This competition is a game of skill, and participants who answer two multiple choice questions correctly go into a draw to win a prize. By entering the ‘Win a 7 night South African adventure’ competition, you agree to the Terms and Conditions below.
THE COMPETITION
Information on how to enter and the prize form part of this competition’s Terms and Conditions.
This competition commences on 01 January 2017 and concludes on 28 February 2017 (the ‘Promotion Period’).
Entry to this competition is deemed acceptance to these Terms and Conditions.
THE PROMOTER
This competition is promoted by African Wildlife Safaris Pty Ltd (AWS) (“the Promoter”).
The Promoter may contact the winner to obtain photographs of them for publication in various media for promotional and publicity purposes.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and to promote any products manufactured, distributed and/or supplied by the Promoter. The Promoter is entitled to a perpetual, irrevocable right to reproduce or modify said photographs, film, recordings, etc. without any fees for the purpose of marketing and promotion in any media.
The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entrants agree to receive Vacation & Travel magazine’s fortnightly e-newsletter upon entering this competition, from which they can unsubscribe any time.
Directors, management and employees (and the immediate families of directors, management and employees) of the Promoter, its agencies and companies involved in this promotion are ineligible to enter. Immediate family includes any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter accepts no responsibility for late, lost or misdirected entries and/or delays in the submission of entries due to technical or network disruptions or for any other reason.
Any cost associated with accessing the promotional website is the entrant’s responsibility.
The Promoter reserves the right to cancel the competition at any time and change these Terms and Conditions without any prior notice to any participant, if this is necessitated by unforeseen circumstances beyond the Promoter’s reasonable control.
The Promoter reserves the right to, at any time, request the winner to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim their prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit their prize in whole and no substitute will be offered.
The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content including (but not limited to) profanity, potentially insulting, inflammatory or defamatory statements. They may disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions or who has, in the opinion of the Promoter, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or the Promoter. The Promoter also reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry are of the nature described in this clause.
The Promoter’s decision is final and binding and the Promoter will not enter into any correspondence regarding the competition result.
The Promoter reserves the right to refuse to allow the winner and/or his/her travelling companion to take part in any or all aspects of the prize if the Promoter determines in its absolute discretion that the winner and/or his/her guest are not in the mental or physical condition necessary to be able to safely participate in the prize.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes, war or act of terrorism, the Promoter may, at their absolute discretion, suspend, modify or cancel the competition, as appropriate.
The Promoter and the prize sponsors shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize.
Nothing in these Terms and Conditions limits, excludes, modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (‘Non-Excludable Guarantees’).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a winner or entrant; or
(f) taking of a prize.

Competition entry is open to residents of Australia, aged 18 years or older only.

A limit of one (1) entry per person is permitted.
Entries open 01 January 2017 and close midnight AEDT Tuesday, 28 February 2017.
All entries must be received by midnight AEDT Tuesday, 28 February 2017 to be eligible.
To be eligible to win the prize, individuals are required to provide correct answers to two multiple choice questions and submit a fully completed online entry form.
Should an entrant’s contact details change during the Promotion Period, it is the entrant’s responsibility to notify The Promoter. A request to access or modify any information provided in an entry should be directed to The Promoter.
NON ELIGIBILITY
Incomplete, indecipherable or incomprehensible entries will be deemed invalid.
Any entry which has incorrectly entered personal information or contact details shall be deemed an invalid entry.
Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.
The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but is not limited to, entrants using different email addresses, postal addresses or PO Box addresses to enter the Promotion multiple times.
WINNER
A winner will be drawn at random out of the pool of eligible correct entries on 01 March 2017 at 11:00 AEDT at African Wildlife Safaris, 1st Floor, 333 Clarendon Street, South Melbourne VIC 3205.
The winner of the draw will be notified by phone and/or email within 14 days.
The winner will also be announced on the Promoter’s website

www.facebook.com/awsnfs on 01 March 2017. This Promotion is in no way sponsored, endorsed, associated with or administered by Facebook and entrants completely release Facebook for any and all liability in connection with this Promotion.
In the event that the prize is not accepted or claimed within 15 days of the draw, the winning entry will be deemed invalid. The Promoter reserves the right to conduct another draw at 11am AEDT on 16 March 2017 at African Wildlife Safaris, 1st Floor, 333 Clarendon Street, South Melbourne VIC 3205 to determine a subsequent winner. This winner will be notified and announced as per clauses 35 and 36 respectively.
THE PRIZE
The prize constitutes:
Return South African Airways economy class airfares for two adults from Perth, Brisbane, Adelaide, Melbourne or Sydney to South Africa;
Return Airlink economy class domestic airfares Johannesburg to Skukuza;
Return road transfers from airport to Sun City and Sabi Sabi Game Reserve;
2 nights twin-share accommodation in Luxury Room with breakfast at The Palace of the Lost City; and
3 nights twin-share accommodation on full board basis including standard beverages and scheduled gameviewing activities at Sabi Sabi Bush Lodge.
The winner and his/her companion must travel at the same time, depart from the same Australian capital city and be responsible for the cost of any transfer from their residence to either Perth, Brisbane, Adelaide, Melbourne or Sydney airport.
The prize is valid for use from 01 February 2017 and must be used in full by 31 October 2017. If, for any reason, a winner does not take the prize and complete the relevant holiday before that date or, once the prize has been booked, take the prize or an element of the prize by the date stipulated, then the prize or that element of the prize will be forfeited without further compensation.
Airfares are subject to availability and blackout dates may apply.
Rooms at The Palace of the Lost City and Sabi Sabi Bush Lodge are subject to availability, must be taken on consecutive nights and blackout dates apply for the festive season and public holidays.
All activities included in the prize are subject to availability and weather conditions permitting.
All other expenses, not specifically stipulated in the prize package as an inclusion, remain the responsibility of the prize winner and their nominated travel companion, such as additional airfares or transfers, spending money, meals other than those included, taxes, items of a personal nature, in-room charges, gratuities, optional activities and any other ancillary costs, including but not limited to, insurance and any applicable insurance excesses.
Travel insurance is the sole responsibility of the prize winner. Prize winners should be satisfied that their chosen insurance cover fully meets their personal requirements especially with respect to inclement weather, personal injury or illness.
In the event that the prize or any part(s) of the prize is/are not available, The Promoter reserves the right to substitute the prize or any part(s) of any prize with something with equal recommended retail value and/or specification.
The prize or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
