Seven West Travel Club Competition ‘Camera Electronic Drone and DSLR Camera Package’
Terms and Conditions
1. Instructions on how to enter, prize details and other information contained within the promotional advertisements form part of these terms and conditions. By participating, in this promotion entrants agree to be bound by these terms and conditions.
2. Only those who are members (Gold or Standard) at
www.sevenwesttravelclub.com.au and enter their details via the competition portal between 11.59pm Friday 16 June and 11.59pm Sunday 02 July 2017 will be eligible to enter the competition.
3. Entry is open to all residents of Western Australia 18 years and over. Photo identification may be required upon collection of the prize.
4. The prize winner will be drawn at 10am on Monday 03 July, 2017.
5. The first entrant drawn at random will be deemed the winner and will receive the following prize.

8. These Terms, together with: (a) any Trade Application you completed and submitted to Camera Electronic; (b) any Guarantee(s) You completed and submitted to Camera Electronic; (c) each Quotation provided to you by Camera Electronic, whether signed or not; and (d) any special terms specific to the Quotation you have received from Camera Electronic and any other work authorisation or other forms make up the agreement (the "Agreement") between you and Camera Electronic. It is important that you read and understand all of the terms and conditions of the Agreement. If you have any questions please ask Camera Electronic.
9. Camera Electronic agree to supply the Goods and Services for you according to the Quotation to a reasonable standard.
10. Nothing in this Agreement is intended to have the effect of seeking to contract out of any applicable provisions of the Competition and Consumer Act 2010 and similar applicable legislation in each of the States and Territories of Australia, except to the extent permitted by those Acts where applicable.
10.1 Camera Electronic may vary its advertised prices at any time without notice.
10.2 Stock levels are shown on Camera Electronic’s website as an indication only and are not updated live.
10.3 Products shown on the Camera Electronic website are for reference only and the actual product may differ from the website image and description.
11. Any instructions received by Camera Electronic from you whether written or verbal for the supply of the Goods and Services shall constitute the acceptance of the terms of this Agreement.
11.1 Your liability to Camera Electronic under this Agreement shall be joint and several if you constitutes more than one contracting party to this Agreement.
11.2 The terms of this Agreement override and take priority over all earlier dealings between you and Camera Electronic, the terms of any purchase order placed by you or any other conditions that you seek to incorporate into any agreement between you and Camera Electronic.
11.3 You agree that the Terms of this Agreement cannot be excluded or overridden except by the signed and written authority of one of Camera Electronic’s Directors that is clearly marked to be a variation to this Agreement.
11.4 An order by you for the supply of Good and Services may only be cancelled by you with the written consent of Camera Electronic.
11.5 The Terms of this Agreement shall apply to all Goods and Services supplied by Camera Electronic to you including repairs, rentals and training.
12. You will indemnify Camera Electronic on an actual indemnity basis absolutely against all losses (including but not limited to Consequential Loss), damages, claims, demands, suits, actions, proceedings, orders or judgments whatsoever arising out of or in respect of the provision of the Goods and Services by Camera Electronic for you.
13. Notwithstanding anything to contrary in the Agreement (a) Camera Electronic will not be liable to you, or any third party, for any loss or damage (including but not limited to Consequential Loss) howsoever caused in the supply of Goods and Services; and (b) Camera Electronic’s liability under or in connection with the Agreement is limited an amount equal to the cost of Goods and Services actually supplied.
13.1 If any event arises which is likely to lead to any dispute or claim, you must notify Camera Electronic in writing of the same within fourteen (14) days of the event. If you shall fail to comply with this provision then all Goods and Services provided by Camera Electronic shall be deemed to have been provided in accordance with this Agreement and free from any disputes or claims.
13.2 This Agreement does not seek to exclude liability for matters for which liability cannot be excluded under Australian legislation.
14. You must inspect equipment delivered by Camera Electronic upon receipt and advise Camera Electronic of any faults or shortages within 48 hours.
14.1 If inspection of our Equipment upon receipt is not possible you must note on the carrier’s receipt that inspection of the Equipment has not taken place and in these circumstances you must advise Camera Electronic of any faults or shortages within 72 hours of delivery.
14.2 You agree that Camera Electronic is not responsible for determining the fitness for a particular purpose of the Goods and Services unless Camera Electronic has stated in writing in advance of a contract for the provision of Goods and Services that the Goods and Services are fit for a particular purpose. You agree that you are responsible for determining the type of Goods and Services that you require.
14.3 Goods supplied shall have the benefit of any warranty given by a manufacturer.
15. Camera Electronic will not be responsible for any delays in delivery, installation or collection of Equipment or the provision of Camera Electronic’s Goods and Services due to causes beyond Camera Electronic’s control including but not limited to acts of God, war, terrorism, mobilisation, civil commotion, riots, embargoes, orders or regulations of governments of any relevant jurisdiction, fires, floods, strikes, lockouts or other labour difficulties, shortages of or inability to obtain shipping space or land transportation.
16. It is a condition of entry that all prize winners agree to have their name and suburb published for publicity purposes if required. By participating in this competition, participants signify their acceptance of all terms and conditions, and the requirement to participate in promotional activity if required.
17. All contestants release from, and indemnify Seven West Media against, all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the competition including (but not limited to) loss of income, personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.
18. Seven West Media and associated agencies accept no responsibility for any loss, damage, accident, death or injury resulting from the promotion.
19. The Promoters reserve the right to disqualify any individual who the promoters believes have breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct. The Promoters have legal rights to recover damages or other compensation from such an offender.
20. The Promoters’ decision will be final and cannot be contested. No correspondence will be entered into. The Promoters reserve the right to limit entry or amend rules if considered necessary without notice.
21. The Entrant consents to the use by West Australian Newspapers Limited, its related corporations (as defined by the Corporations Act 2001), of the Entrant’s details and acknowledges that West Australian Newspapers Limited and related corporations may, at their discretion disclose and use those details for the purpose of providing them with goods or services, communicating with Entrants, planning, research, product and business development and sales, the competition and marketing (whether target, direct or indirect) of their businesses, services or products or those of a third party which it believes may be of benefit to them.
22. Employees of Seven West Media, their subsidiaries, their advertising agencies, participating newsagents and resellers of The West Australian and The Weekend West newspapers, and their immediate families are ineligible to enter.
23. If an Entrant does not want their details to be used for the purposes stated in the above clause please write to The West Australian email
privacy@wanews.com.au or post to Privacy Officer, GPO Box D162 Perth WA 6840 and West Australian Newspapers Limited will ensure that the details are not used for that purpose.
24. The details will also be used to investigate complaints, as required or permitted by any law, to enable West Australian Newspapers Limited to perform their obligations under this or any other agreement and to ensure that an Entrant performs their obligations under this or any other agreement.
25. To access personal information kept by Seven West Media please refer to the Privacy Policy. Please note that information will only be provided to the person detailed and current photographic identification may be required prior to the release of any personal information.

27. On completion of the prize draw, all entries will be stored for a 12 month period at The West Australian. This is a mandatory requirement of the Gaming and Wagering Commission Act 1987.
