TERMS AND CONDITIONS
1. The promoter of the Lucky Draw is the ATC of Royal
Randwick Racecourse, Alison Road, Randwick, NSW
2031, telephone: +61296638400.
2. The Lucky Draw is a game of chance and not skill and
will be conducted randomly by computer generation.
3. Rules on how to enter the Lucky Draw form part of
these Terms and Conditions of entry. By entering the
Lucky Draw or accepting a prize, entrants agree to be
bound by these Terms and Conditions.
4. Entry to the Lucky Draw will be refused or disqualified
if an entrant does not comply with these Terms and
Conditions. The ATC reserves the right to verify the
validity of entries and reserves the right to disqualify
any entrant for tampering, or attempting to tamper, with
the entry process.
5. To be eligible for the Lucky Draw, entrants must be a
financial Member of the ATC and must be 18 years of
age or more on the day of the Lucky Draw. The ATC
may request proof of age at any time.
6. The Lucky Draw commences at 00.00 (AEST) on
Monday, 16 October 2017 and closes at 23.59 (AEST)
on Sunday, 31 December 2017.
7. Officers, management and staff and their immediate
families of the ATC are not eligible to enter the Lucky
Draw.
8. To be included in the Lucky Draw an entrant must join
or renew to be a Member of the ATC. Every new
Membership application or renewal Membership
application received and processed by the ATC will
automatically entitle the entrant to enter the Lucky
Draw. Entrants may only enter the Lucky Draw once. If
more than one entry is received from an entrant, only
the first received valid entry will be valid.
9. The Lucky Draw will take place in the Administration
building at Royal Randwick Racecourse on Monday,
8 January 2018 at 14.00 pm and will be conducted
by the ATC and scrutinised by an independent
scrutineer. The ATC will use its best endeavours to
notify the winning entrant by telephone and will
publish the winner’s name in the ATC’s members’
electronically delivered messages (EDM) on
Thursday, 11 January 2018.
10. The intended prize for the winner of the Lucky Draw is
a tour prize package consisting of the following:
A racing tour for two (2) adults (must be over
18), to Hong Kong valued at AU$10,000. Tour
includes;
o Return Economy Qantas flights
Sydney to Hong Kong.
o 6 nights twin share accommodation at the
luxury Hotel including breakfast daily
o Welcome dinner with racing industry
special guest
o Premium hospitality at the Longines
International Jockeys Championship at
Happy Valley
o Premium hospitality at Longines Hong
Kong International race day at Sha Tin
o Trackside breakfast with the stars at Sha
Tin
o Hong Kong Highlights tour including lunch
and visit to Stanley market
o Optional day trips to Macau, Shenzhen or
Lantau Island (additional cost applies)
The maximum retail value of the prize in this Lucky
Draw is AU$10,000. Prize value is correct as at the
date of printing. The Promoter accepts no
responsibility for change in prize value between the
date of printing and the ultimate date on which the
prize is taken. All prizes must be taken as offered.
Prizes cannot be transferred, exchanged or
redeemed for cash.
11. The results of the Lucky Draw will be published on the
ATC website (theATC.com.au) on Monday, 8 January
2018 and in an ATC Membership EDM on Thursday,
11 January 2018.
12. The winner and travelling companion must be able to
leave and travel on 4th of December 2018 and return
10th December 2018, (dates are currently TBC for
2018, approximate dates for travel listed above) or
dates specified by the tour operator once confirmed,
and have a current passport with at least six months
validity based on date of entry back to Australia
remaining on the passport. Unused tickets after the
specified dates will be deemed null and void and no
longer valid. Once nominated by the winner, the
travelling companion is not transferable. The winner
and travelling companion will have all travel arranged
by the Tour Operator or as nominated by the
Promoter. Once booked any changes made to the
booking may incur a cancellation fee or amendment
fee, at the cost of the winner. To claim the prize, the
winner must contact Keith Prowse Travel on 1300 730
023, once being contacted by the Australian Turf Club
notifying them of their prize.
13. Separate conditions apply to gift voucher prizes. The
gift vouchers cannot be used to make credit
payments. The gift vouchers apply to full price
merchandise and cannot be used in conjunction with
any other sales, special offers or discounts otherwise
offered by the entity who issues the gift vouchers.
14. All entries become the property of the ATC. Entries
not completed in accordance with the conditions of
entry or received after the closing date will not be
considered. Indecipherable or incomplete entries will
be disregarded. No responsibility is taken for late or
misdirected entries.
15. An entrant must not enter the Lucky Draw on behalf
of any other person or accept payment or other
compensation from any person to enter the Lucky
Draw.
16. In the event an element of the prize is not available, a
replacement product to equal or greater value will
apply, subject to state government legislation. Prizes
unclaimed after a period of four weeks from the date
of notification of the winner may be forfeited and used
by the ATC at the discretion of the ATC. Conditions
apply to travel and accommodation prizes. These
prizes must be taken as specified. Timing is subject
to availability.
17. Frequent flyer miles cannot be accrued on the prizes.
Flights, Cruise and accommodation are subject to
availability at the time of booking and cannot be
exchanged for other destinations.
18. The ATC may conduct a redraw if an entrant does not
comply with or satisfy these Terms and Conditions or
forfeits or rejects the intended prize or is unable to
accept or enjoy the prize in accordance with its terms.
This redraw will take place one week after the ATC
contacts the first draw winner. Otherwise if the ATC
cannot contact the first draw winner or the prize
otherwise remains unclaimed within 3 months after
the original draw, a second chance draw will be held
by the ATC in the Administration building at Royal
Randwick Racecourse on Monday, 9 April 2018 at
14.00 pm subject to any written directions given under
applicable law. Any second chance draw winner will
be notified by email within 2 days and have their name
published on the ATC website theATC.com.au.
