Terms & Conditions of Entry.
To be eligible to enter, entrants must purchase, an Eligible Vehicle (as defined in clause 2) from Mercedes-Benz Brisbane, Mercedes-Benz Fortitude Valley, or Mercedes-Benz Windsor showrooms between 8.00am AEST on 6 July 2017 and 6.00pm AEST on 31 August 2017.
"Eligible Vehicles" include new, demo, certified pre-owned or light commercial vehicles, but excludes C-Class (new & demo), GLA Facelift, E-Class Coupe, E-Class All Terrain, Plug-in Hybrid models, S-Class, SL, G-Wagon, E43, V8 & V12 vehicle variants.
To be eligible to enter, the Eligible Vehicle must be delivered to the customer's address, or collected from the showroom by the customer, on or before 31 August 2017.
Eligible Vehicles that have been purchased but not been delivered to, or collected by, the customer on or before 31 August 2017 will not be eligible for entry.
Customers that purchase an Eligible Vehicle may opt-in to the promotion at the time of purchasing an Eligible Vehicle during the promotion period. Customers are required to provide their full name, address, phone number, email address and age.
Conditions of entry
Information on how to enter and prizes form part of these conditions of entry. Submission of an entry is deemed acceptance of these conditions of entry.
Entry is only open to Queensland residents aged 18 years or over.
Eligible entrants must be within the Promoter’s trading terms throughout the promotional period and must not have overdue monies owing as at the 1 September 2017 in order to be eligible to claim any prize.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. [TG1]
Promotion commences 6 July 2017. Entries close and must be received by 6.00pm AEST on 31 August 2017. The draw will take place at 824 Ann Street, Fortitude Valley QLD 4006 on 1 September 2017 at 10.00am.
The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable, illegible or inaudible entries will be deemed invalid.
Any incorrect details submitted may render the corresponding entry invalid.
Only one entry permitted per person.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The winner will be notified by email and/or telephone and their name will be published on the Facebook and Instagram pages of the Promoter and/or the relevant showroom on 5 September 2017. The winner will also have their name published in Electronic Direct Mail on 5 September 2017.
The first one (1) valid and correct entry drawn will win a cash prize in the amount of the purchase price paid by the winner for the Eligible Vehicle (excluding additional options and accessories). The prize includes the cost of all compulsory on-road costs and insurances, including GST. However, the prize excludes the cost of any additional options or accessories, additional insurance (i.e. comprehensive), petrol and all other ancillary costs.
The cash prize will be awarded in the form of bank transfer to the winner's nominated bank account. The winner will be required to attend the showroom where their Eligible Vehicle was purchased to complete various documents, including providing details of their nominated bank account.
If for any reason whatsoever beyond the reasonable control of the Promoter, the promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to cancel, suspend, modify, terminate or cancel the promotion.
Unless expressly stated within these Conditions of Entry regarding all prizes, all other expenses become the responsibility of the winner.
If required, an unclaimed prize draw may take place on 1 December 2017 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner’s name will be published on the Facebook and Instagram pages of the Promoter and/or the relevant showroom on 5 December 2017. The winner will also have their name published in Electronic Direct Mail on 5 December 2017.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are the winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Nothing in these Conditions of entry limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Conditions of entry would contravene any statute or cause any part of these Conditions of entry to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these Conditions of entry all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise, for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax implications; (e) any variation in reward value to that stated in these Conditions of entry; (f) any tax liability incurred by a successful claimant or entrant and/or (g) a prize or use of a prize.
The laws of Queensland, Australia apply to this promotion to the exclusion of any other law. Entrants submit to the jurisdiction of the courts of Queensland, Australia.
