TERMS AND CONDITIONS
Participation
1. This promotion –“HOYTS Rewards member competition”(“Promotion”) is conducted by Hoyts Cinemas AU, Level 50, 680 George Street, Sydney, NSW, Australia (“Promoter”).
2. Information regarding prizes and how to enter forms part of these Terms and Conditions. Submission of an entry into this promotion is deemed to be acceptance of these Terms and Conditions. Entries not completed in accordance with these Terms and Conditions are ineligible.
3. Entry is only open to Hoyts Rewards members who are permanent residents of Australia who have opted in to receive email communications. Entrants must present themselves as a HOYTS Rewards member when purchasing a ticket in cinema or sign in as a HOYTS Rewards member when buying online at hoyts.com.au for at least two movies between Thursday 27 2016 October and Wednesday 30 November 2016 at a participating HOYTS. Directors, management and employees (and their immediate families) of the Promoter, participating retailers, agencies and companies associated with this Promotion are ineligible to enter. Entrants who are under the age of 18 years old must obtain their parent’s consent before entering.
4. The Promotion commences at 12.01am AEST on Thursday 27 October 2016 and finalizes at 23.59pm on Wednesday 30 November 2016 (the “Promotional Period”). To be a valid entry, all of the necessary information must be included with an entry and the entry must be received by the Promoter during the applicable Promotional Period explained above.
5. HOYTS Rewards members must have a current HOYTS Silver membership at the time of the draw and have a valid email address in your member profile. They must have checked the box ‘Please send me weekly newsletters & HOYTS offers’ under Edit Profile in the HOYTS Rewards section of the Hoyts website

6. Any customer who is not a HOYTS Rewards member can join the program to participate in this promotion.
7. Members must present themselves as a HOYTS Rewards member when purchasing a ticket in cinema or sign in as a HOYTS Rewards member if buying online at

Prizes
9. Each winner will receive a HOYTS Double movie pass + $20 HOYTS Dollars into their member account. Prizes are not transferable for cash. Prizes must be fully used within a six (6) month period from the date of allocation.
10. The Promoter’s decision is final and no correspondence will be entered into. The prize winners will have their name(s) published online at
www.hoyts.com.au and in HOYTS social media channels in December 2016.
For the sake of clarity, there are five (5) prizes valued at $310.00AUD in total.
All prizes are non-transferable and cannot be redeemed for cash.
General
11. The total prize pool is valued at $310.00AUD.
12. All prizes must be taken as offered. No portion of the prizes is redeemable for cash. All prizes are non- refundable, exchangeable or transferable. The prizes are valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize values. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
13. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
14. All entries become the property of the Promoter. The Promoter’s decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the Promoter. Entries will be deemed void if incomplete, indecipherable, illegible, stolen, forged or mutilated in any way.
15. If any prize is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute that prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. The Promoter accepts no other liability or responsibility for any loss.
16. The Promoter shall conduct such further draws as may be deemed necessary in accordance with the above at Level 50, 680 George Street, Sydney, NSW 2000. Prize winners, if any, will be contacted by phone and in writing within two (2) days of the re-draw date.
17. If for any reason the conduct or operation of the Promotion is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion, subject to the approval of the authorities that have issued permits for its conduct.
18. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication including any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, or otherwise, (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion; (iv) any incorrect or incomplete information which may be communicated in the course of the administering of this Promotion (whether as a result of one of the foregoing causes or otherwise).
19. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
20. The Promoter assumes no responsibility for, and the entrant releases the Promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the entrant’s participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an entrant’s error, any technical problem of any kind including communications or network failure, unauthorised access to, transferring or theft of data, whether caused by the entrant or associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotion’s administration, security, fairness or integrity are compromised or affected, the Promoter may (where necessary with the approval of the relevant Department) cancel, terminate, modify or suspend the promotion and/or disqualify any entrant involved in interfering or tampering with the conduct of this promotion in any way.
21. Details from all entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for publicity purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described.
