TABASCO® ‘WIN A TABASCO® SUMMER PRIZE’ COMPETITION
FULL TERMS AND CONDITIONS
Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
Entry is open to residents of Australia aged 18 years and over. Employees and their immediate families of the Promoter, its agencies and stores associated with this competition are ineligible to enter. This promotion is limited to stores that have been invited by the Promoter to participate and which display advertising for this promotion ("Participating Store").
The competition commences at 00.01 EDT on 23/10/2017 and closes at 23.59 EDT on 17/12/2017 (“Promotional Period”). Entries received after 23.59 EDT on 17/12/2017 will not be accepted.
To enter:
purchase any TABASCO® product from a Participating Store during the Promotional Period (“Qualifying Purchase”) to receive a guide to entry leaflet;
visit
www.wintabascoprizes.com.au and access the online entry form for this promotion;
fully complete all sections of the online entry form (including first name, last name, street address, email address, date of birth, mobile number last four (4) digits of the product barcode); and
submit the form during the Promotional Period.
Limit applies of one (1) entry per person per Qualifying Purchase.
Entrants must retain a clear copy of their original receipt as proof of valid purchase during the Promotional Period.
There are a total of 370 random electronic instant win prize draws that will occur during the Promotional Period and will take place at Aura Interactive Pty Ltd, Level 12, Suite 1203, 242 Elizabeth Street, Surry Hills, NSW 2010. The randomly selected entry of each prize draw will win a prize. Entrants will be notified upon submitting a valid online entry form, in accordance with clause 4 above, whether they have won an Instant Win Prize.
An instant win Prize will be either one (1) TABASCO® branded picnic blanket (RRP $55.00), or one (1) BBQ tool set (RRP $80.00), or one (1) retro cooler boxes (RRP $195.00), or one (1) Charmate Charcoal smoker and grill (RRP $220.00), or one (1) picnic basket (RRP $230.00), or one (1) $20.00 eftpos card (RRP $20.00). All taxes (excluding GST) which may be payable as a consequence of receiving a prize are the sole responsibility of the winner.
The Instant Win Prize Pool consists of seventy five (75) TABASCO® branded picnic blankets, forty (40) BBQ tool sets, twenty (20) retro cooler boxes, twenty (20) Charmate Charcoal smoker and grills, fifteen (15) picnic baskets and two hundred (200) $20.00 eftpos cards. The total instant win prize pool value is $23,075.00.
A major prize draw will take place at 13:00 EDT on 18/12/2017 at Aura Interactive Pty Ltd, Level 12, Suite 1203, 242 Elizabeth Street, Surry Hills, NSW 2010. All qualifying entries during the promotional period are eligible for the Major Prize Draw. The first entry drawn will win the major Prize.
The major Prize consists of one (1) Weber® Performer Premium Kettle (RRP $799.00), a BBQ tool kit (RRP $80.00) and a $200 eftpos card (RRP $200.00). The Total major prize pool value is $1,079.00.
The total prize pool value, including instant win and major prizes, is $24,154.00.
The winner(s) will be notified immediately by the Promoter via email, and major prize winners name will be published on
www.wintabascoprizes.com.au by 20/12/2017.
Prizes will be delivered to winners within thirty (30) days of the prize draw to the address provided in the online entry form. If address provided is incorrect and cannot be delivered, the Promoter will contact the winner by email to ask for the correct address. If the winner does not provide the correct address to the Promoter within a reasonable time, the winner will forfeit their prize and a re-draw will take place at 12:00EDT on 19/03/2018 at Aura Interactive Pty Ltd, Level 12, Suite 1203, 242 Elizabeth Street, Surry Hills. NSW 2010. Any replacement winners will be notified by email on or by 21/03/2018.
Prizes are not transferable and are not redeemable for cash. The Promoter’s decision is final and binding – no correspondence will be entered into. The Promoter assumes no responsibility for any failure to receive an entry or to provide the prize or for inaccurate information or for any loss, damage or injury as a result of technical, electronic or telecommunications problems, including security breaches or the provision of an inaccurate or invalid email address by entrants to this promotion. If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion.
The Promoter accepts no responsibility for late, lost or misdirected entries or other communications.
If any prize or any element of a prize becomes unavailable or is otherwise unable to be provided, the Promoter may substitute a prize or element of a prize of equal or greater value at the Promoter’s sole discretion, subject to any written directions from the relevant authorities. Winners will not be entitled to any additional compensation in the event that the prize or element of a prize has been substituted at equal or greater value.
The Promoter reserves the right to request verification of identity, residential address and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or is otherwise involved in any conduct that involves manipulating, interfering or tampering with this promotion or otherwise preventing the conduct of the promotion as intended by the Promoter. In the event of such problems or conduct, then the Promoter may modify, cancel, terminate or suspend the promotion.
The Promoter shall not be liable for any loss, damage or injury suffered by any winner as a result of the winner accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law. The prize is subject to the terms and conditions of Traction Promotions Pty Ltd ABN 94 537 518 936 and Edge Loyalty Systems Pty Ltd ABN 96 138 299 288. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of Traction Promotions Pty Ltd or Edge Loyalty Systems Pty Ltd or otherwise as a result of the winner accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including but not limited to technical difficulties, unauthorised intervention or fraud), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
Entrants further warrant and agree that:
they have full authority to grant the Promoter the rights referred to in these Terms & Conditions; and
they will indemnify the Promoter against all loss, damage and liabilities arising from a breach of any of the warranties in these Terms & Conditions.
Entrants consent to the Promoter using their name, image, entry, and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on Entrants providing their personal information. The Promoter will collect, store, use and disclose personal information as set out in its privacy policy, which can be viewed at

Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these terms and conditions; (e) any tax liability incurred by a winner or entrant; or (f) use or acceptance of a Prize.
