Experience With Us Terms and Conditions of Participation

Information on participation in Market Square’s “Experience With Us – Freebies for over 50s every Tuesday” (The Promotion) forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. All participants are required to meet the entry criteria outlined in Terms and Conditions.
The Promotion is open to those aged over 50 only who attend Market Square Shopping Centre, Corners Moorabool & Malop Streets, Geelong, Victoria, 3220 (Market Square).
Employees (and their immediate families) of the Promoter (Market Square Shopping Centre) are ineligible to enter.
To participate eligible individuals must claim their ‘freebie’ on a Tuesday at Market Square Shopping Centre in person. Freebies will not be given to a third party.
Only one redemption can be made per eligible person.
The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s age) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Promotion runs every Tuesday until further notice from 9am – 5.30pm.
Freebies vary every Tuesday and the most up to date information can be obtained from Market Square Centre Management, Level 1 of Market Square or on Market Square’s website – www.marketsquaregeelong.com.au
Participants agree that photos may be taken for promotional use at the discretion of Market Square Shopping Centre for the use of promotion and must notify Centre Management if they do not wish their photo be to be used or taken.
Where personal data is collected as part of the redemption process, the personal data will be handled strictly in accordance with current Privacy Legislation. Market Square’s privacy policy can be found at http://www.marketsquaregeelong.com.au/privacy/
When personal data is collected, participants will be joined up to the Market Square VIP Club Membership program and will receive marketing communications from Market Square.
Freebies must be redeemed on the day of redemption. Freebie is void if it’s not collected or redeemed on the day of promotion.
Failure to use the freebie forfeits the freebie and the promoter or its associated agencies take no responsibility for loss, damage or unused freebies.
If the participant is unable to comply with The Promotion’s terms and conditions, then they forfeit the redemption.
Redemptions are non-transferable and cannot be exchanged for cash or sold.
If The Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to disqualify any participant.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of the offer.
The Promoter may collect personal information in order to conduct The Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, offer suppliers and as required, to Australian regulatory authorities. By submitting an entry into this competition, entrants consent to receive promotional and other marketing messages from the Promoter. Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.
How To Enter

To enter eligible individuals must, during the Promotional Period (defined in clause 13):

To be considered a valid entry, a valid name, email address, suburb, DOB and mobile number must be provided.
Entrants will also receive a bonus entry for each user that clicks and enters the competition from an entrant’s shared link when entering via the Facebook address in clause 7b or through using the unique URL sent in the Market Square VIP enewsletter.
Subject to clause 9, only one entry per valid email is allowed.
The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Open, Close, Draw and Publish dates

Promotion commences 1 January 2017 at 10am and closes 31 January 2017 at 9am (‘Promotional Period’).
The winners will be drawn randomly on the 31 January 2017 at 10am and notified on the same day by phone. If a winner cannot be notified by 9am on the 5 February 2017, a new winner will be drawn and notified.

Winner’s name will be published on the Market Square website and other social media outlets operated by Market Square Shopping Centre at the discretion of the promoter (Market Square).
In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the Promoter a perpetual and non-exclusive license to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.
All eligible entrants will be joined up to the Market Square VIP Club Membership program and will receive marketing communications from Market Square Shopping Centre.
