Participation in the above named promotion (Promotion) is deemed acceptance of these Terms and Conditions. Information about prizes and how to enter forms part of these Terms and Conditions.
Entry is only open to Australian residents who, as at the start of the Promotion Period, are at least 18 years of age and who are able to book the prize by 30 November 2019. Employees of the Promoter, Grin Creative, AirAsia, Urban Adventures and agencies associated with this Promotion (and their immediate families) are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promotion commences on 18 February 2019 and closes at 11:59pm AEDT on 23 May 2019 (Promotion Period). No late entries will be accepted.
To enter, individuals must, during the Promotion Period:
a. obtain the Avalon Inbound | Outbound magazine that is available for free from Avalon Airport and participating outlets;
b. read the promotional pages in the magazine that will enable the individual to answer the questions on the Online Entry Form;
c. visit

d. fully complete and submit the Online Entry Form, including by answering all asterisked questions and responding to the creative response question.
Your entry must be received during the Promotion Period and will be deemed to be received only when received by the Promoter. You will receive a return message confirming your entry. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.
There will be 1 (one) winner determined. Entries will be judged by an internal panel at Avalon Airport’s head office on 27 May 2019, based on among other things, creativity and originality of creative responses. This is a game of skill. Chance plays no part in determining the winner. The valid entry judged to be the best will win the prize. All judging decisions are as determined by the Promoter, in their absolute discretion.
The winner will receive:
a. four (4) return AirAsia Standard Seat airfares (for the winner and 3 companions) from Avalon Airport to Kuala Lumpur, Malaysia; and
b. the choice of EITHER the Urban Adventures Market Tour OR the Urban Adventures Food Experience.
The Prize and all elements of the prize must be booked as offered by 30 November 2019 or will be forfeited, and if forfeited, the Promoter will not be liable. The Urban Adventure must be booked as per the Urban Adventures voucher. It is up to the winner to ensure that the chosen adventure is available to match the dates of the flights. The Promoter will not cover the cost of re-booking flights if the winner makes an error in this regard.
Prize/s are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including, as relevant:
a. validity period/s;
b. booking and availability of flights, accommodation and activities;
c. conditions of travel and conditions of entry into any event venues (including behaviour requirements and applicable dress codes);
d. conditions of ticket validity and any restrictions on ticket on-sale or transfer;
e. travel dates and specified travel exclusion periods;
f. any additional fees (payable by the winner) relating to changes made by the winner/companion to a prize after it has been booked;
g. the requirement to obtain all necessary documents to travel to the destination specified, including a current and valid passport and any visas required;
h. a requirement to present a credit card when checking in to accommodation; and
i. a requirement that any person taking the prize that is aged under 18 years old must be accompanied by their parent or guardian at all times.

The winner/companions are responsible for all other unspecified costs related to the prize, including accommodation, meals, transport to and from Avalon Airport, transport at the destination, parking, insurance (including excesses), in-room charges, additional taxes, etc.
Where relevant, the Promoter accepts no responsibility if any activity awarded as part of the prize is abandoned, called off or postponed for any reason. In that case, the winner/companions forfeit their entitlement to that activity. Unless otherwise specified by the Promoter, the winner will not be given cash or any alternative prize as a substitute for this altered prize element.
Total prize value is up to AU$6480 for flights and AU$320 for the Urban Adventure. This is the maximum value. If the two flights and the Urban Adventure do not use up complete value, no change, vouchers or alternative prizes will be provided.
The winner will be contacted by email and/or phone on 27 May 2019. The winner must respond within 5 (five) business days of being notified to verify their details (name, address, phone number, email address and date of birth) in order to claim the prize.
A person may enter the competition once only. Any further entries will be discounted.
Every entry, including creative responses, must be the entrant's original work and not copied.
The Promoter may copy and amend entries (including creative responses) and may use (or allow others to use) entries and any rights in relation to entries, to publicise this competition or for any other purpose. These rights are perpetual, royalty free, world-wide, irrevocable and transferable. For example, the Promoter may publish all or any part of an entry or any amended version of it. The Promoter may also decide not to publish an entry, to cease publication of an entry, or to publish an edited entry.
Entrants warrant that their entry does not breach any third party rights (for example, intellectual property rights) and its use by the Promoter or any other person will not breach such rights nor otherwise breach any law (for example, it is not defamatory, in contempt of court or in breach of any privacy law). Entries must not be obscene, offensive, malicious, discriminatory, indecent or (in the Promoter's opinion) otherwise objectionable or inappropriate (for example it must not include nudity or language the Promoter deems offensive).
The following entries will be deemed invalid: duplicate, incomplete, incorrectly submitted or indecipherable entries, entries which include profanity or nudity, entries which share personal details other than those requested on the Online Entry Form.
The Promoter reserves the right to verify the validity of entries and entrants (including requiring entrants to produce documentation to establish to the Promoter's satisfaction their identity, age and place of employment) and reserves the right to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
The Promoter’s decision is final and no correspondence will be entered into.
The prize is not transferable, exchangeable or redeemable for cash. The prize is only valid for the period specified. The Promoter does not control entry to the prize location. If for any reason a winner does not take their prize by the date specified in the Terms and Conditions, the prize will be forfeited.
Winners must claim their prize by 12pm (AEDT) on 29 May 2019. If a prize has not been accepted or claimed by this time and date or if, after making all reasonable attempts, the Promoter can't contact the winner (or the winner does not contact the Promoter) by this time and date, the relevant entry will be discarded and the Promoter will re-award the relevant prize/s to the second best entry. The second best entry winner will be contacted by email and/or phone on 29 May 2019.
If a prize is unavailable, for whatever reason, the Promoter reserves the right to cancel the Promotion or provide another item of equal or higher value. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value.
If an entrant or their entry are deemed by the Promoter to breach these Terms and Conditions including if they are unable to book the prize by the date specified in these Terms and Conditions, their entry (or at the Promoter's discretion, all of their entries) may be discarded.
Entrants must not:
a. tamper with the entry process;
b. engage in any conduct that may jeopardise the fair and proper conduct of the Promotion;
c. act in a disruptive, annoying, threatening, abusive or harassing manner;
d. do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this Promotion;
e. breach any law; or
f. behave in a way that is otherwise inappropriate.
To the extent permitted by law the Promoter makes no representations or warranties as to the suitability of the prize.
Entrants consent to the Promoter using the entrant's (and their officers and agents) name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting any products or materials manufactured, distributed and/or supplied by the Promoter or the Prize supplier.
The Promoter is not responsible for any tax implications arising from the prize winnings. Winners should seek independent financial advice. If for GST purposes this Promotion results in any supply being made for non-monetary consideration, winners must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
Except for any liability that cannot be excluded by law, the Promoter is not responsible for and excludes all liability (including in negligence) for any personal injury, illness or death, or any loss (including indirect, special or consequential loss or loss of profits) or damage (direct or indirect) arising in any way out of (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any variation in prize value to that stated in these Terms and Conditions; (d) taking and/or use of a prize.
Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this Promotion are not liable for any loss of, damage to or delay in delivery of prizes.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such personal information to third parties, including prize suppliers. Entry is conditional on providing this personal information. If you have marked the “opt-in” box on the entry form, you consent to the Promoter keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging. The Promoter reserves the right to cancel, change, suspend or amend the Promotion and these Terms and Conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Promoter’s control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure. Any changes to the Promotion will be notified to entrants as soon as possible by the Promoter.
The Promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this Promotion.
