The Competition
1. Entry into ‘WIN A LUXURY GETAWAY WITH JETS & LUXURY ESCAPES’ competition is open to Australian residents who are aged 18 years and over, except those persons set out in clause 9 of these terms. Nominated winner will be required to present proof of age when accepting their prize.
2. These terms and conditions form part of your entry to the competition. Entry into the competition is deemed acceptance of these Terms and Conditions.
3. The competition commences at 9:00am AEST on Monday, 8 August 2016 and will end at 5pm AEST on Wednesday, 31st August 2016 (“Promotional Period”). Late entries will not be eligible to enter. The Promoter reserves the right to extend, withdraw or cancel the competition at their own discretion without any obligation to compensate entrants.
4. The Promoters of this competition is Jets Swimwear Pty Ltd (ABN 28 068 819 581) of 17 Hardner Road, Mount Waverley Victoria 3149 and Luxury Escapes Travel Pty Ltd (ABN 16 150 650 927) of 50—60 York Street, South Melbourne, VIC 3205.
Eligibility
5. To enter the ‘WIN A LUXURY GETAWAY WITH JETS & LUXURY ESCAPES’ competition and be eligible to win, entrants must during the Promotional Period go online at jets.luxuryescapes.com, complete the competition form and answer in 25 words or less their response to the question “What are the 3 things you would take with you on a Luxury Escape?”
6. Entrants are limited to one (1) entry and must fill in all mandatory fields via the competition form.
7. All entries must include the correct contact details including name, email and phone number. This information will be used to contact you should you be successful.
8. All entries must be unique and original and not contain extracts from other published material.
9. Employees (and their immediate family) of the Promoter and related body corporates of the Promoter (as defined in the Corporations Act 2001 (Cth)) and DREAM Hotel Phuket employees (and their immediate family) are not eligible to enter this competition.
The Prize and Winning
There are three prizes to be won. The prizes are:
First Prize

11. The total value of the prize pool is $10,969.80.
12. This competition is a game of skill, and chance plays no part in the results of this competition. Entries will be judged on creativity of the answer given which will be determined at the judge’s sole discretion. The Promoters decision in relation to any aspect of this competition is final and negotiations will not be entered into.
13. There will be only one winning entrant nominated for the first prize. Accompanying ‘friend’ is not defined as a winner in this competition.
14. Judging will take place at JETS head office located at 8 – 18 Bowden Street Alexandria NSW, 2015 on Monday, 5th September 2016.
15. The nominee will be contacted via email or phone by Friday, 30th September 2016. The nominee must confirm their acceptance of the ‘WIN A LUXURY GETAWAY WITH JETS & LUXURY ESCAPES’ within five business days of being contacted.
16. If the nominee does not claim their prize by 5 October 2016 then the Promoters have the right to conduct further judging which will take place at JETS head at [insert time date].
17. The JETS garments chosen may be up to $600(RRP) in total. JETS will use best endeavors to find product to meet the prize value and match personal selection. Final product decision is subject to product availability and at JETS discretion. The prize is based on JETS current Recommended Retail Price (RRP) in Australian Dollars (AUD). Prizes may not be exchanged, transferred or redeemable for cash.
18. Unused / unclaimed garment value is not redeemable for cash or credit nor is any other portion of the ‘WIN A LUXURY GETAWAY WITH JETS & LUXURY ESCAPES’.
Return flights are only valid from your closest capital city i.e. Brisbane, Melbourne, Sydney, Canberra, Hobart, and Perth. Winner will need to cover ‘local’ transport arrangements to nearest airport at their own expense.
Winning entrant is responsible for their own personal insurance and liability – this includes all transfers and accommodation.
19. The nomination of type of accommodation, transfer, and flights is chosen by the Promoter only.

21. Travel must be taken between 30 September 2016 to 31 July 2017, subject to availability. All services included must be redeemed during your stay.
22. Blackout dates apply from 20th December 2016 – 10th January 2017.
23. The Promoters accept no responsibility for any variations in the value of the prize as quoted in these terms and conditions. In the event that the prize components as listed cannot be offered at the time of fulfilment at the fault of the promoter, a replacement prize will be offered of equivalent value (at the combined discretion of the promoters).
24. Prize is not transferable, and cannot be sold or exchanged for cash.
25. Unless expressly stated in these Terms and Conditions, all other expenses are the responsibility of the winner (and their companion) including but not limited to spending money, visas, transport to and from departure and arrival points, incidentals, mini-bar, laundry, room service, telephone calls, additional activities, gratuities, services charges, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs.
NO LIABILITY
26. The Promoters shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. Neither are the Promoters responsible for any incorrect or inaccurate information, either caused by the entrant or for any of the equipment or programming associated with, or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition, including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available.
27. If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoters, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoters reserve the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.
28. Except for any liability that cannot be excluded by law, the Promoters (including it officers, employees and agents) excludes all liability (including negligence) for any personal injury or loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to, where arising out of the following:
a) Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
b) any theft, unauthorised access or third party interference;
c) Any entry or prize claim that is late, lost, altered, damaged or misdirected (whether on not after receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters.
d) Any variation in prize value to that stated in these conditions of entry;
e) Any tax liability incurred by a winner or entrant;
f) The broadcast of any program relating to the competition or the publication of any material, including statements made by any compere, staff member, journalist, other entrants or any other person; and/or
g) Participation in the prize.
29. Once prizes have left the Promoters’ premises, the Promoters and their associated agencies take no responsibility for prizes damaged, delayed or lost in transit.
30. The Promoters reserve the right, in its sole discretion, to disqualify any individual who the Promoters have reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoters’ legal rights to recover damages or other compensation from such an offender are reserved.
Privacy
31. By entering the ‘WIN A LUXURY GETAWAY WITH JETS & LUXURY ESCAPES’ competition and accepting these terms and conditions, entrants acknowledge that the Promoters or Dream Hotel Phuket may publish winner details on their branded social media channels, company blog and/or company websites.
32. Published winner details will be limited to first name, residing suburb or town and answer to competition question.