19. Entry details remain the property of the Promoter.
Entrants' personal information provided in connection
with this Lucky Draw will be handled by the ATC in
accordance with the ATC's Privacy Policy, which is
available at
http://www.theATC.com.au. The
personal information collected as part of the entry is
collected for the purposes of facilitating the conduct of
the promotion and awarding the prize and for future
publicity, marketing and promotional purposes. The
ATC may enter all personal information provided in
relation to the Lucky Draw and other related
documentation into a database. An entrant's personal
information will only be used by or disclosed to the
ATC and its related bodies corporate, agents and
contractors for these purposes. The entrant may opt
out of receiving future publicity, marketing and
promotional material by emailing “opt out” to
members@australianturfclub.com.au .
20. All survey forms and related documentation become
the property of the ATC.
21. In accepting the prize, entrants agree they may be
filmed, photographed and/or interviewed and that
their names and images may be used by the ATC, its
sponsors and other third parties for future
promotional, marketing and publicity purposes for no
fee unless the winner otherwise notifies the ATC at
the time of accepting the prize.
22. The winner of the Lucky Draw agrees to be available
for at least one photo shoot and one public
appearance at the request of the ATC during 2018.
The photo of the winning member will be published in
the ATC website and distributed in the ATC
Membership EDM.
23. The winner and travelling companion agree they will
not sell or otherwise provide their story and/or
photograph to any media or other organisation without
the Promoter’s prior written approval.
24. It is a condition of accepting the prize package that
the winner and travelling companion must comply with
all the conditions of use of the prize package and the
Promoter’s requirements.
25. The winner and travelling companion must travel on
the same flight at the same time and are responsible
for transport from their residence to Sydney airport for
flight departure to Hong Kong and return back to their
residence after the flight back from Hong Kong. The
Promoter will not be liable for any cost arising from or
otherwise related to delays or cancellations to any
flights, cruise or other travel booked by the winner.
26. Unless expressly stated in these Terms and
Conditions all other expenses related to the prize
become the responsibility of the winner and travelling
companion. Subject to the prize package stipulated in
clause 10, the winner and travelling companion are
responsible for all expenses including but not limited
to airline fuel surcharges and departure taxes,
spending money, transfers, telephone calls, activities,
meals and beverages, insurance, passports and other
ancillary costs. A credit card imprint or cash deposit
may be required from the winner on the cruise ship for
all incidental charges
27. The winner is responsible for ensuring that all those
travelling have valid passports and applicable visas.
The Promoter will not be held responsible for any loss
or delay that may occur as a result of any passport or
visa not being produced in time for travelling.
28. Compliance with any health or other government
requirements is the responsibility of the winner and
travelling companion.
29. Travel insurance is not included in the cost of the prize
package and is recommended to protect against the
additional costs in the event of unforeseen
circumstances.
30. All prize travel will be subject to the carrier’s General
Conditions of Carriage. The Promoter and carrier
make no representation as to the safety, conditions or
other issues that may exist at any destination.
International travel advice can be obtained from
various sources, including local government, local
consular offices and the website of the Australian
Department of Foreign Affairs and Trade at
www.smartraveller.gov.au31. The Promoter may require the winner to sign a waiver
of liability and indemnity in the form determined by the
Promoter in its absolute discretion,
32. If for any reason a Lucky Draw promotion is not
capable of running as planned (including, without
limitation, due to infection by computer virus, bugs,
tampering, unauthorised intervention, fraud, technical
failures or any other causes beyond the control of the
ATC which corrupt or affect the administration,
security, fairness, integrity or proper conduct of this
promotion), the ATC will not be liable for any failure to
perform or delay in performing its obligations and
reserves the right (subject to any written directions
given under applicable law) to cancel, terminate,
modify or suspend the Lucky Draw. The ATC is not
responsible for any malfunction, delay or traffic
congestion on any telephone network or line,
computer on-line system, servers or providers,
computer equipment, software, or website.
33. The ATC makes no representations or warranties as
to the quality, suitability or merchantability of any
goods or services offered as prizes. The ATC, Prize
Sponsor and their related bodies corporate, their
officers, employees, agents and sponsors will not be
liable for any loss, damage, costs or personal injury
whatsoever (including but not limited to direct, indirect
and consequential loss, or loss of profit or any other
economic loss) suffered or sustained by any person or
property, by reason of any act or omission, deliberate
or negligent, in connection with the Lucky Draw, the
promotion and advertising of the Lucky Draw,
downloading any materials in a Lucky Draw, or
accepting or the use of any prize, except for any liability
which cannot be excluded by law (in which case that
liability is limited to the minimum extent allowable by
law).
34. If any act, omission, event or circumstance occurs
which is beyond the reasonable control of the ATC
and which prevents the ATC from complying with
these Terms and Conditions, the ATC will not be liable
for any failure to perform or delay in performing its
obligations and the ATC reserves the right (subject to
any applicable law) to cancel, terminate or modify or
suspend this promotion.
35. Independent financial advice should be sought as tax
implications may arise as a result of accepting the
prize.
36. The ATC's decision in relation to any aspect of the
Lucky Draw is final and binding on every entrant. No
correspondence will be entered into.
37. These Terms and Conditions are governed by the
laws of New South Wales and entrants agree to
submit to the non-exclusive jurisdiction of the Courts
of New South Wales.
38. The Promoter may vary these terms and conditions at
its discretion, subject to state government legislation.
39. The Lucky Draw is authorised under NSW Permit No.
LTPS/17/18457
