1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
2. Entry is open to residents of Australia who are 18 years and over. Employees and their immediate families of the Promoter, its agencies and venues/outlets associated with this promotion are ineligible to enter.
3. The promotion commences at 00.01 AEST on 28/08/16 and closes at 23.59 AEST on 8/09/16 (“Promotional Period”).
4. To enter:
a. For participants who are existing XXXX database members, participants must:
i. open the August 2016 email; and
ii. click on the ENTER link and fully complete all sections of the online entry form (including first name, last name, address, date of birth, email address and mobile number);
iii. submit an answer to the Entry Question ("What’s your favourite way to enjoy a XXXX GOLD Australian Pale Ale?") in 25 words or less during the Promotional Period; or
b. For participants who are not existing XXXX database members, participants must:
i. Be a current Facebook subscriber and visit the XXXX GOLD Facebook page at
http://www.facebook.com/XXXXGOLD, and click on the promotional post to access the online entry form;
ii. fully complete all sections of the online entry form (including first name, last name, address, date of birth, email address and mobile number);
iii. agree to become a member of the XXXX database and receive marketing communications via email and/or mobile from XXXX; and
iv. submit an answer to the Entry Question ("What's a fresh new change your've made for the better?") in 25 words or less during the Promotional Period;
5. Limit applies of one entry per person.
6. The judging of winners will take place from 10.00 AEDT on 9/09/16 at Level 7, 68 York St, Sydney NSW 2015. This competition is a game of skill. Chance plays no part in determining the winners. All entries will be judged individually on their merits based on creativity and originality. The best four (4) entries, as determined by the judges, will each receive a prize.
7. Prize consists of a carton of XXXX GOLD Australian Pale Ale (RRP $45). Total RRP value of total prize pool = $180. All taxes (excluding GST) which may be payable as a consequence of receiving a prize are the sole responsibility of the winner. In the event that a winner is a resident of the Northern Territory or where delivery is unable to be arranged, the prize component of the carton of XXXX GOLD Australian Pale Ale will be substituted for a gift card to the value of $45. The gift card prize is subject to the terms and conditions of that gift card.
8. Winners will be notified by telephone and/or email within two (2) days of the draw. Winner must accept the prize by phone or return email (however contacted by the Promoter) no later than 5:00pm EST on 13/09/2016 in order to accept the prize.
9. If any prize remains unclaimed in accordance with clause 8 or is otherwise forfeited despite the Promoter making all reasonable efforts to notify the winner, the Promoter may deem any winner as ineligible to receive the prize. In that event, the Promoter will reconvene the judges on 14/9/2016 at the same time and place as the first judging in order to distribute any unclaimed prizes. The next most creative and original entry, as determined in the discretion of the judges, will be deemed the replacement winner.
10. Prizes are not transferable and are not redeemable for cash. The Promoter’s decision is final and binding - no correspondence will be entered into.
11. To the extent permitted by law, the Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury in connection with the conduct of the promotion whether as a result of:
a. technical or telecommunications problems, including security breaches, technical website malfunctions or glitches; or
b. acts or omissions (including negligent acts of omissions) of the Promoter's servants or agents involved in the conduct of this promotion.
In the event of such problems or conduct, the Promoter may (subject to relevant state and territory lottery regulations and where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion.
12. If any prize or any element of a prize becomes unavailable for reasons beyond the Promoter's control, the Promoter may substitute a prize or element of a prize of equal or greater value at the Promoter’s sole discretion, subject to any written directions from the relevant authorities. Winners will not be entitled to any additional compensation in the event that the prize or element of a prize has been substituted at equal or greater value.
13. The Promoter reserves the right to request verification of age, identity, residential address and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or is otherwise involved in any conduct that involves manipulating, interfering or tampering with this promotion or otherwise preventing the conduct of the promotion as intended by the Promoter. In the event of such problems or conduct, then the Promoter may (where necessary with approval from the relevant lottery authority) modify, cancel, terminate or suspend the promotion.
14. The Promoter shall not be liable for any loss, damage or injury suffered by any winner as a result of the winner accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law.
15. In participating in this promotion entrants are providing information to the Promoter and not to Facebook. Each entrant acknowledges that this promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, and to the extent permitted by law, releases Facebook from any and all liability in relation to this promotion. 16. Entries will be deemed accepted at the time of transmission if all mandatory fields are completed. In any dispute relating to whether entries have been received or not will be determined by the Promoter, whose decision is final. Any entry that contains content that the Promoter, in its sole discretion, considers to be incomplete, inaccurate, underage, erroneous, ineligible, offensive, misleading, inappropriate or incomprehensible will be deemed invalid, as well as any entry that the Promoter, in its sole discretion, considers to infringe any intellectual property rights or other rights of any person, corporation or entity. Entrants will be refused service of alcohol or provision of an alcoholic beverage prize if it would breach any relevant laws, codes or policies including those of the relevant liquor licensee relating to the state or national promotions: responsible service of alcohol. The Promoter supports the responsible service of alcohol.
19. Any personal property rights in entries are owned by the Promoter. Details from entries will be collected and used for the purpose of conducting this promotion (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion.
