Terms and Conditions: “Win a ‘HYUNDAI ACCENT’ Promotion”
1. Informa+on on how to enter and the prize form part of these Terms and Condi+ons. By participating in this promo+on each entrant accepts these Terms and Condi+ons.
2. The Promoter is Melbourne United Basketball Club Pty Ltd (“Promoter”) ABN 42 158 938 624. The prize is provided by Automo+ve Holdings Group (Victoria) Pty Ltd (ABN 12 158 935 249) of 32-42 Johnson Street, South Melbourne, Victoria 3205 (“AHG”).
3. The Promo+on Period commences at 11am Melbourne time on Monday 23rd January 2017 and closes at 11am Melbourne +me on Monday 31st July 2017.
4. Entry is only open to Australian residents over the age of 18 who fulfill the entry requirements (as outlined in point 5). Employees, directors, management, licensees and contractors of the Promoter, of AHG, or their related bodies and adver+sing agencies are ineligible to enter.
5. To enter the promo+on, an entrant must, during the Promo+onal Period:
a) Enter the following details into the form found on the Melbourne United Website:
1. Full name
2. Email address
3. Address
4. Mobile Phone Number
5. Date of Birth
6. The draw will take place on the closing day of the Promo+on Period at Level 3, 1001 Nepean Highway, Moorabbin. All valid entries will be collated and a winner will be drawn at random through a digital mechanism. As soon as possible a`er the draw, the Promoter will aaempt to contact the person iden+fied in the winning entry using the informa+on provided in the entry (as outlined in point 5), including by:
a) SMS and mobile phone call to the originating number of the SMS for the winning entry;
b) email to the email address identified in the winning entry.
If the winner cannot be contacted within 2 Business Days of the draw by any of the above means, the entry will be invalidated and a further entry drawn.
7. In the event that the first entry is invalid (due to false, incorrect or incomplete details, not fulfilling the entry requirements as set out at point 5 above, or as a result of the promoter being unable to contact the winner in accordance with point 6 above) a further entry will be drawn at random. This will con+nue until a valid winning entry is drawn.
8. Only one entry per email address will be permiaed.
9. The winner’s name will be published on Monday 31st July 2017 on the following websites for at least 28
days:
a) the Melbourne United website:
www.melbourneutd.com.au; and
b) the AHG VIC website:
www.ahg.com.au/vic.
The winner’s name will also be published on Melbourne United’s social media platforms.
10. The prize is a new 2017 Hyundai Accent SR Hatch - Auto valued at $18,990 (including all compulsory on-road costs).
The prize must be collected by the winner of the promotion, at an agreed time within 28 days of the
draw, at Melbourne City Hyundai, 37-39 Brady St, South Melbourne VIC 3205.
11. Incomplete, indecipherable or illegible entries will be deemed invalid. No responsibility will be accepted for lost, late, illegible or misdirected entries.
12. The Promoter reserves the right, at any +me, to verify the validity of entries and entrants (including the entrants’ iden+ty, age and place of residence), and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Condi+ons or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discre+on. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
13. If there is a dispute as to the iden+ty of an entrant, the Promoter reserves the right, in its sole discre+on, to determine the iden+ty of the entrant.
14. Entry into the promo+on is deemed as approval to use the winner’s name(s) and photograph(s) for publicity purposes. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of publicising this promo+on (including any outcome), and promo+ng any products and/or services supplied by the Promoter or by AHG.
15. If this promo+on is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties or unauthorised interven+on or fraud, the Promoter reserves the right, in its sole discre+on, to the fullest extent permiaed by law: (a) to disqualify any entrant; or (b) subject to any wriaen direc+ons from a regulatory authority, to modify, suspend, terminate or cancel the promo+on, as appropriate.
16. Nothing in these Terms and Condi+ons limits, excludes, modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Compe++on and Consumer Act, as well as any other implied warran+es under the ASIC Act or similar consumer protec+on laws in the State and Territories of Australia (“Non-Excludable Guarantees”).
17. Except for any liability that cannot by law be excluded, including Non-Excludable Guarantees, the Promoter (including its respec+ve officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequen+al, arising in any way out of: (a) any technical difficul+es or equipment malfunc+on (whether or not under the Promoter’s control); (b) any the`, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not a`er their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any varia+on in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
18. Privacy No+ce: The Promoter collects your personal informa+on so you can enter, and the Promoter can administer, this promo+on. Your personal informa+on is required for the Promoter to contact you in the event that you submit the winning entry. The Promoter and AHG may also use your informa+on for future marke+ng and promo+onal purposes. Your personal informa+on will only be disclosed to the Promoter, to AHG, and to their related corporate bodies for these purposes.
19. All entries become the property of the Promoter.
