TERMS AND CONDITIONS – Pause Fest COMPETITION

1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. The promoter is IBM Australia Limited ABN 79 000 024 733 of 55 Coonara Ave, West Pennant Hills NSW, 2120 ("Promoter").

3. Entry is only open to Australian residents.

4. If an entrant is under the age of 18 years, the entrant must have his or her parent or guardian's consent to enter this Promotion. The Promoter reserves the right to request this consent in writing.

5. Minors may use the Prize, but they must be accompanied by a person over 18 years when doing so, and have consent from their parental or legal guardian (which the Promoter may request in writing).

6. A parental or guardian consent must include:

(a) consent to the matters referred to in these Terms; and

(b) the words "inconsideration of the Promoter agreeing to admit the entrant into this Promotion, [name of Parent or Guardian] agree to be bound by the Terms of entry into the Promotion".

7. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

8. Promotion commences on January 25th, 2018 at 9:00 am, Australian Eastern Savings Time (AEST) and closes on January 30th 2018 at 5:00 pm AEST. (“Promotional Period”). The Promoter reserves the right to suspend or terminate the competition, extend the closing date or amend these Terms and Conditions.

9. To enter, individuals must, during the Promotional Period:
a) To enter via Facebook, comment below the competition post with a response to “Why do you want to join IBM at Pause Fest?”; and/or
b) To enter via Twitter, reply to @ibmaustralia with a response to “Why do you want to join IBM at Pause Fest?”, or comment below the competition tweet with a response to Why do you want to join IBM at Pause Fest?”.

10. Entrants can only enter the Promotion in their own name, via their own personal valid Twitter or Facebook account.

11. Incomplete, incorrect or indecipherable entries will be deemed invalid.

12. One entry per person permitted, subject to the following: (a) each entry must be substantially unique;.

13. Any entrant using multiple accounts to enter this Promotion is ineligible to enter and will be disqualified. Multiple entries in a single day on the same social media platform will not be accepted.

14. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

15. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

16. This is a game of skill and chance plays no part in determining the winner. Judging will be conducted by a representative of the Promoter. Each entry will be individually judged based on the originality, literary merit and creative merit of the answer provided to the promotional question.

17. The best valid entry, as determined by the judges in their sole discretion, will win the prize ("Winner").

18. The judging of valid entries received during the Promotional Period will take place between 9:00am – 5.00pm AEST on January 31st , 2018 at the Promoter’s premises. The judges may select additional reserve entries which they determine to be the next best, and record them in order of merit, in case of an invalid entry, ineligible entrant or if the original Winner is are unable to be contacted in accordance with clause 20.

19. The Prize includes two 3 day passes (2x tickets) to Pause Festival 2018 valid from 7th to 11th February 2018 ("Prize"). Each ticket is worth $850 (incl. GST) and the total prize is worth $1700 (incl. GST).

20. The Winner will be notified by DM and/or email and telephone, if provided, on the 5th February

21. If the Promoter is unable to contact the Winner and/or if the Winner does not respond to the Promoter's notification by 5.30pm AEST on 5th February 2018, the Winner will forfeit the Prize in its entirety and the Prize will be awarded to the next best valid entry, as determined by the judges in their sole discretion ("Second Draw Winner"). The Second Draw Winner will be notified by the Promoter by 11.00pm AEST 6th February 2018.

22. If the Promoter is unable to contact the Second Draw Winner and/or if the Second Draw Winner does not respond to the Promoter's notification by 5.00pm AEST 6th February 2018, the Prize will be forfeited in its entirety.

23. The Promoter’s decision is final and no correspondence will be entered into.

24. The Prize includes the ticket entry only. All other costs associated with the Prize, including any transportation, lodging or transfers, are the responsibility of the Winner.

25. The Prize will be available for the Winner to collect via the ticket collection area at the entrance of Pause Fest. The Promoter will provide the Winner with instructions and their contact details in finding the ticket collection area.

26. If the Winner is unavailable to attend the Pause Fest event, they may nominate an individual to attend Pause Fest in their place. They must provide the Promoter with the full name of the individual in writing and the individual will be required to present photograph identification and prove their identity to the Promoter upon collection of the Prize and attendance Pause Fest ticket collection area.
27. If for any reason the Winner (including a Second Draw Winner) does not take the Prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

28. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification.

29. Each entrant warrants to the Promoter that the answer to the promotional question submitted in each entry is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty.

30. The entrant warrants and agrees that he or she will not submit any content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication.

31. As a condition of entering this promotion, each entrant licenses and grants the Promoter, their affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry for any purpose, including but not limited to the purposes of uploading and publicly displaying the entries, promoting this promotion, and/or any future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

32. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

33. The Promoter accepts no responsibility for any entries not received for any reason during the Promotional Period. Entries will be deemed to be accepted at the time of receipt by the Promoter. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.

34. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.

35. Any cost associated with accessing Facebook and Twitter is the entrant’s responsibility and is dependent on the Internet and/or mobile service provider used.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in the prize.

38. As a condition of accepting the Prize, the Winner (and his/her companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. The Winner’s companions under the age of 18, must have a nominated parent/legal guardian sign the legal documentation required under this clause on their behalf.
