Tourism Holdings Australia Pty Ltd trading as Britz Campervans, Central West Business Park, Building 2, 9 Ashley Street, Braybook VIC at 11am on the 19 September 2016. The winners will be notified by phone and email and the winners’ names will be published on
www.facebook/britzcampervans on the 21 September 2016.
3.5 If a winner is a resident of South Australia their name will be published in the classifieds section of the Adelaide Advertiser on 26 September 2016.
3.6 If any prize is unclaimed a redraw will take place (subject to any directions from a regulatory authority) at Tourism Holdings Australia Pty Ltd at 11am 3 October 2016. In the case of a re-draw the prize winner will be notified by phone and email and the winner’s name will be published on
www.facebook/britzcampervans on the 6 October 2016.
3.7 If the winner is a resident of South Australia their name will be published in the classifieds section of the Adelaide Advertiser on Tuesday the 13 October 2016.
4. THE PRIZE AND DETAILS OF PRIZE DRAW
4.1 There is one (1) prize to be won with a total value of up to AU$3060.
4.2 No purchase is required to enter.
4.3 There will be 1 draw. The first valid entries randomly drawn from the pool will win a Britz Summer 7 Day Holiday in New Zealand or Australia.
4.4 The prize is valid for travel from 14 November 2016 to the 31 March 2017 excluding 16 December 2016 to the 15 January 2017.
4.5 The prize redemption is subject to availability at all times.
4.6 The prize a Britz 2WD Campervan self-drive package with inclusive pack as liability option. Branch locations vary dependant on vehicle type. Australian locations available: Adealide, Melbourne, Sydney and Brisbane. New Zealand Locations: Auckland, Christchurch and Queenstown.
4.7 The prize does not include airport transfers. Fuel is not included and any cost for supplies and incidentals are the responsibility of the prize winner.
4.8 If the winner wishes to add extra rental days to the prize the inclusive pack will apply to all of these additional days. An alternative Liability Reduction option for these extra days cannot be selected.
4.9 The prize is not transferable and cannot be redeemed for cash.
4.10 Winners of the prize should seek independent financial advice about any tax implications that may arise from the prize winnings.
4.11 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
4.12 In participating in the competition, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed, filmed for broadcast and photographed. The winners agree to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner (and his/her companion) will not be entitled to any fee for such use.
4.13 The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
4.14 If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
4.15 As a condition of accepting the prize, the winner must sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity.
4.16 The Promoter’s decision is final and no correspondence will be entered into.
5. NO LIABILITY
5.1 This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible persons understand that they are providing their information to the Promoter and not to Facebook. The information an Eligible Person provides will only be used for the purposes outlined in these Conditions. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Facebook
5.2 CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
5.3 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to government legislation
5.4 The Promoter is not responsible for lost, interrupted communications or unavailable server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic.
5.5 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
5.6 The Promoter reserves the right to verify the validity of entries and to disqualify any entry of any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
5.7 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantee, the Promoter (including its respective officers, employees and agents) and Prize Promoter are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity) ; whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.
5.8 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
